Absent: Pamela Bleiwas and Eric Levine Staff Present: Judy Drake, Donna Shaw, Dan Thaete, Susan Ritter, and Becky Jordan Mr. Howe called the meeting to order at 4:34 p.m. 1. Sheriff Derek Osbourne Quarterly Report-Pulled 2. Tompkins County Library Annual Report Teresa Vadakin, Assistant Acting Director stated the position for Director was posted June lst and provided an overview of programs and services offered by the library. Some access programs created during the pandemic such curbside delivery,library by mail,and hybrid&virtual programs have been so beneficial and successful they will be here to stay. Program numbers continue to increase. The library distributed 12,920 covid test kits,24,195 adult masks,and 6,000 youth masks thanks to the Tompkins County Health Department. The library has received a lot of positive praise since reopening on Sundays 1:00 p.m. — 5:00 p.m. as witnessed by 2,833 Sunday visitors. Ballet and Books is a favorite Sunday program. The library requests an additional $15k in support form the Town to maintain Sunday operations all year. Mr. Howe expressed appreciation for the library's shout out to its supporters, Town of Ithaca, Tompkins County, and Friends of the Library. 3. Public Hearing regarding the King Rd East Water Main Extension Improvement Project Public Interest Order increasing the amount to be expended Mr. Howe opened the public hearing at 4:42 p.m. Increasing the amount by $62,100 due to increased cost of asphalt, unforeseen conditions, and needing some flexibility contingency funds. There was no one wishing to address the board and the public hearing was closed. Consider award of Forest Home Crosswalk project Mr. Howe stated this is not to be confused with the Forest Home Walkway. TB Resolution 2022 -107: Authorization to award and execute contract for the 2022 Town of Ithaca Forest Home Crosswalk Whereas on June 10, 2022, the Town's Director of Engineering (Director) received proposals for the 2022 Town of Ithaca Forest Home Crosswalk Project. Whereas the proposal is to construct/install (2) concrete curb ramps, modify and install granite curbing, construct 25 linear feet of sidewalk, install a select limestone retaining wall, and perform associated miscellaneous grading and restoration, and Whereas the Director has reviewed and determined that the proposal of $28,000 made Procon Contracting, P.O. Box 1037 Vestal,NY 13851, is the best value for the Town; now therefore be it Resolved that the Town Board authorizes the Town Supervisor to award and execute the contract for the 2022 Town of Ithaca Forest Home Crosswalk Project to Procon Contracting, subject to final review by the Director and the Attorney for the Town, and be it further Resolved that the Director is authorized to approve change orders without further authorization from this Board,provided that the maximum amount of such change orders does not exceed$2000 in aggregate and the total project cost, including the contract, engineering, legal and other expenses, does not exceed the maximum authorized cost of the project of$30,000. Consider acceptance of concept and location of utilities and authorization to sign easement associated with the Westhaven Homes project Mr. Goodman stated EcoVillage at Ithaca Inc. will be signing the easements as they haven't yet transferred the land to Graham and Otto and because he is doing pro bono legal work for EcoVillage at Ithaca Inc. during this transaction, he is recusing himself from the vote. TB Resolution 2022 - 108: Acceptance of the Concept and Locations of Public Utilities to be Dedicated to the Town and Easements in Conjunction with the Westhaven Homes Subdivision Whereas, the Town of Ithaca Planning Board has granted Final Site Plan Approval for the proposed Westhaven Homes Subdivision located near the corner of Mecklenburg Road and Westhaven Road, Tax Parcel 28.-1-26.22, Medium Density Residential Zone and Planned Development Zone No. 8. The project involves subdividing eight lots from the EcoVillage at Ithaca, Inc. property for the purposes of single-family residential development. The project applicants, Ken and Graham Ottoson ("Applicants"), will extend existing potable water and TB 2022-06-27 (Filed 6/29) Pg. 4 sanitary sewer infrastructure. The extensions will occur on properties currently owned by EcoVillage at Ithaca,Inc.,Jane Atkin,and Barbara Parker(formerly known as Barbara P.Johnson) (collectively, the "Property Owners"), and Whereas,the Applicants have proposed to dedicate to the Town the potable water extension and the sanitary sewer extension, and the Property Owners are willing to convey the associated water and sewer easements, and Whereas, the water main extension, sewer line extension, and associated easements are shown on the drawing titled "Subdivision Map, Lands of Ecovillage at Ithaca Inc., Westhaven Road, Town of Ithaca, Tompkins County, New York" dated February 1, 2022, last revised June 24, 2022, prepared by T.G. Miller, P.C. Engineers and Surveyors, and Whereas,the Public Works Committee has reviewed the plans for the above improvements that are proposed to be dedicated to the Town, and have found them generally acceptable, and voted to move the request to the Town Board for further discussion and consideration, now therefore be it Resolved, that the Town Board hereby accepts the concept and locations of the above- described improvements, approves the Permanent Water Easement and Right-of Way and