MINUTES
Board Members Present: Rod Howe, Supervisor; Members Eric Levine(6pm), Rich DePaolo,
Bill Goodman, Tee-Ann Hunter, Pat Leary and Pamela Bleiwas
Staff Present: Susan Brock, Attorney for the Town; Judy Drake, Director of Human Resources;

1. Call to order and pledge of allegiance—Mr. Howe opened the meeting at 5:33p.m.

Added item—Authorization to establish a line of credit
Mr. Howe stated that the resolution was sent earlier and asked if there were any questions. There
were none.
TB Resolution 2021 — 133: Authorization for the Town of Ithaca to open a Line of Credit
Account at Tompkins Trust Company and for the Supervisor to sign a Letter of Credit for
NYSEG on behalf of the Town Board
Whereas the Finance Manager has determined a need for the establishment of an account at
Tompkins Trust Company and associated Line of Credit required by NYSEG for the Streetlight
Replacement/Ownership Project, and
Whereas NYSEG requires an irrevocable letter of credit and Tompkins Trust Company requires
a resolution from the Town Board designating the person(s) authorized to sign said Letter of
Credit, now therefore be it
Resolved that the Town Board of the Town of Ithaca hereby approves and authorizes the
establishment of a line of credit not to exceed $60,000.00 and designates and authorizes the Rod
Howe, Town Supervisor or Deputy Town Supervisor William Goodman, to execute the
necessary documents to establish the account and sign the Letter of Credit.

TB Resolution 2021-134: Ratify Southern Cayuga Lake Intermunicipal Water
Commission 2022 Wage Scale and Employee Wages
Whereas, the Commission on October 7, 2021, approved the 2022 Wage Scale and Wages for all
Commission staff, now, therefore,be
Resolved, the Town Board of the Town of Ithaca does hereby ratify approval of the 2022 Wage
Scale and Wages for all Commission staff as filed in the Human Resources Office.

4. Approval of Town Employee Wages

TB Resolution 2021-135: Approval of 2022 Employee Wages
Whereas, the governing Town Board of the Town of Ithaca has reviewed the proposed wages for
the Town of Ithaca non-collective bargaining employees for the year 2022,utilizing the 2.5%wage
scales approved by the Town Board August 9, 2021; and
Whereas, the Town Board has reviewed the wages established by the collective bargaining
agreement with the Public Works unit represented by Teamsters Local 317; now, therefore, be it
Resolved, the Town Board of the Town of Ithaca does hereby approve the said wages for the non-
collective bargaining employees and collective bargaining employees for 2022, as filed in the
Human Resources Office.

5. Public Hearing regarding the Preliminary 2022 Town of Ithaca Budget
Mr. Howe opened the public hearing at 5:38 p.m. there was no one wishing to address the board
and the hearing was closed.

Mr. Howe thanked Ms. Shaw and the Budget Committee for their work on the budget and noted
that there is a 3-page summary at the beginning which has a great summary.
This year's budget will actually decrease about 3.43% from last year, or about $900K; the tax
levy will decrease by $46K. This is due to the increased taxable assessed value of town
properties, up a bit from last year about 1.9%. We are staying under the 2% tax cap and the
typical house, $300K, will have a 1.27% increase at about$25.30 per 1,000.
TB Resolution 2021 - 136: Adoption of the Town of Ithaca 2022 Budget
Whereas the Town Board held a public hearing on Monday, October 18, 2021, to hear comments
regarding the 2022 Preliminary Budget, and
Whereas the Town Board discussed, reviewed, and made any changes properly put forth and
voted upon to the 2022 Preliminary Budget, now therefore be it
Resolved that the Town Board of the Town of Ithaca hereby approves and adopts the 2022
Preliminary Budget as the Final 2022 Town of Ithaca Budget.

6. Amabel requests for change in building permit fee and refund of penalty costs
Mr. Moseley gave an overview, stating that Ms. Cosentini has requested a change in the building
permit fee structure for her development houses and a refund of the penalty fee assessed due to
her starting work without a permit. He referred the Board to his memo.
The applicant was informed that work should not begin prior to the issuance of a permit. The
building permit fee is $1,400 and when work was started, the additional "building without a
permit fee"was charged, which is $100 or 50% of the original permit fee.
The applicant has also requested a reduction in the permit fee because she feels the inspections
are repetitive given the nature of the buildings and the four models she is using.
We did do a search and there does not seem to be any precedent for that type of reduction.
At this point, the Department has conducted 14 inspections, including plan overview, and we
anticipate an additional 10 inspections for a total of 24, which on average are 1 hour long. The
$1,400 fee divided by the 24 inspections comes to $58, which does not include the 70+ emails
the inspector has dealt with up to this point, or the time I have spent on this, as well as other
town staff.

