Monday, April 26, 2021
Due to the Governor's Executive Orders suspending certain aspects of the Open Meetings Law
to protect the health and safety of New Yorkers, the meeting was held via ZOOM.com
MINUTES
Board Members Present: Rod Howe, Supervisor; Members Eric Levine, Rich DePaolo, Bill
Goodman, Tee -Ann Hunter, Pat Leary and Pamela Bleiwas
Staff Present: Judy Drake, Marty Moseley, Susan Ritter, Paulette Rosa, Joe Slater, Donna Shaw,

Mr. Howe opened the meeting at 4:30 p.m.
1. Consider approval and authorization for the Supervisor to sign an agreement
associated with Tompkins County's Ellis Hollow over Six Mile Creek Project
Mr. DePaolo asked for clarification regarding the relocation of facilities; will there be
replacement of components in the process to extend the service life of such utilities?
Mr. Thaete replied that they are replacing existing box culverts under the intersection at Ellis
Hollow Rd and Pine Tree Rd and our new watermain to the Ellis Hollow Tank would be
under the concrete end section so we are having them reroute that watermain around the end
of the culvert and another section is pretty shallow so they are lowering and replacing that
section; so, yes, there will be new parts but the overall life of the utility as a whole will not
be extended.
TB Resolution 2021 - 050: Granting the State of New York authority to perform
construction project "Ellis Hollow Road over Six Mile Creek Tributary" (Project) for the
owner, Agreeing to maintain facilities adjusted via the state -let contract for the Project,
and Authorizing the Supervisor to sign any necessary documents related to the Project
Whereas, the New York State Department of Transportation (State) proposes the construction,
reconstruction, or improvement, titled "Ellis Hollow Road over Six Mile Creek Tributary, Town
of Ithaca, Tompkins County, PIN 3756.61" (Project), and
Whereas, the State will include as part of the Project the relocation and adjustment to water
mains, sanitary sewer mains and appurtenances pursuant to Section 10, Subdivision 24, of State
Highway Law, as shown on the contract plans and meeting the requirements of the owner, and
Whereas, the service life of the relocated and/or replaced utilities has not been extended, and
Whereas, the State will provide for the Project, as shown on the contract plans submitted to the
Board, now therefore be it

Resolved, that the Ithaca Town Board hereby approves the Project as submitted and agrees to
maintain, or cause to be maintained, the adjusted facilities at the completion of the Project, and,
be it further
Resolved, that Ithaca Town Board hereby authorizes the Town Supervisor to sign any and all
documentation that may become necessary to execute and complete the Project.

2. Consider authorization for the Supervisor to sign an agreement regarding
streetlight upgrades
Mr. Howe gave an overview, saying that the decision to purchase the streetlights was made
about 3 years ago and the process has been long to get this settled. Counsel has reviewed
this already and there is a time constraint in that some costs will increase after August.
Mr. DePaolo asked about the "facilities" and if we are buying everything but the poles, which
NYSEG retains ownership of, and so in essence we are renting space from NYSEG.
Mr. Goodman responded that is correct; we will own the light and the arm that attaches to
the pole and the agreement allows us, and other utilities, to attach to their poles. He
explained that once the agreement is signed by both the Town and NYSEG, NYSEG sends
it to the Public Service Commission (PSC) for approval. Once it is approved and we own
the streetlights, we can change them to LED with the help of the New York Power Authority
(NYPA).
Mr. Howe added that the price went down about 10% from 3 years ago.
TB Resolution 2021 - 051: Approval of and authorization to sign Street Lighting Pole
Attachment Agreement and Agreement for Purchase and Sale of Street Lighting Facilities
Whereas the Town Board and numerous Committees have discussed and recommended moving
forward with the replacement of current streetlights with LED and the Town has applied for
grant funding for portions of the cost, and
Whereas the Town has adopted a Green New Deal Action Plan and this Project is part of meeting
those goals, now, therefore be it
Resolved that the Town Board hereby approves and authorizes the Supervisor to sign the above
named agreements.

