Call to Order and Pledge of Allegiance—Mr. Howe opened the meeting at 5:32 p.m. 2. Swearing in of Town Board Members—Ms. Rosa swore in Board Members Rich DePaolo, Rob Rosen, and Margaret Johnson as members. 3. Announcement of Deputy Town Supervisor—Mr. Howe reported for the record that Mr. DePaolo will be the Deputy Town Supervisor this year. 4. Persons to be Heard There was no one wishing to address the Board. 5. Consider approval of Town Board Meeting Schedule for 2022 Mr. Howe noted that this has been the schedule for the past few years. TB Resolution 2022 -001: Set Dates for 2022 Meetings of the Town Board Whereas the Town Board of the Town of Ithaca meets on the second Monday of each month at 5:30 p.m. except when delayed to the following week due to holidays, and Whereas the Town Board also meets the fourth Monday of each month for an additional meeting. These second meetings are commonly called study sessions which begin at 4:30 and are held in a smaller meeting room. Consider NYS Association of Towns' Resolutions for 2022 and designation of the Official Delegate for the 2022 Annual Meeting The Board decided to pull out the resolutions of the Association to discuss at the next meeting and simply vote on the voting member and alternate. TB Resolution 2022-005: Desisnation of Official Delegate and Alternate voting member to the New York State Association of Towns Annual Meeting Whereas, the NYS Association of Towns Annual Meeting is held in New York City and the Town of Ithaca is a member in good standing and eligible to have voting rights at the Annual Meeting, now therefore be it Resolved, that the Town Board hereby designates Margaret Johnson as the Official Delegate and Rich DePaolo as the Alternate to cast votes on behalf of the Town. Consider approval of the Highway Expenditures Agreement Mr. DePaolo asked about the verbiage "shall be expended" and whether any unspent funds would go back to the Highway Fund. Ms. Brock responded that this is standard language that follows NYS Highway Law and we have used this same language for years and she did not think there was an issue with the language., but it could be changed for next year to spell it out. Mr. Slater and Ms. Shaw added that any money left has gone back to the Highway fund. Mr. DePaolo said he was satisfied with the answers given and there was no need to research different language. TB Resolution 2022-007: Approval of 2022 Agreement for Expenditure of Highway Monies Resolved that the Town Board of the Town of Ithaca approves the following Agreement with the Highway Superintendent of the Town of Ithaca for 2022: AGREEMENT between the Town Highway Superintendent of the Town of Ithaca, Tompkins County, New York and the undersigned members of the Town Board. Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and collected in the Town for the repair and improvement of highways, and received from the State for State Aid for the repair and improvement of highways, shall be expended as follows: TB 2022-01-10 (Filed 2/9) Pg. 7 HIGHWAY: 1. GENERAL REPAIRS. The sum of$150,000 shall be set aside to be expended for primary work and general repairs upon 7 miles of town highways, including sluices, culverts, and bridges having a span of less than five feet and walks or the renewals thereof. 2. PERMANENT IMPROVEMENTS. The sum of$200,000 shall be set aside to be expended for the permanent improvement of town highways, including paving, guide rails, etc. The sum of$60,000 shall be set aside to be expended for the permanent improvement of Sesame Street/Alison Drive to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.17 miles of road The sum of$25,000 shall be set aside to be expended for the permanent improvement of the Campbell Avenue/Hopkins Place to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.09 miles of road The sum of$45,000 shall be set aside to be expended for the permanent improvement of Eldridge Circle to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.22 miles of road The sum of$210,000 shall be set aside to be expended for the permanent improvement of Indian Creek/Happy Lane to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.48 miles of road The sum of$80,000 shall be set aside to be expended for the permanent improvement of Williams Glen Road to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.16 miles of road The sum of$45,000 shall be set aside to be expended for the permanent improvement of Valley View Road to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.12 miles of road The sum of$55,000 shall be set aside to be expended for the permanent improvement of Orchard Hill Road to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.35 miles of road The sum of$25,000 shall be set aside to be expended for the permanent improvement of Evergreen Lane to re-establish shoulders, mill asphalt, and install an asphalt overly on 0.16 miles of road The sum of$115,000 shall be set aside to be expended for the permanent improvement of Westhaven Road to re-establish