Mr. Howe added that this has been a very difficult development with issues along the way and
the town has worked very closely with her and others to address issues as they have come up to
the best of our ability, and I think we have been a good partner.
Mr. DePaolo asked if there is anything related to the review of replica homes that would reduce
the amount of time involved in inspections and review.
Mr. Moseley responded that the process is the same no matter what except for possibly the plan
review is a little shorter,but they do allow for variations in these models we still need to review
them. The inspection process is the same; each one has to be set and different installations as
well as the foundations. He did not think there is any difference.
Mr. DePaolo asked if the homes were staged in such a way as to allow for a site visit to cover
multiple homes, instead of multiple site visits, would that make a difference, and do we know if
that is her plan?
Mr. Moseley responded that we have only one building permit and he was not sure what the
process is going to be for the next or the future.
Mr. DePaolo stated that this always comes to the recoupment of staff time and if the estimation is
that time is not going to be significantly reduced by virtue of these homes being similar or
somewhat identical, then we would have to deny the request.
Mr. Moseley added that he could not see any significant reduction in time is similar
developments recently such as the Belle Sherman Cottages and Maplewood. Both had multiples
of similar buildings or what is called modular construction, and there was no significant
reduction in staff inspections and time involved.
Mr. DePaolo asked if these permit prices were a surprise because she seems to be making this
request as if it were a surprise to her or is this something that should have been known and
figured into the construction costs.
Mr. Moseley responded that she is aware of the Code Fee Schedule as she has worked in the
town before, it is posted online as well as in the permit application process. Permit fees are based
on the cost of the project.
Mr. Howe turned to the $1,400 penalty levied on her, and where did that come from.
Mr. Moseley stated that we had not issued the permit to her when she started the foundation.
She was also told not to begin work prior to the issuance of the permit. We were in the process
of issuing it, but it had not been issued and we had warned her not to start work. She requested
an inspection before the permit was issued, and at that point in time, it was evident that she had
started several times and we had warned her that if you start work, it is a double permit fee.
Mr. Howe noted that there is no resolution proposed;just wanted to know whether this was
something you wanted to consider, we could draft a resolution.

Mr. Goodman asked, as far as the penalty, isn't a foundation only permit a way to begin some
work while a permit is processing and did she ask for one?
Mr. Moseley responded that she did not, and we were in the process, about 3 days out, from
issuing her the building permit for the first home, when she started foundation work, that was the
work that was started that triggered the additional fee.
Mr. Goodman asked what the $2,400 fee is she is referencing in her emailed request.
Mr. Moseley said he would assume she is factoring in the other permitting fees such as an
external plumbing permit and any other permits she may need for each home.
Mr. Thaete spoke, saying that Engineering recently went through a calculation of the external
plumbing permit and although only one or two site visits may be needed, there is a lot of plan
review and behind the scenes work.
Ms. Cosentini started the sewer lateral work for this home before she had obtained that permit
also and we did not charge her the double fee for that action. We overlooked it and just verball
"slapped"her on the wrist kind of thing, and then she went ahead and put the pipes in the ground
before she had a permit.
Mr. Goodman asked if the base permit is $1,400, what is the price range of the homes.
Mr. Moseley responded the fee of$1,400 is based on a price range of$100K- $35OK,
construction costs, and she listed a $200K range for price.
Mr. Goodman stated that he feels the town under charges in a lot of these pyramid type fees
because there are lots of costs associated with people going out for inspections other than the
time of actual inspection; benefits, vehicles, administrative, and other costs. He said he was not
inclined to reduce the permit fee to a flat $600 per home as requested.
As for the penalty was known and is there to stop people from getting started before they have a
permit and there is a foundation permit only she could have availed herself of and she did not.
Ms. Bleiwas stated that the town's P&O Committee and the staff is very thorough in determining
fees and they answer a lot of questions from committee members in determining and evaluating
the rates. She said she was not inclined to reduce a fee just for asking and she did not see a good
cause shown to do so.
Ms. Hunter said she agreed with Ms. Bleiwas but asked for clarification that the $200 was the
construction cost, not the sale of the home cost.
Mr. Moseley agreed, saying the application states $200K for the house and Mr. Howe added that
he believes they are being marketed and sold for around $300K or more.
Ms. Leary said she agrees with the other statements and does not see a reason to move forward.