3. Consider authorization for the Supervisor to sign an amendment to the contract
with TG Miller, PC for additional work associated with Saunders Park Project
Mr. Howe noted that this to allow the current placement of the trail and Hospice has agreed
to transfer the land to us and this amendment details the survey work needed to complete the
transfer documents.
There were no questions or comments from the Board.
TB Resolution 2021 - 052: Authorization to amend existing contract with T.G. Miller P.C.
to expand the scope of work to include preparation of a property transfer map and legal
description for the King Road East Park Project
Whereas, on February 26, 2018 the Town Board authorized T.G. Miller, P.C. Engineer and
Surveyors (TG Miller) to prepare construction documents for the park and trail project located on
King Road East, at a cost not to exceed $16,200.00 (Contract), and
Whereas, the original design drawings showed the relocation of approximately 150 LF of gravel
trail that is currently located on lands owned by Hospicare Foundation Inc., and
Whereas, Hospicare Foundation Inc. has agreed to transfer a portion of land in fee to the Town to
facilitate retaining the current trail alignment and existing screening/vegetative buffers in place,
and
Whereas, the Contract needs to be amended to include the additional work outlined in Proposal
Amendment No. 1, prepared by T.G. Miller at an additional cost of $1,000.00; now, therefore be
it
Resolved, that the Town Board hereby authorizes the Supervisor to sign said amendment to the
existing Contract as described above.

4. Consider acceptance and dedication of water infrastructure associated with
Phase 3 and 4 of the Westview Subdivision
Mr. Thaete reported that the water infrastructure is inspected and ready for dedication to the
Town. He added that the sewer infrastructure is not ready yet but will come to the Board for
acceptance and dedication at some point soon and once that is done, the developer can begin
to build on the lots.
TB Resolution 2021 - 053: Acceptance of dedication of Phase 3 and Phase 4 Water Main
Infrastructure associate with the Westview 32-Lot Subdivision, Schickel Rd and

authorization to sign associated easements
Whereas, the Town of Ithaca Planning Board granted Subdivision Approval for the Westview 32-
lot Subdivision, located at the intersection of Danby Road (NYS Route 96B) and Schickel Road,
Town of Ithaca Tax Parcel No. 36-2-3.2, Low Density Residence District. The subdivision
consists of 31 residential lots and a 1.5+1- acre lot for a park in the southeast corner of the property,
Igor Chiekhet, Owner; and
Whereas, the Town Board accepted the concept and location of utilities associated with the Project
by TB Resolution 2004-130; and
Whereas, Phase 3 and Phase 4 water infrastructure for the Project has been completed in a manner
satisfactory to the Town Highway Superintendent and the Director of Engineering; and
Whereas, Project included proposed dedication to the Town of Ithaca the public water
infrastructure as shown on the plan titled "Waterline Easement Map for Westview Subdivision
Phase 3 and 4" dated January 11, 2021, revised March 15, 2021; prepared by Lee Dresser, L.S.,
T.G. Miller P.C.; and
Whereas, the Attorney for the Town has reviewed and approved the title, access easements and
rights -of -way associated with the dedication of the infrastructure to the Town; now, therefore be
it
Resolved, that the Ithaca Town Board hereby accepts the dedication of the above -described
public water infrastructure and approves and authorizes the Supervisor to sign all associated
easements and rights -of -was on behalf of the Town.