shoulders, mill asphalt, and install an asphalt overly on 1.24 miles of road TB 2022-01-10 (Filed 2/9) Pg. 8 The sum of$95,000 shall be set aside to be expended for the permanent improvement of Hopkins Road to re-establish shoulders, drainage facilities, mill asphalt, and install an asphalt on 0.52 miles of road (Signatures on file on separate Agreement) Moved: Rod Howe Seconded: Pamela Bleiwas Vote: ayes—Howe, Bleiwas, DePaolo, Johnson, Rosen and Goodman 12. Consider authorization for certain expenditures by the Superintendent of Highways without prior Town Board approval Mr. Howe explained that in the past, some of these expenditures were brought to the Board and it was cumbersome, so the decision was made to allow these certain expenditures that are identified in the budget each year. TB Resolution 2022 -008: Authorizing Certain Expenditures by the Superintendent of Highways without Prior Town Board Approval Whereas, Section 142, Subdivision- 1(a) of the New York Highway Law authorizes the Town Board to adopt a resolution permitting the Town Superintendent of Highways to purchase equipment, tools and implements without prior approval of the Town Board in an amount or amounts to be fixed by it from time to time; and Whereas, the Town Board adopted a 2022 Ithaca Town Budget which included monies for the purchase of vehicles, tools and equipment; and Whereas, it is determined by this Board to be reasonable and proper and in the best interests of the efficient functioning of the Public Works Department that the Town Superintendent of Highways be granted permission to purchase such items without its prior approval in amounts not to exceed the approved respective budgeted amounts; now therefore be it Resolved, that the governing Town Board of the Town of Ithaca does hereby authorize the Town Superintendent of Highways to spend amounts, not to exceed what is identified within the adopted 2022 Ithaca Town Budget, without the prior approval of this Board, for the purchase during fiscal year 2022 of vehicles, tools and equipment to be used for highway maintenance, construction, reconstruction, and/or snow removal; except when the lowest responsive and responsible bidder is not selected and be it further Resolved, that the authorization hereinabove granted shall be construed as meaning that the total amount spent on each item purchased by the Town Highway Superintendent during fiscal year 2022 shall not exceed the respective budgeted amount for that item in the adopted 2022 Town of Ithaca budget. Ethics Disclosure Form and Distribution List, Procurement Policy, Cash Management and Investment Policy, Emergency Management Response Plan, Green Procurement Policy, and Green Fleet Policy Mr. Howe noted that the Board Protocol and Procedures Manual has been pulled for a final review prior to adoption of the revised Manual. Ms. Johnson asked if the Town has a policy regarding divesting investments from fossil fuels. Mr. Goodman responded that we do not really have investments, so we haven't gone further in that aspect of the policy. Some discussion followed and it was noted that Towns are very limited in the ways they can invest money even when there was a push in the recent past to look into it as a shared-municipal effort. TB Resolution 2022 -009: Annual Approval of Ethics Disclosure Form and Distribution List, Procurement Policy, Cash Management and Investment Policy, Emergency Preparedness Plan, Green Fleet Policy, and Green Procurement Policy Whereas the Town Board reviews certain policies and procedures at its Organizational Meeting as required by the Town of Ithaca Code or at direction of the Town Board, and Whereas the Ethics Disclosure Form& Distribution List, Procurement Policy, Cash Management and Investment Policy, Emergency Preparedness Plan, and Green Fleet Policy, Green Procurement Policy have been submitted to the Town Board for review, now therefore be it Resolved, the Ithaca Town Board hereby accepts, approves, and affirms the above listed policies, procedures and forms as required for the year 2022. Consider authorization for Supervisor to sign an amendment to the Intermunicipal Agreement Regarding Historic Preservation Planning Staff Services Mr. Howe noted that this is for the remainder of the tasks and goals under the current agreement and does not negate a different contract or duties in that may come about in 2022. TB Resolution 2022 -010: Authorization for the Supervisor to sign an addendum to the Intermunicipal Agreement Regarding Historic Preservation Planning Staff Services Resolved that the Town Board authorizes the Supervisor to sign and addendum to the Intermunicipal Agreement Regarding Historic Preservation Planning Staff Services, for an TB 2022-01-10 (Filed 2/9) Pg. 10 amount not to exceed $4,000 for 2022 services associated with this Agreement. Consider authorization for the Supervisor to sign an agreement regarding the Game Farm Rd Trail Crossing Mr. Howe gave the history of the issue, noting that the County did