the Permanent Sewer Easement and Right-of Way from EcoVillage at Ithaca, Inc., approves the Permanent Sewer Easement and Right-of-Way from Jane Atkin, approves the Permanent Water Easement and Right-of-Way from Barbara Parker, and authorizes the Town Supervisor to execute the four easements, subject to the following conditions: 1. The approval of the four easements and authorization for their execution by the Town Supervisor are subject to the approval of the Attorney for the Town. 2. The specific surveyed and/or mapped locations,deeds,and abstracts showing good and marketable title for the proposed improvements and for the four easements are submitted in a form acceptable to the Attorney for the Town and Director of Engineering, prior to Town Supervisor execution of the four easements, and prior to dedication and acceptance of the improvements by the Town Board. 3. The water and sewer extensions and related appurtenances to be dedicated to the Town are completed to the satisfaction of the Director of Engineering,prior to the acceptance of the improvements by the Town Board, which acceptance is in the Town Board's discretion. Committee Reports a) Budget—Ms. Shaw reported discussion about the procurement policy currently under revision, interest rates going up, where to invest CD coming due in July, budget amendments and property tax override that are on tonight's agenda. TB 2022-06-27 (Filed 6/29) Pg. 5 Mr. Howe explained the amendment to chapter 239 Town of Ithaca code taxation updating income tables is for senior citizens with limited income increasing the income amount by $1,000 as suggested by Jay Franklin to put us in line with where the County is. TB Resolution 2022 — 109: Setting Public Hearings regarding proposed local laws to Override the Tax Levy Limit Established in General Municipal Law 0-c and Amending Town of Ithaca Code Chapter 239,Taxation, to update income tables for certain exemptions Resolved that the Ithaca Town Board will hold Public Hearings on July 11, 2022 during their meeting which begins at 5:30 p.m., local time, held virtually by the ZOOM platform, accessed at www zooin._cot'n or by calling 929-436-2866 and entering the Meeting ID 9891 095 8241, regarding the adoption of proposed local laws: 1. To override the tax levy limit established in General Municipal Law §3-c, for the fiscal year beginning January 1, 2023 and ending December 31, 2023, and 2. Amending Chapter 239 of the Town of Ithaca Code, "Taxation", updating income tables for§239-2A Grant of exemption(Senior Citizens with Limited Income)and§239-12 Grant of exemption; conditions (Certain Disabled Persons with Limited Income) Comments may be submitted prior to the public hearing via mail to 215 N. Moved: Rod Howe Seconded: Rob Rosen Vote: ayes— Howe, DePaolo, Goodman, Johnson, and Rosen b) Public Works—Mr. Howe reported that at the last meeting of June 21st they discussed Sand Bank Rd and restricting by length trucks that go up there. The process of changing over the streetlights has begun. As of last week, there were about 50 completed. Joe is starting to get calls from people recognizing they need a streetlight. May set aside money in the future for adding more streetlights. Found some streetlights that were not on the overall plan. Mr. Thaete collecting complaints and requests. Discussed fleet replacement for 2023. Expense and availability of green fleet. With costs going up we're looking at what can be pushed off and what needs to be addressed in next couple years. c) Personnel and Organization/ERC—Ms. Drake reported that the personnel committee continued discussion of sick time maximum and retiree health, had first look at staffing plans for TH and PWF in preparation for the 2023 budget process. TB Resolution 2022 - 110: Adoption of Revised Personnel Policies-Vacation Buy Back, Sick Time Maximum and Retiree Sick Time Maximum Whereas, the Personnel & Organization Committee has reviewed and recommend the revised Vacation Buy Back, Sick Time Maximum and Retiree Sick Time Maximum for all non- collective bargaining staff of the Town; now, therefore, be it TB 2022-06-27 (Filed 6/29) Pg. 6 Resolved, that the Town Board approves the revised Vacation Buy Back, Sick Time Maximum and Retiree Sick Time Maximum for all non-collective bargaining staff of the Town. Moved: Margaret Johnson Seconded: Rod Howe Vote: ayes—Howe, DePaolo, Goodman, Johnson, and Rosen Ms. Drake reported the need to address changes in NYS law for marijuana and one of the questions that came up in engagement surveys and through discussions at safety committee are our testing policy outside CDL. There is a recommendation for pre-employment testing for anyone who will drive employer vehicles. Mr. DePaolo commented that he doesn't comprehend the effectiveness of the program. For everyone who fails a drug test there's someone else who has figured out how to pass so we have no way of really knowing whether they're a user anyway. Not in favor of pre-employment nor random testing. Mr. Rosen stated he is not in favor of pre-employment drug testing unless they need a CDL. Mr. Goodman stated he is leaning toward not in favor unless we include anyone who uses town vehicles but to be fair,he recalls using a town vehicle occasionally while he was supervisor and deputy supervisor. Note: He did have to take the safe driver course as all town employees do that use town vehicles. Mr. Howe stated he is not opposed. Ms. Johnson referenced