5. Consider approval and authorization of a Bond Redemption from Fund
Balances
Mr. Howe gave an overview saying that since the interest rates have dropped so much, we are
not making the same profits that Mr. Solvig was getting and Ms. Shaw suggested to the Budget
Committee that we pay off some of our bonds which will save us $151,000.00 in interest. The
Committee recommended that to the Board.
TB Resolution 2021 - 054: Approval and Authorization of a Bond redemption from Fund
balances
Whereas, the Town Budget Committee has recommended the Town use $1,245,000 in available
Fund balance as follows: A Fund $192,000; DB Fund $469,000; and F Fund $584,000
to redeem the Series 2013 Bonds prior to maturity, and

Whereas, the Series 2013 Bonds are callable on August 1, 2021 at par, now therefore be it
Resolved, that the Town Supervisor is hereby authorized to use available Fund balances as
described, and the Finance Officer is authorized to make any necessary budget adjustments for
same, to call the Series 2013 Bonds on August 1, 2021, and be it further
Resolved, that the Town cause to be filed a Notice of Early Redemption with the Depository
Trust Company and post such Notice on the Electronic Municipal Market Access website of the
Municipal Securities Rulemaking Board.

6. Committee Reports
Budget — Mr. Levine reported they discussed the bond early redemption just passed;
and this ties to the drafting of a Fund Balance Policy we are working on. There are
three funds that payment is coming from and will bring the balances back to 40%
over what they should be. The goal is to be between 30%-40% above the balance
required. We will continue to work on a fund balance policy and setting policies for
other funds to present to the Town Board.
We learned about the American Rescue Plan from which the Town received $2.16
million, with a portion going to the Village. We are waiting on clarifications from the
Federal Government; the current indications seem to be that infrastructure such as
water and sewer and possibly sidewalks will be allowed. Once we have the
clarifications, there will be discussions at future committee and board meetings on
how to spend the funds.
Sales tax collections were just under budget; first quarter budget amendments were
approved at the last Board meeting and the audit was completed, remotely, and we
expect a report by the end of May.
Ms. Hunter asked for the reasoning behind setting a policy for fund balances and if
they are healthy, we should look at our reserve funds.
Mr. Howe responded that the NYS Comptroller recommends it and we are looking at
reserves and fund balances in parallel.
Codes & Ordinances — Mr. Goodman reported that the committee discussed the
Ithaca Energy Code Supplement and reported on the City's progress. The City will
review and discuss it at their May 5fh meeting and could potentially adopt it then. The
committee's review is done and the next step is to go over some revisions the

committee wanted and then bring the final draft to the Board to discuss and consider
setting a public hearing for June.
The Committee discussed the concerns about the current state of the grid in areas of
New York and the prospects for increases of cleaner energy sources on the grid. The
Committee decided to recommend the same timeline going to the City for approval
which is to move the timeline for 12 points on the points system from 2025 to 2023
and the timeline for eliminating fossil fuels for heating and clothes drying from 2030
to 2023. He reminded the Board that this is for new construction and natural gas for
cooking is not considered.
The other topic discussed by the committee was the Renewable Energy section which
deals with how many points you can get and how you can get them with ofsite or
offsite renewable energy, such as solar panels or buying into a community solar farm
for renewable energy credits.
Finally, we also discussed enforcement, compliance, and how to set it up for
variances based on the NYS energy code that can be taken to the ZBA.
Mr. Howe asked if all of Cornell's concerns got resolved?
Mr. Goldsmith responded that we agreed that they could use their own data which is
public but reserved the right to request third party analysis at the applicant's cost.
They do have other concerns and we are not going to see eye -to -eye on all of them
but we have considered them.
Ms. Leary asked about the clothes dryers and Mr. Goodman explained that after 2026
you wouldn't be able to use gas powered dryers in new construction.
Some discussion followed and Mr. Goldsmith said there is a point for residential
buildings for electric ranges or ventless dryers, but people can still use vented dryers,
they just won't get a point for it.
Mr. Goodman asked if the Board has any big concerns about the advanced timeline.
Mr. DePaolo said until we hear from the public at our public hearing, we should be
open to change.
Mr. Howe responded that we will probably get many of the same comments the City
did and Mr. Goldsmith has those and the answers he will send out for the next
meeting.
Personnel and Organization/ERC — Ms. Bleiwas reported that they reviewed the
Board Protocol and Procedures Manual Chapter 1 and the goal is to have that
reviewed and approved by January when new members will be coming on. Also
reviewed the Engagement Survey and made some changes to make it clearer and

