Call to Order
Called to order at 7 : 04 p . m .
Appeal of David and Roberta Sibley, owners, requesting variances from the
requirements of Chapter 270, Section 71 A and Section 71 C "Yard Regulations" of
the Town of Ithaca Code to be permitted to construct a 2 car garage, extend a
front entryway, and maintain a deck that encroach into the front and side yard
® setbacks located at 2 Dove Dr, Tax Parcel No. 61 .-1 -8.26, Medium Density
Residential.
Mr. Sibley appeared before the board . Chairperson Sigel commented that the application
submitted to the board was quite complete and asked Mr. Sibley if he had anything to add to
his appeal . Mr. Sibley did not.
Chairperson Sigel solicited questions from the board regarding the appeals there were none.
Chairperson Sigel thought that the appeal seemed reasonable and that the encroachment did
not seem significant. It appeared that other homes in the area are also close to the setback
line as well . Chairperson Sigel did not think the addition of the garage and porch area would be
out of character with the neighborhood . He went on to say that Mr. Sibley did a good job of
explaining why he felt he met the criteria .
Public Hearing
Chairperson Sigel opened the public hearing at 7 : 07 p . m . and invited the public to address the
board . There being no one interested in speaking, he closed the public hearing at 7 : 07 p . m .
SEQR
Chairperson Sigel assumed that the variance was exempt from SEQR. Attorney Brock agreed
and explained that the application was exempt for several reasons—consideration of granting of
setback variances, variance for single-family residence, and construction that is an expansion of
minor accessory or appurtenant residential structures.

Final
Chairperson Sigel asked . if the side yard setback was 10 feet because of the garage . Attorney
Brock agreed and explained that a one-story garage can be located in the side yard as long as it
is not a street line. The side yard setback for such a garage in the MDR zone is 10 feet.
Mr. Sibley asked if the setback would be different if the garage were a habitable dwelling .
Attorney Brock responded yes; the side yard setback would be 15 feet. Chairperson Sigel
added that if Mr. Sibley ever wanted to add a second story to the garage or convert the space
to living space then the required setback would be 15 feet and an additional variance would be
needed for that.
Mr. Rosen asked if the gravel parking area was part of the zoning process or if it was a separate
issue. Chairperson Sigel explained that the parking area is not something the board would deal
with ; Mr. Sibley will work with the Public Works Department regarding the driveway.
Chairperson Sigel moved to grant the appeal of David and Roberta Sibley to be permitted to
construct a 2 car garage, extend a front entryway and maintain a deck that encroach into the
front and side yard setbacks located at 2 Dove Dr, Tax Parcel No. 61 . - 1 -8 . 26, finding that all
criteria of an area variance had been satisfied, specifically listing how each criterion was met,
and with conditions on setback distances and compliance with plans submitted to the board .
Seconded by Mr. Krantz. Vote—Carried unanimously.

RESOL VED, that this board grants the appeal of Da v/d and Roberta Sibley, requesting
variances from the requirements of Chapter 270, Section 270-71A and Section 270-71 C "Yard
Regulations" of the Town of Ithaca Code to be permitted to construct a two car garage, extend
a front entryway, and maintain a deck that encroach into the front and side yard setbacks
located at 2 Dove Dr Tax Parcel No. 61. -1-8.26, Medium Density Residential zone, with the
following:
Findings:
That the benefit to the applicant does outweigh any detriment to the health, safety, and welfare
of the community, specifically.
1. That the benefit the applicant wishes to achieve, which is that of making a modest
extension to the porch, maintaining an existing deck, and adding a two car garage, cannot
be achieved by any other means feasible given the configuration of the lot and the location
of the house, which is fairly close to the street,
2. That an undesirable change in the neighborhood character or to nearby properties will not
take place as the distance from the road to these improvements is not out of character with
nearby properties and is a similar distance from the road,

3. That the request is substantial. It is not a minor encroachment into the front yard, especially
for the garage, but nevertheless, the benefit to the applicant does outweigh any detriment
to the health, safety and welfare of the community,
4. That the request will not have adverse physical or environmental effects, and
5. 777at while the alleged difficulty is self-created by the applicants desire for these
improvements, that nevertheless, the benefit to the applicant does outweigh any detriment
to the health, safety and welfare of the community.
Conditions:
1. That the garage be no closer to the side lot line than 6 feet,
1. That the garage be no closer to the front lot line than 15 feet,
3. That the porch be no closer to the front lot line than 14 feet,
4. That the deck not further encroach into the front yard setback beyond its current
encroachment,
® S. That all improvements be completed substantially as indicated on the plans submitted by
the applicant to this board, and
6. That no further encroachment into any setbacks take place without further variances from
this board.
A vote on the motion resulted as follows:
A YES: Sigel, Krantz, King, Rosen, Dixon.
NAYS: None.