Mr. DePaolo asked about the penalty; saying she seems to be saying she was under the
impression that she could go forward and made a point in her email that she had been given an
indication that the issuance of the permit was imminent and that there were no obstacles between
point a and b. He asked if this was a case of her being asked to remedy something and she
didn't and went ahead anyway.
Mr. Moseley responded that that conversation was concerning a State DOT permit for the
southern end connection, and I told her there shouldn't be an issue now and we can proceed with
the permit, but she needed to check with the inspector assigned to the project to see where they
were in the review process of the building permit.
Mr. DePaolo stated that as usual, it is more complicated than as presented. The consensus of the
board was no action was necessary and the fee schedule is researched, discussed and set.
7. Consider approval and authorization for the Supervisor to sign the 2022
Amendment to the Municipal Cooperative Agreement—Health Consortium
Ms. Drake stated that this is an annual requirement under the bylaws of the Consortium and we
are adding four additional municipalities in 2022.
TB Resolution 2021 -137: Approval of the 2022 Amendments to the Municipal Cooperative
Agreement for the Greater Tompkins County Municipal Health Insurance Consortium
Whereas, the Town of Ithaca is a Participant in the Greater Tompkins County Municipal Health
Insurance Consortium (the "Consortium"), a municipal cooperative organized under Article 47 of
the New York Insurance Law, and
Whereas, the municipal participants in the Consortium, including this body, have approved and
executed a certain Municipal Cooperation Agreement(the "Agreement"; effective date of October
1, 2010), and
Whereas, Article 47 of the New York Insurance Law and the rules and regulations of the New
York State Department of Financial Services set forth certain requirements for governance of
municipal cooperatives that offer self-insured municipal cooperative health insurance plans, and
Whereas, the Agreement sets forth in Section Q2 that continuation of the Consortium under the
terms and conditions of the Agreement, or any amendments or restatements thereto, shall be
subject to Board review and upon acceptance of any new Participant hereafter, and
Whereas, by motion 001-2021 the Consortium's Board of Directors recommends approval of the
2022 Amended Agreement, and
Whereas, the Municipal Cooperative Agreement requires any amendments be presented to each
participant municipality for review and adoption by its municipal board, and

Whereas,the Town of Ithaca is in receipt of the proposed amended Agreement and has determined
that it is in the best interest of its constituents who are served by the Consortium to amend the
Agreement as set forth in the attached 2022 Amended Municipal Cooperative Agreements, now
therefore be
Resolved, that the Ithaca Town Board hereby authorizes the Town Supervisor to sign the 2022
Municipal Cooperative Agreements of the Greater Tompkins County Municipal Health Insurance
Consortium, and
Resolved, further, that the Town Clerk of the Town of Ithaca is hereby authorized to execute this
Resolution to indicate its approval, transmit a copy thereof to the Board of Directors of the Greater
Tompkins County Municipal Health Insurance Consortium, and take any other such actions as
may be required by law.

Whereas, a municipal online auction is held from time to time hosted by RTI auctions located in
Geneseo, NY, and
Whereas, certain items have become surplus/no longer needed by the Town, and
Whereas, the Town wishes to put the following surplus equipment in an online auction in
November:

TB Resolution 2021 -138c: Approve Permanent Appointment of Director of Code
Enforcement and Electrical and Code Enforcement Officer
Whereas, Martin Moseley was provisionally appointed as the Director of Code Enforcement,
effective December 28, 2019, and Jessica Hull was provisionally appointed as an Electrical and