do a study,but the Town of Dryden and we would like to look a little deeper into options and get additional information on the area. Ms. Johnson asked about the study having been done at the current speed limit and if there has been any effort to lower the speed limit. Mr. Slater added that there was a speed limit reduction request that is working its way through the State's process, and he had been told that the study by the State has been done but the decision has not been released as of this time. TB Resolution 2022 -011: Acknowledge commitment to cost sharing with the Town of Dryden for services provided by Barton & Loguidice,D.P.C. associated with the Game Farm Road Trail Crossing Whereas, the Town entered into a Memorandum of Agreement with the Town of Dryden and Tompkins County to improve the Game Farm Trail Crossing, and Whereas, the Town of Dryden and Town of Ithaca propose to share the costs of services needed as described in the Scope of Services in the Agreement to be signed by the Town of Dryden and submitted for review, now therefore be it Resolved that the Town Board acknowledges and commits to the cost sharing of said services provided by Barton& Loguidice, DPC not to exceed $7,715.00 for the Town of Ithaca's share Moved: Bill Goodman Seconded: Rod Howe Vote: ayes—Goodman, Howe, Levine, DePaolo, Bleiwas, Rosen and Johnson Mr. DePaolo asked about the signage in the Game Farm Rd parking area to restrict all-day parking and the status of that. Mr. Slater responded that he would have to look at that and the Town's authority to regulate that. Mr. DePaolo said it would be helpful to dissuade the use of the lot as a car-pooling lot and open the spaces for recreational users. Mr. Howe stated that we will look into that. TB 2022-01-10 (Filed 2/9) Pg. 11 16. Consider setting public hearings regarding: Mr. Howe gave a brief overview of each proposed local law. TB Resolution 2022 - 012: Setting public hearings regarding proposed local laws for a monetary gift to the City of Ithaca for support Cass and Stewart Parks; adding Chapter 220 to the Town of Ithaca Code to regulate food trucks, amending Chapter 250 of the Town of Ithaca Code to add 3-way stop at Forest Home Dr/Arboretum Rd intersection and No Parking Signs on a portion of Game Farm Rd Resolved, that the Town Board will hold public hearings at its meeting on Monday, February 14, 2022 at 5:30 p.m. to hear all interested parties on proposed local laws for the following: a. A proposed local law authorizing a monetary gift to the City of Ithaca to support Cass Park and Stewart Park recreational facilities. ($58,000) b. A proposed local law adding Chapter 202 to the Town of Ithaca Code, "Food Trucks", to regulate food trucks in the Town of Ithaca c. A proposed local law amending Chapter 250 of the Town of Ithaca Code to: i. Add 3-way Stop signs at Forest Home Drive / Arboretum Road Intersection ii. Install No Parking Signs on Game Farm Road Details on the proposed local laws will be available from the Town Clerk's office and on the Town's webpage. Consider establishing the Conservation Board Stipend amount Mr. Howe noted that the Board passed the local law to permit this, and this resolution sets the rate, as we set all rates via resolution rather than by local law. TB Resolution 2022 -013: Establish Stipend amount for Conservation Board Members and authorize associated Budget Amendment Whereas, at meetings on September 27, and November 8, 2021, the Town Board discussed a request from the Conservation Board for a stipend to help defray expenses related to service on the Conservation Board, and Whereas, on December 13, 2021, the Town Board held a public hearing and adopted a local law amending Town of Ithaca Code Chapter 23, Conservation Board, authorizing compensation for Conservation Board members (not associate members)based upon a stipend per meeting attended; and TB 2022-01-10 (Filed 2/9) Pg. 12 Whereas, the Town Board wishes to establish the rate of the stipend, now therefore be it Resolved, that the Town Board hereby establishes a stipend for Conservation Board Members (not Associate Members) at $40.00 each per monthly meeting attended; such payment to be made at least once annually; and be it further Resolved, that the Town Board establishes the Budget Line B8020.432 (Conservation Board Stipends) and authorizes the Finance Officer to transfer $4,500.00 from Line B8020.403 (Planning Study) to Line B8020.432 (Conservation Board Stipend). Report of Town Officials, Committees, and review of Correspondence Brief discussion on the status of being allowed to continue with virtual meetings. Gov. Hotchul has signed a law to allow the continued virtual meetings until the Emergency Declaration is repeated, at this point. Mr. Howe added that the Town is working on improving the Town Board room in anticipation of being able to meet there and also continue with virtual broadcasting for the public. Mr. Howe reported that the internet issues are being addressed by some technology upgrades. 20.
