Board Members Present: Rod Howe, Supervisor; Members Eric Levine, Rich DePaolo, Bill
Goodman, Pamela Bleiwas, Rob Rosen and Margaret Johnson

Mr. Howe opened the meeting at 5:30 p.m.

3. Public Hearings regarding proposed local laws:
a. Authorizing a monetary gift to the City of Ithaca to support Cass Park and
Stewart Park recreational facilities. ($58,000)
Mr. Howe opened the public hearing at 5:32 p.m. There was no one wishing to speak and the
hearing was closed.
Mr. Howe noted this was an annual requirement.
Mr. DePaolo asked about the statistics this was usually based upon and Mr. Howe responded that
with the COVID pandemic, we have not received any report,but are using the amount usually
used.
TB Resolution 2022 -020: Adopt Local Law 1 of 2022: A Local Law authorizing a Monetary
Gift to the City of Ithaca to Support Cass Park and Stewart Park Recreational Facilities
Whereas, the Town Board discussed the need for monetary support for the Cass Park and Stewart
Park Recreational Facilities during its budget process, and
Whereas, the Town Board adopted a budget for 2022 including an amount of$58,000.00 for a
contribution towards City Parks, of which approximately$40,000 would result in a special benefit
to Town residents, but the remainder would be considered a gift, and

Whereas, pursuant to the Town's New York State Municipal Home Rule powers, a local law may
be adopted to authorize the Town to make a gift to another municipality where the gift furthers a
public purpose of the Town, and
Whereas, at its meeting on January 10, 2022, the Town Board discussed the proposed local law
and set a public hearing for February 14, 2022,to hear all interested parties on the proposed local
law which was legally advertised and held, and
Whereas, pursuant to the New York State Environmental Quality Review Act("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval of the local law is a Type lI action because it constitutes "routine or continuing agency
administration and management,not including new programs or major reordering of priorities that
may affect the environment," and thus approval of the local law is not subject to review under
SEQRA,
now therefore be it
Resolved, that the Town Board hereby adopts Local Law 1 of 2022 entitled "A Local Law
authorizing a Monetary Gift to the City of Ithaca to Support Cass Park and Stewart Park
Recreational Facilities."

TB Resolution 2022 -021: A Local Law adding Chapter 202 to the Town of Ithaca Code,
titled"Food Trucks"
Whereas, the Town of Ithaca Code currently does not regulate food truck operations; and
Whereas, food trucks continue to grow in popularity as a source of prepared food; and
Whereas, the Planning Committee discussed the proposal to regulate food truck operations in the
town at their July and August 2020 meetings; and
Whereas the Planning Committee reviewed and revised the draft local law, which regulates how
food trucks can operate in the town, at their February, April, October, and December 2021
meetings and referred it to the Town Board; and

Whereas, the Town Board discussed the proposed local law at its meeting on January 10, 2022,
and scheduled a public hearing for February 14, 2022, to hear comments from all interested
parties, which was legally publicized and held; and
Whereas, pursuant to the New York State Environmental Quality Review Act("SEQRA") and
its implementing regulations at 6 NYCRR Part 617, adoption of said local law is a Type II
Action, because food trucks are considered minor temporary uses of land having negligible or no
permanent impact on the environment(Section 617.5(c)(21), and adoption of said local law
constitutes routine or continuing agency administration and management, not including new
programs or major reordering of priorities that may affect the environment (Section 617.5(c)(26),
and is related to inspections and licensing activities relating to the qualifications of individuals or
businesses to engage in their business or profession (Section 617.5(c)30); and
Whereas, the Town Board finds that the proposed local law will further the health and welfare of
the community; now, therefore,be it
Resolved, that the Town Board of the Town of Ithaca hereby adopts Local Law 2 of 2022
entitled A Local Law Adding Chapter 202 to the Town of Ithaca Code, titled"Food Trucks."