Appeal of Hillside Alliance Church, owner, Ben DeGeorge, agent, requesting
variances from the requirements of Chapter 221 , Section 221 =513(1 )(c) " Exempt
Signs" and Section 221 -6A(1 )(a) " Regulated Signs" of the Town of Ithaca Code to
be permitted to install a wall sign on a shed located at 1422 Slaterville Rd, Tax
Parcel No. 58.=2-39.3, Medium Density Residential. Said sign exceeds the
allowable number of wall signs and the 24 square foot allowance for wall and
freestanding signs on the property.
Mr. DeGeorge appeared before the board on behalf of the Hillside Alliance Church . Chairperson
® Sigel stated that the appeal seemed straight forward and asked if Mr. DeGeorge had anything
he would like to add .

Final
Mr. DeGeorge explained that the Church would like to install the sign represented in the board
packet onto the shed . The sign, of course, would not say " Marietta United Christian Church ",
but rather " Hillside Alliance Church . " He went on to say that the sign cannot be seen from the
road . He explained that the purpose of the sign is to educate people making donations to
ensure the correct items are donated and are donated in the correct way.
Mr. DeGeorge went on to say that the project does not work without the signage because it
helps identify the support of the church, the location of the drop-off and acceptable donation
items . He stated that the proposed sign will be the only sign on the shed .
Mr. Krantz commented that it was hard to object to a clothing drop-off sign on a shed at a
church that cannot be seen from the road . Mr. Dixon added that it is very similar to the sign on
the shed at St. Catherine's church on Siena Dr.
Mr. Rosen asked that if the cross was not considered a sign, would the church need a variance
for the shed sign . Ms . Brock thought that was correct. Brief discussion followed .
Public Hearing
Chairperson Sigel opened the public hearing at 7 : 22 p . m . There being no one present other
than the applicant, he closed the public hearing at 7 : 22 p. m .
SEQR
Chairperson Sigel stated that the board needed to complete SEQR. Attorney Brock suggested
changes to Part I of the environmental assessment forms board agreed with suggested
changes . (The amended EAF Part I located in Zoning Board of Appeals file . )
Chairperson Sigel moved to make a negative determination of environmental significance based
upon the information in Part I and the reasons stated in Part II of the environmental
assessment form .
Seconded by Mr. Rosen . Vote—carried unanimously.

regard to the appeal of Hillside Alliance Church, based upon the information in Part I and for
reasons stated in Part II of the Environmental Assessment Form.

all criteria for an area variance had been satisfied, specifically listing how each criterion was
met, and with conditions on sign size and appearance .

58(1)(c) "Exempt Signs"and Section 221-6A(1)(a) "Regulated Signs" of the Town of Ithaca
Code to be permitted to install a wall sign on a shed located at 1422 5/aterville Rd, Tax Parcel
No. 58. -2-39.3, Medium Density Residential zone. Said sign exceeds the 24-square foot
allowance for wall and freestanding signs on the property.
Findings:
® That the benefit to the applicant does outweigh any detriment to the health, safety, and we/fare
of the community, specifically
1. The benefit the applicant wishes to achieve, which is to label a shed used for clothing and
other donations, cannot be achieved by any other means feasible,
2. That there will not be an undesirable change in neighborhood character or to nearby
properties given that the shed and the sign on it is not visible from the road and is also not
very noticeable for any nearby properties,
3. That the request is not substantial being only an approximately 8 square foot sign,
A That the request will not have adverse physical or environmental effects, and
5. That while the alleged dl>fculty is self-created, nevertheless the benefit to the applicant
does outweigh detriment to the health safety and welfare of the community.
Condition:
1. That the sign be no larger than 10 square feet, and
2. That the sign be substantially similar to the picture of the sign submitted by the applicant as
modified by the description submitted by the applicant to change the church name.