shorter. Discussed current Covid response and policies which seem to be changing
daily.
Planning — Mr. DePaolo reported that they talked about the proposed layout for the
New Neighborhood on South Hill with the property owners. We are trying to
determine the most appropriate way forward.
The Committee felt a Charrette is probably the most efficient way to include all
stakeholders' input and discussed to what level the town was willing to invest in a
third party.
Noah Demerest is representing the two major owners and although we know him and
think he is competent, he is being paid by developers, so we need to make sure we
have a balanced proposal.
There are funds in Planning that may be available for that purpose and we will
probably present that more formally to the Board in the near future.
Mr. Tasman added that the current Plan does not conform to the New Neighborhood
Code and that would be the goal of the Charrette.
Mr. DePaolo said he thought the Committee made that clear to the owners and this
would be a holistic view of development in the area.
We also looked at the final draft of food truck legislation and that will be reviewed by
Counsel and then on to the Board.
The Chainworks ROD will be out soon and we will be looking at that.
Ms. Hunter asked if the plan was to put an RFQ out for the consultant.
Mr. DePaolo responded that the general idea was for up to $50K which would
probably mean an RFQ. Rob Steudevault was mentioned since he is familiar with the
Town, the Comp Plan and the NND. There is a lot of work that needs to happen
before that, including discussions with DOT regarding a road diet which is essential
to this sort of a walkable community.
Some discussion followed and Ms. Hunter asked to be kept informed on anyone being
considered or sent a list if one is compiled.
Public Works — Ms. Hunter reported that the meeting was canceled, and Mr. Slater
responded that they are working on speed limit reduction requests at the next meeting.
Mr. Thaete added brief project updates.

Mr. DePaolo asked Mr. Thaete what the status was of reviewing the 3-day storage
requirement.
Mr. Thaete said he is still researching through our documents how this came to be,
and his next step is to ask retired staff and then report to the Committee.
Others
o Broadband — Mr. DePaolo reported that the first meeting was quite
overwhelming. Fujitsu is the consultant and is also used by Southern Tier
Network to try and determine where underserved resident are. At this point, the
focus is going to be on trying to provide fiber or at least a study, on providing
fiber to the home at 100mg per second which is probably better than what most of
us have.
The City's built -out area will not be in the study and most areas of the town are
served by Spectrum so there was discussion about whether those should be added
to the study or not and if they were, would that provide some leverage that might
result in more affordability.
That didn't gain much traction except from Dryden, who seems to be looking into
their own municipal service independently owned and operated.
As it stands now, this is referred to as an open access model where the County
would own the infrastructure and make it available to the array of service
providers.
As far as the Town of Ithaca, we have some pockets that are underserved but this
will probably not be a gamechanger for us, but it might help some of the more
rural municipalities.
Another issue is whether this report, when finished, will be proprietary or subject
to Freedom of Information and municipalities are going to have to wrestle with
that but right now, it is very preliminary, and groundwork being discussed.
o Short Term Rental — Mr. Goodman reported that they are still talking about
Lakefront Residential and limits on days. We are talking about having a longer
amount than other parts of town given the history and tradition of lakefront
rentals, but exactly what that will be isn't firmed up yet.
Talked about STR in secondary units on one parcel and we will probably have
some limit on having one permit to avoid LLCs from buying up properties and
renting them out.
Tourism and hospitality industry reps are also talking to us about what they want
and we also talked a little about the request for a town -wide survey, but the

Committee is not interested in that because we feel we have a good amount of
comments from across the spectrum to feel confident about it.
o Economic Development — Mr. Howe reported that some possibilities of new
businesses have been presented so it is started to resonate with some.
o Bicentennial — Mr. Howe reported that although it is all year long, we did put a
lot of effort in the presentations we did, and for now we will have the banners and
the displays and see where we are as the year progresses. He noted that the Town
of Ulysses sent a resolution as our "parents" which was funny and nice.
o Parks, Trails, Preserves & Recreation — Mr. Howe reported that they meet this
week and we are going to have more of a discussion about recreational proposals
and think them through.
SJC — Mr. Goodman gave an update on an incident at the Plant where there was a blockage that
caused significant damage and repairs could top $1.5M and our portion is 40% so not an
insignificant amount. It is important to get the message out not to put those "disposable" wipes
in our system and similar products.