TB Resolution 2022 -022: SEAR: Proposed Local Law Adding Provisions Regarding
Barns on Non-Farm Lots,Auitourism, and Seasonal Farm Lodging Facilities in the
Agricultural Zone to Chapter 270,Zoning, of the Town of Ithaca Code
Whereas, this action is the enactment of a local law adding provisions regarding barns on non-
farm lots, agritourism, and seasonal farm lodging facilities in the Agricultural Zone to Chapter
270, Zoning, of the Town of Ithaca Code; and
Whereas, this is a Type I Action for which the Town Board is acting as
Lead Agency in an environmental review with respect to the enactment of this local law; and
Whereas, the Town Board, at its regular meeting held on February 14, 2022, has reviewed and

accepted as adequate the Full Environmental Assessment Form (FEAF), Parts 1, 2 and 3, for this
action, prepared by the Town Planning staff, now, therefore, be it
Resolved, that the Town Board hereby makes a negative determination of
environmental significance in accordance with Article 8 of the Environmental Conservation
Law, 6 NYCRR Part 617 New York State Environmental Quality Review, and Chapter 148
Environmental Quality Review of the Town of Ithaca Code for the above-referenced action as
proposed, based on the information in the EAF Part 1 and for the reasons set forth in the EAF
Parts 2 and 3, and, therefore, a Draft Environmental Impact Statement will not be required.

TB Resolution 2022 -023: A Local Law Adding Provisions Regarding Barns on Non-Farm
Lots,Agritourism, and Seasonal Farm Lodging Facilities in the Agricultural Zone to
Chapter 270, Zoning, of the Town of Ithaca Code
Whereas, the proposal involves adding two new uses to the Ag Zone, specifically "agritourism"
and"seasonal farm lodging facilities", along with allowing barns to be a principal building that is
not part of a farm; and
Whereas, the Planning Committee reviewed the proposed amendments at several meetings in
2021 and at their December 16, 2021 meeting, recommended the amendments be forwarded to
the Town Board for consideration of approval; and
Whereas, at its meeting on January 24, 2022, the Town Board discussed the proposed local law,
and a public hearing was scheduled for February 14, 2022, at 5:30p.m. to hear all interested
parties on the proposed local law, which was legally advertised and held, and
Whereas, pursuant to the New York State Environmental Quality Review Act("SEQRA") and
its implementing regulations at 6 NYCRR Part 617, adoption of said local law is a Type I Action
for which the Town Board of the Town of Ithaca, acting as lead agency in an environmental
review with respect to adoption of this local law, has, on February 14, 2022, made a negative
determination of environmental significance, after having reviewed and accepted as adequate the
Full Environmental Assessment Form Parts 1, 2 and 3, and
Whereas, the Town Board finds that the proposed local law will further the health and welfare of

Mr. Howe opened the public hearing at 5:40 p.m.
Caroline Arms spoke, saying that she is a frequent user of the intersection and she thinks it is a
big improvement. (Attachment 1 written comments)
Bruce Brittain also spoke in favor of the action.
There was no one else wishing to speak, and the hearing was closed.
There were no comments from the Board.
TB Resolution 2022 -024: Adoption of Local Law 4 of 2022 amending Chapter 250 of the
Town of Ithaca Code, titled "Vehicles and Traffic" by adding two stop signs at the Forest
Home Drive Arboretum Road intersection
Whereas, the Town received a request from Cornell University for a crosswalk to connect an
existing trail network along Beebe Lake to their Facilities on Arboretum Road, and
Whereas, after further review of the request, Town Engineering and Public Works Departments
determined the request from Cornell would be a midblock cross walk on a town road that has a
functional classification of a major collector road and would therefore be a safety concern, and
Whereas, the Departments proposed that the best way to mitigate the safety concerns would be to
make the intersection of Forest Home Drive and Arboretum a 3-way stop intersection, and
Whereas, the proposal was discussed at the Town of Ithaca's Public Works Committee on
October 19th, 2021, and recommended it to the Town Board for approval, and
Whereas, the Town Board agreed with the recommendation and set a public hearing for February
14, 2022, on the proposed local law to enable the installation of two additional stop signs at the
intersection, which was legally advertised and held, now, therefore be it;
Resolved, that the Town Board adopts Local Law 4 of 2022 authorizing the placement of two
new stop signs on Forest Home Drive at the intersection of Forest Home Drive and Arboretum
Road.

Mr. Howe gave an overview of the role of the Assessment Review Board for new members.
Mr. DePaolo and Mr. Levine volunteered to serve as they have in the past. Ms. Bleiwas offered
to be the alternate.
TB Resolution 2022 - 025: Appointment to the Town's Local Assessment Review Board
Whereas Tompkins County Assessment has decided to reinstitute a Local Assessment Review
Board, now therefore be it
Resolved that Rich DePaolo and Eric Levine are appointed to the Local Assessment Review Board
for the Town of Ithaca as required by Tompkins County Assessment with Pamela Bleiwas
serving as an alternate.

