TOWN OF ITHACA
LOCAL LAW NO. 3 OF THE YEAR 2022
A LOCAL LAW ADDING PROVISIONS REGARDING BARNS ON NON-FARM LOTS,
AGRITOURISM,AND SEASONAL FARM LODGING FACILITIES IN THE
AGRICULTURAL ZONE TO CHAPTER 270, ZONING, OF THE TOWN OF ITHACA CODE
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Chapter 270 (Zoning), Article III (Terminology) of the Town of Ithaca Code,
Section 270-5, titled "Definitions,"is amended by adding the following two definitions:
AGRITOURISM
Activities conducted as part of farm operations and offered to the public or to invited
groups for the purpose of recreation, education or active involvement in the farm
operation, and which are related to agricultural or natural resources and incidental to the
primary farm operation on the site. Agritourism activities include farm tours, hayrides,
corn mazes, a-pick operations, farm festivals, youth and/or adult education activities
related to agricultural products or skills, and similar uses.
SEASONAL FARM LODGING FACILITIES
Temporary tent or yurt lodging facilities used in conjunction with and as part of farm
operations, in which guests live while participating in the farming activities for the
purposes of learning about farm life or while supporting and providing temporary labor to
the farm operations.
Section 2. Chapter 270 (Zoning), Article VI(Agricultural Zones) of the Town of Ithaca
Code, Section 270-26, titled"Permitted principal uses," is amended by adding a new subsection
P reading as follows:
"P. In addition to the uses of barns as principal buildings on farm lots or for farm purposes
pursuant to Subsection A, a barn building may be a principal building on a lot that is not
used as a farm. Any such barn building may be used for any of the permitted principal
uses in the Agricultural Zone, subject to the requirements in this article and chapter. A
building permit may be issued for construction of another principal building on the lot,
provided that the barn building becomes an accessory building to the other building upon
issuance of a certificate of compliance for the other building. If a barn building becomes
an accessory building pursuant to this provision, its uses as an accessory building are
subject to the requirements of this article and chapter. A barn building that becomes an
accessory building pursuant to this provision may exceed or contribute to the exceedance
of the cumulative square footage limit for accessory buildings in § 270-29D, provided
that no expansion of the barn building or other accessory buildings is allowed once the
cumulative square footage limit is met."

Section 3. Chapter 270 (Zoning), Article VI(Agricultural Zones) of the Town of Ithaca
Code, Section 270-29, titled "Permitted accessory buildings and uses,"is amended by adding a
new subsection M reading as follows:
"M. Agritourism."
Section 4. Chapter 270 (Zoning), Article VI(Agricultural Zones) of the Town of Ithaca
Code, is amended by adding new Section 270-30, titled"Accessory buildings and uses
authorized by special permit only" and reading as follows:
"§ 270-30 Accessory buildings and uses authorized by special permit only.
A. Seasonal Farm Lodging Facilities
(1) Yurts and/or tents placed on a platform and used solely as seasonal farm lodging
facilities.
(a) No more than 10 tents or yurts, or any combination thereof, are permitted.
(b) No yurt or tent may be larger than 735 square feet, and all such yurts and tents in
the aggregate may not exceed a total of 5,500 square feet.
(c) In addition to sleeping facilities, seasonal farm lodging facilities may include
related bathroom/shower, laundry, and/or kitchen facilities in the same tents/yurts
that contain sleeping facilities, or in tents/yurts that do not contain sleeping
facilities.
(2) Yurts and tents may be erected for no more than 180 days in any calendar year."
Section 5. In the event that any portion of this law is declared invalid by a court of
competent jurisdiction, the validity of the remaining portions shall not be affected by such
declaration of invalidity.
Section 6. This local law shall take effect immediately upon its filing with the New York
State Secretary of State.
