The real estate herein described was owned by Ira P. Sears in his lifetime and was
conveyed to Ira P. .Sears and Bernice Sears, (his first wife) by deed dated the 16th of April
1923, and recorded in,the Tompkins County Clerk's Office in Book Number 204 of Deeds at
page 498.
TOGETHER with thea appurtenances and all the estate and rights of the parties of the

TO HAVE :AND TO HOLD the premises herein granted unto the parties of the second part,
their heirs and assigns forever.
And the parties of the first part covenant that they have not done or suffered anything

place of business in the Town of Ithaca, county of Tompkins and State of New York party of the
first part, and TOWN OF ITHACA, a municipal corporation and political subdivision of the
County of Tompkins and the State of New York party of the second part:
WITNESSMy . that the party of the first part, in consideration of One Dollar (:1.00)
lawful money of the United States, and other good and valuable consideration paid by the party
of the secon4 part, its successors and assigns forever, for highway purposes,
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of Tompkins and
State of New York, more particularly bounded and described as follows: according to a survey
made by S.D. Crumb August 29, 1942:-
Beginning at the intersection of the eienter line of Coddington Road with the northerly �
right of way line of the first track of the D.L. & W. Railroad crossing said road south of

of the tract and being the southwest corner of lands conveyed to the party of the first part
by deed of Ithaca Enterprises, Inc. crated June 30, 1938 and recorded in. the Tompkins County

line of the right of way of said D.L. & W. Railroad 459 feet to an iron pipe, said course
passing through a concrete monument 271.5 feet easterly from the place of beginning; thence
north 77" 301 east 321.1 feet to an iron pipe, said course passing through an iron pipe near a
16 inch hickory tree 37.7 feet northeasterly from the beginning of said course; thence southr
77" east 281 feet to an iron pipe in the easterly boundary of the premises conveyed to the
party of the first part by the deed above mentioned; thence north W11 201 east along said

boundary 55 feet to another iron pipe in said boundary line; thence 77" west 317 feet to an ry

feet to the center line of Coddington Road, said course passing through three iron pipes, ons

at 187 feet westerly from the beginning of said course, one at 420.7 feet, and one at 477.4
feet westerly from the beginning of said course, the last mentioned of said three pipes
being in the northeasterly right of way line of Coddington Road; .thence south 22" 381 east
87 feet to the plaaeeof beginning, being a portion of the premises conveyed to the party of
the first part by the deed of Ithaca Enterprises, Inc. above mentioned.
The purpose of this deed is to provide an easier and more adequate access from Coddington
Road to the plant of the party of the first-part by means of a public highway to be constructed
from the premises hereby conveyed to the Town.
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said-premises,
TO HAVE AND TO HOLD the premises herein granted unto the part of the second part, _
and assigns forever.
AND the party of the first part, covenants as followst
FIRST. That the part of the second pact shall quietly enjoy the said premises;
SECOND. That-the party of the first part will forever WARRANT the title to said premises.

W. YacDONALD, ESQ., attorney for said Debtor, in favor of said Petition and no appearance
having been made in opposition thereto,
Now upon said Petition, verified October 12, 1942, and all the proceedings had before
me at the said hearing, and cause having been shown therefor, it is
