County Clerks Office in liber 201 of Deeds at page 281.
TOGETHER with the appurtenances; and all the estate and rights of the said party of the
first part in and to said premises. TO HAVE AND TO HOLD the above granted premises unto the
said parties of the second part, their heirs and assigns forever.

AND the said Clara C. Vorhis does covenant with the said parties of the second part as
follows$
TRAT the parties of the second part shall quietly enjoy the said premises.

Town of Ithaca : hand paid, the receipt of which is hereby aclinowledged and for

Della W. Barrus his wife, of the Town of Ithaca, County of Tompkins and State of New York,
do hereby grant to the TOWN OF ITHACA, a municipal corporation and political subdivision of the
County of Tompkins in said state its successors or assigns, a right of way to lay, maintain
operate and remove water mains in connection with the Forest Home water Distribution Project
about to be constructed through, along and across the property of the parties of the first
part located in the said Town of Ithaca, in the hamlet known as Forest Home, bounded on the
south by the McIntyre Road, on the west by the Forest Home Road, on the north by property of
H.H. Whetzel and on the east by properties of H.E. Sanford and Kenneth Washburn; one line of
such water mains to run diagonally in a northwesterly direction from a point on the south side

of said McIntyre Road across the western end of the property of the parties of the first
° part to the Forest Home Road and another line of such water mains to run in a northerly ,

direction from the said McIntyre Road along a private road located between the property of the
parties of the first part on the west and of B.E. Sanford and the parties of the first part on

the east; and also the right to lay, maintain, operate and remove service connections from w
said last mentioned line to serve the residences of the parties of the first part and of said

B. E. Sanford; all as shown on a map entitled, "Town of Ithaca, N.Y. Forest Horne dater District
Water Distribution System Water Mains Sheet 1 of 3" drawn by Harry W. Eustance, Consulting
Engineer, a copy of which map is hereto attached and made a part hereof, with the right of 3
ingress and egress to and from the same.

This grant is made upon the condition that the grantors their heirs and assigns may fully,
use and enjoy their said premises, except for the purpose hereinabove granted to said Town of
Ithaca and that the said Town of Ithaca will pay any damages which may arise to fences or other
structures from the laying, maintaining, operating and removing of said water mains and
service connections; said damages if not mutually agreed upon, to be ascertained and de-
termined by three disinterested persons, one to be appointed by the grantors their heirs or
assigns one by the Town of Ithaca, its successors or assigns and the third party to be
appointed by the two appointed as aforesaid and the award of such tree persons shall be final
{ and conclusive.
IN WITNESS WHEREOF the parties of the first part have set their hands and seals as of the
15th day of October, 1935.