Code Enforcement Officer, effective October 15, 2019, both pending the next civil service exam
for their title; and
Whereas, the Tompkins County Civil Service office has provided the certificate of eligible listing
for the said titles and Martin Moseley and Jessica Hull were reachable candidates; now, therefore
be it
Resolved, the Town Board of the Town of Ithaca does hereby approve the appointment of Martin
Moseley to the position of Director of Code Enforcement with no change in current
compensation or benefits,retro-active to September 28, 2021, with an eight (8) week
promotional probationary period applies with no further action by the Town Board if there is
successful completion of the probationary period as determined by the Town Supervisor; and be
it further
Resolved, the Town Board of the Town of Ithaca does hereby approve appointment of Jessica
Hull to the position of Electrical and Code Enforcement Officer with no change in current
compensation or benefits,retro-active to September 28, 2021, with a twenty-six (26)week
probationary period applies with no further action by the Town Board if there is successful
completion of the probationary period as determined by the Director of Code Enforcement.
9. Discuss Short Term Rentals draft legislation
Mr. Goodman gave an overview, saying that the Committee met again last week and also talked
to Counsel about a number of issues, which we will most likely go into closed session to report
to the full board about.
The Committee discussed the purpose clause and adding an amortization provision for
implementation so people could have extra time to recoup some of the investment they have
made expecting to be able to utilize short term rental income.
We also discussed the enforcement provisions and penalty sections, which will mirror the
penalty guidelines in other sections of the Town Code.
The goal tonight is to decide what number to put in for the days limitation and the lakefront
residential restrictions for the majority of the board so the final draft can be presented at the
November meeting and a public hearing scheduled for December.
Lakefront residential was at 120 days to start because the committee felt that was the summer
months in total then to 150 which seemed to be about 5 months to recoup the costs of owning
and maintaining a lakefront home.
Discussion followed, with some members saying that it is unfair to allow some owners such a
significant number of days over others, especially since the lakefront properties are significantly
more expensive and the perception is that people who are more well off get more.

Non-committee members stated their concerns, mostly around lakefront rentals which are
historical, way before the concept of Air BNB's and is a known factor for anyone purchasing a
lakefront property up front. The economic drivers and support provided by renters to the
community and county as a whole outweighs the limited number of complaints in the zone. The
lakefront residential is comprised of approximately 120 residences with maybe 60-70 used as
short term rentals.
Mr. Howe suggested moving to the discussion regarding the request for Water Sewer Billing
reduction from Utility Advisors for Maplewood so Public Works staff could leave the meeting
prior to a closed session.
Item 10 Report of Town Officials Maplewood billing request.
Mr. Howe explained that the Public Works Committee reviewed the data, history and request and
recommended no refund based on that information. The system is private, at the choice of the
developers and the leak was on the private side and not addressed in a timely fashion by them
after notifications by Bolton Point and assistance from Bolton Point in locating the general area
of the leak.
The Board concurred with the Public Works Committee recommendation and took no further
action at this time.
Short Term Rentals continued
Closed Session to seek the advice of counsel, moved by Mr. Goodman, seconded by Ms. Hunter
at 6:34 p.m.; unanimous.
Reenter open session at 6:40 p.m. moved by Ms. Hunter, seconded by Mr. Goodman,
unanimous.
The Board discussed various numbers for Lakefront residential and Mr. Goodman will work
through the notes and make a change to the draft that will either be approved or changed at the
next full session.
The next item centered on the "one permit per owner" and the restrictions that entailed if
someone had a"regular"rental and wanted a short term for a period of time, which would not be
allowed.
Changes to accommodate certain scenarios with little overall impact were discussed.
Clarifications on hosted and unhosted rentals were discussed and the legislation will be drafted
for discussion and action at the November meeting.
It was noted that some residents have questioned whether board members acting on this
legislation should be conflicted out of the discussion. Each member stated whether they owned

rental property, which some did,but none engaged in short term rentals, and so there is not
conflict.
The Board was not unanimous in support of the stated draft outline, but the Committee felt they
had spent three plus years researching and discussing many scenarios, and the draft needed to
come to a vote.
Mr. DePaolo added that a survey was sent to the lakefront owners and those responses factored
into the draft legislation.

Desc: I was in the neighborhood (14 Peachtree Ln.) following up on a complaint and saw contractors working
on a roof without a BP. Top Notch Contracting. I spoke with contractor William Marks who called his
boss J.R. and put him on speaker phone. I told J.R to fill out the Application online and pay the double
fee this Monday. He said he would do just that. I also spoke with homeowner's daughter Barb Singleton
who was sitting on the front porch when I pulled up.

Desc: Alarm in Building B. the building has been renumbered, but the fire alarm panel addresses are still old.
Finally found the alarm in a small utility room in the interior of the building with an activated smoke
head. Attempted to replace the head but it was jammed in its base. Left the system in alarm and
