Be it remembered, that in pursuance of Section 151, Surrogate's Court Act, I hereby certify
that on the 29th day of May 1936, the last Will and Testament of Etta May Brenner deceased,
being the foregoing written instrument, was upon due proof duly admitted to probate by the
Surrogate's Court of the County of Tompkins, and by the Surrogate of said County, as and for
the last Will and Testament of said deceased, and as a Will valid to pass real and personal
property. Said last Will and Testament and decree admitting said Will to probate are recorded
in the office of said Surrogate in Liber SS of Wills, page 449.
IN TESTIMONY WHEREOF I have hereto subscribed my name and affixed the seal of office of
the Surrogate of said County this 29th day of May one thousand nine hundred and thirty-six.

Cornell University INDENTURE, Made this 9th day of January between Cornell University;
to : party of the first part, and the Town of Ithaca, party of the second
Town of Ithaca. part.
- - - - - - - - - - -X WHEREAS: The said party of the first part is seized in fee simple of
certain lands across which runs a road known as Judd Falls Road as indicated on a map entitled
"Survey of Right of Way for Judd Falls Road" prepared by yu. J. McClintock, G.E., under date
of 4bruary 8, 1935 and filed in the office of the Clerk of the County of Tompkins, State of
New York, on the 19 day of Jan 1937, and
WHEREAS: The said party of the first hart has heretofore agreed in consideration of the
said party of the second part releasing its right of gray over the old site of the said Judd
Falls Road, indicated on said map as "Old Right of Way" to grant to said party of the second
part a right of way for a new location of said road, and
'SHEREAS: The said party of the second part has heretofore released and abandoned the right
of way indicated on said map as "Old Right of Way" and has, by action of the Town Board duly
taken, changed the location of the said Judd malls Road to the location indicated on said map
as "New Right of Way",
NOW THIS INDENTURE WITNESSETH That in pursuance of said agreement and in consideration of

the release of the "Old Right of Way" and the abandonment thereof by the party of the second
part, said party of the first part hereby grants to the said party of the second part full
:and free right of use for highway purposes of the following described premises, to wit:
ALL THAT TRACT OR PARCEL OF LAND being a part of Lot 92 located in the Town of Ithaca,
bounded and described as follows: Beginning at the intersection of the center line of Judd
:Falls Road and the center line of Tower Avenue before relocation, which point bears south

of ground 49j feet wide which is the right of way for the relocated portion of Judd Falls Road.
TO HOLD said right of way to the use and benefit of the said party of the second part so
long only as it is used for highway purposes.
IN WITNESS WHEREOF the parties hereto have caused this instrument to be duly executed by
their proper officers, the day and year first above written.

On this 9th day of January, 1937 before me personally came George F. Rogalsky and -r'rie
J. Miller, who being by me duly sworn, did depose and say that they reside in the County of
Tompkins and State of New York, and the said George F. Rogalsky states that he is the Treasurer
of Cornell University, the corporation described in and which executed the above instrument as
one of the parties thereto, that he knows the seal of the said corporation, that the seal
affixed to said instrument is such corporate seal, that it was so affixed by authority granted
him by the Board of Trustees of said corporation, that he signed his name thereto pursuant to
(such authority. The said Erie J. Miller states that he is the duly elected supervisor of the
Town of Ithaca, and by virtue of such office, he is the Chairman of the Town Board of said
Town of Ithaca and that he executed the said instrument on behalf of the Town of Ithaca by
order of the Town Board as contained in a resolution duly adopted by said Board at a regular
meeting thereof.