a). expectation that staff will not be impaired while at work, it's a violations of the drug free workplace policy to use legal drugs while on the job. Wondering if the language is too broad and the word"legal"would unintentionally be read to prevent someone from taking needed medication that doesn't impair them. I think what we want to address is that marijuana is now legal, and we want to include it as prohibitive on the job. Also share concerns expressed. It simply may not be as effective as we hope in preventing hiring folks with chronic problems however, I do take into consideration that there's a surprising number of situations where someone doesn't take the trouble to gain the test and that is a signal of something. Having the ability to test and weed those folks out could prevent accidents so not ready to say we shouldn't. Ms. Drake stated they discussed how to address the legal aspect of some drugs and further discussion will ensue. What we want to stop is the sale, purchase, or illegal transfer of legal drugs. Mr. DePaolo stated there could be a distinction drawn under the category of legal drugs to make it clear we're talking about drugs that are contraindicated for driving or operating heavy equipment. Usually, prescription drugs come with a warning. There are plenty of legal prescription drugs that don't have any effect on someone's ability to do one's job. In referencing language in memo section c)., last sentence, reasonable suspicion, what does that mean? TB 2022-06-27 (Filed 6/29) Pg. 7 Ms. Drake stated that a supervisor can have reasonable suspicion which will trigger a random test. Mr. DePaolo asked if we've had a history of drug/alcohol impairment on the job that has led to safety issues, accidents or other undesirable outcomes? Ms. Drake responded yes, we have had issues and concerns with staff at all 3 locations during her 25 years here. Mr. DePaolo asked if we can count the number on one hand in the past 25 years? Ms. Drake responded it is creeping to two hands. On another note, the picnic flyers have gone out. Anyone with door prize donations reach out to Judy. <insert resolution adopt revised personnel policy> d) Codes & Ordinances—Mr. Goodman reported that the June meeting was canceled. Next meeting is Wednesday, July 6th. Hoping for revised telecommunications law amendments back from the Attorney for the town. Not anticipating getting into the big topic of setback distances from small cell facilities until August. Will report back to the town board at August study session and hope to have a draft law to bring to town board in September. e) Planning—Mr. DePaolo reported that they heard from Noah Demarest, project manager of Stream Collaborative, developer for RaNic Golf Club. Shown a draft sketch plan and PDZ for consideration of which we did not have time to review. This plan has moved a lot of what was envisioned for the village of Cayuga Heights to the Town of Ithaca. Approved Attorney comments on the Inlet Valley overlay. Staff comments raised will be addressed at next draft. Eagerly awaiting word from City of Ithaca Attorney regarding collaboration with the Ithaca Landmarks preservation commission to see if that can potentially be incorporated into the zoning language so we have some sort of established body that can determine whether properties are eligible for designation. Potential modifications with NNC following discussions with major stakeholders and consultants. There's more to be done on Community Choice aggregation. Have started to meet periodically with common council representatives and planning staff from the City of Ithaca to discuss areas of mutual interest and concern. One of the topics that came up was review of the landmark's preservation commission merger. Discussion of the potential semi- permanent encampment for the homeless and the implications on the town. Next meeting September. f) Parks, trails, recreation - Mr. Howe announced tree planting event Oct 1 at the preserve on East Hill. Mr. Goodman reported still trying to work out easement language with NYSEG for extending the South Hill trail beyond Burns Rd where it ends in our town into Dryden, Danby and Caroline. We were hoping for comments returned from other municipalities by now to bring actual documents before all four town boards in July. Trying to push NYSEG forward for a TB 2022-06-27 (Filed 6/29) Pg. 8 negotiated draft for public hearing. Some adjoining landowners may have concerns about the trail extension. Talking about applying for a state grant for a feasibility study for work that will need to be done along segments of the trail to make it usable. Was hoping for a CFA grant by end July but there are other grant opportunities available we can seek such as county tourism. Have been working on the Black Diamond Trail with Scott Doyle from county planning trying to figure out the last two pieces of property that is privately owned. Mr. Howe reported that the City of Ithaca obtained funding to help make a connection between the towns gateway trail and where the Black Diamond trail ends. We've been working with the town of Dryden and the county. We have our East Hill Recreation Way and the town of Dryden has a trail in between on Game Farm Rd so the department of transportation has agreed to lower the speed limit to 45 mph. Waiting for another meeting between county and other two towns to figure out next steps on a safe crossing connecting the two trails.