TB Resolution 2021- 055c: Approval of Revised Working Supervisor — Town of Ithaca Job
Description
Whereas, the Director of Public Works and the Personnel & Organization Committee have drafted,
reviewed and recommended a revised Working Supervisor — Town of Ithaca job description to
create a Town of Ithaca -only Working Supervisor job description, which provides a more accurate
description of the scope of duties for the position in the Town of Ithaca•, now, therefore, be it

TB Resolution 2021 - 055e: Proclamation — May is Building Safety Month
Whereas, the Town of Ithaca is committed to recognizing that our growth and strength depends on
the safety and economic value of the homes, buildings and infrastructure that serve our citizens,
both in everyday life and in times of disaster, and
Whereas, our confidence in the resilience of these buildings is achieved through building safety
and fire prevention officials, architects, engineers, builders, tradespeople, design professionals,

safe construction of buildings, and;
Whereas, modern building codes include safeguards to protect the public from hazards such as
hurricanes, snowstorms, tornadoes, wildland fires, floods and earthquakes, and;
Whereas, Building Safety Month is sponsored by the International Code Council to remind the
public about the critical role of our Construction Professionals and Officials, and
Whereas, "Prevent, Prepare, Protect. Building Codes Save," the theme for Building Safety Month
2021, encourages all Americans to raise awareness about the importance of safe and resilient
construction; fire prevention; disaster mitigation, energy conservation; water safety; training the
next generation; and new technologies in the construction industry, and
Whereas, each year, in observance of Building Safety Month, people all over the world are asked
to consider the commitment to improve building safety, resilience and economic investment at
home and in the community, and to acknowledge the essential service provided to all of us by local
and state building departments, fire prevention bureaus and federal agencies in protecting lives
and property, now therefore be it
Resolved that the Town Board of the Town of Ithaca hereby proclaims the Month of May as
Building Safety Month.
8. Review of Correspondence
Mr. Moseley noted that a request for a waiver for the fee for a building permit extension was
submitted by the owners of the Comfort Inn project on Elmira Rd due to difficulties from the
effects of COVID executive orders and building and supplies.

a) Vacancies
• There were seven funded firefighter vacancies at the end of 2020. There are
also two officer vacancies; One Assistant Fire Chief and one funded Deputy
Fire Chief. The Deputy Chief is unfunded in 2021. The Assistant Chief
position is funded but has not been filled yet.
b) Retirements and Separation from Service:

• In June, there is one Fire Lieutenant who will be retiring from the department.
There will be a Firefighter promoted to Fire Lieutenant, and a Firefighter
hired in July to replace the Firefighter position.
c) Hiring/Promotions
Six firefighters were hired in February and in March to fill vacancies that
were created in 2020. The six firefighters are in NYS Career Firefighter
Recruit Training program in Montour Falls. Four firefighters will graduate
from the Fire Academy in May and two firefighters will graduate in June.
expect all six firefighters will be complete their recruit training and will be
assigned to shift work in late July and mid -August.
d) Firefighters on Injury Leave or Light Duty
• There are two fire lieutenants and one firefighter who are on injury leave.

3) Grants and Donations
In 2021, we applied for two FEMA Assistant to Firefighting Grants. The first grant
application is requesting funding to replace our 31-year-old Heavy Rescue, and the
second grant application is requesting funding to replace 63 Portable Radios.
4) Apparatus
a) A Pumper Truck was ordered in 2020, with delivery expected this month.
b) A new Pumper Truck was ordered in March and will be delivered in the late
spring of 2022.