1 am Caroline Arms, of 200 Forest Home Drive.
I am a frequent user of the intersection in question as a pedestrian and I see the proposal to make it a 3-way stop as a
big improvement from that perspective. In particular, if I want to cross Forest Home Drive from the path round Beebe
Lake towards the Botanic Gardens, I have a problem. The current mid-block crosswalk to the north of the intersection is
useless because Cornell has ceased maintaining the path it connects with. To cross to Arboretum Road,the visibility is
bad in both directions, but particularly to the west along the southern side of Beebe Lake.
Meanwhile, I am aware that Cornell has required a new ADA-compliant crosswalk on the western side of the
intersection as part of the easement agreement with the Town that allows the Forest Home Walkway to use its existing
route,which cuts over Cornell land.
A 3-way stop will allow that crosswalk without the visual clutter of yellow warning signs and also corresponds to the
proposal for that intersection in the 2007 Forest Home Traffic Calming Report.
I am supporting the proposal for a 3-way stop, which requires the Town to add two stop signs, as an individual, but Herb
Engman,the current president of the Forest Home Improvement Association is also in favor of the proposal. He is
unable to attend tonight, but has seen the existing crosswalk situation at the intersection as a problem for decades,
remembering when he used to walk that way to work every day before retiring from Cornell.

Monday and asked that people take notes to share with the Board and Team.

• Fire Lieutenant Scott Eaton has submitted a letter of intent to retire on March
6, 2022. One of our recruit firefighters hired in August of 2021 resigned on
January 3, 2022.

c) Hiring/Promotions in 2021
• In 2021, eight new firefighters were hired and trained to fill vacancies created
by retirements during 2020 and 2021.
• Two more firefighters positions were added to the Fire Department Roster in
July 2021,raising the number of funded firefighter positions from 49 to a pre-
pandemic roster of 51. Those firefighters were hired and trained over the
summer and fall of 2021.
• On September 5, 2021, Assistant Chief Robert Covert was promoted to
Deputy Fire Chief, Lieutenant George Apgar II was promoted to Assistant
Fire Chief, and Firefighter Richard Brown was promoted to Fire Lieutenant.
d) Firefighters on Injury Leave or Light Duty
• There is one fire lieutenant who is on long-term injury leave. There is one
firefighter who is on Light-Duty for Maternity,but we expect the firefighter to
return to full duty in August or September of 2022.
2) Budget Report
a) 2021 Budget: Budget Summary is attached to this memo (The 2021 budget has
not been closed out,but it is expected to be closed soon)
4) Grants and Donations
a) In 2021, we applied for two FEMA Assistance to Firefighting Grants. The first
grant application is requesting funding to replace our 31-year-old Heavy Rescue,
and the second grant application is requesting funding to replace 63 Portable
Radios.
5) Apparatus
a) One Staff Vehicle was purchased and delivered in 2021.
b) One Pumper truck ordered in 2020 was delivered in the spring of 2021.
c) Common Council approved a Capital project for 2021 to replace a 2001 Pumper
Truck reaching its end of service life. The Pumper Truck has been ordered and
will be delivered in the fall of 2022.
6) Fire Training Center and Fire Station Study
The fire training was used regularly in 2021,but due to structural damage and needed
repairs, the live-fire training building has not been used for live-fire training. The

training center has been inspected twice in the last 4 years, and significant repairs or
replacements are needed to use it for live-fire training.
It was in 1989 when the Central and East Hill Fire Stations were renovated, and the South
and West Hill Fire Stations were Constructed. All four fire stations are in need of
significant and costly repairs and renovations. Improvements to each building's energy
systems and building envelope are a high priority for future work.
A capital project to study replacement of the training center, as well as renovations and
repairs of Central Fire Station, the West Hill Fire Station, and the South Hill Fire Station,
was approved in 2021 by the City's Common Council. The City is currently looking into
the relocation of the East Hill Fire Station. A request for expressions of interest was
advertised to local developers to determine if there was interest in acquiring the current
East Hill Fire Station and assisting with the relocation or colocation of a new Fire Station.
The City is currently evaluating a proposal from a local developer.
