McLELLAN and ELIZABETH S. McLELLAN, husband and wife, both residing at Ithaca, New York, herein called the grantors, and the . —_ = TOii�N OF-ITHAC/� ::==`':�, a municipal corporation in the County of Tompkins, New York, hereinafter called the grantee: WITNESSETH: That the grantors, in consideration of the sum of One ($1.00) Dollar and other good and valuable consideration, do hereby grant, release and°forever quitclaim unto the grantee, its successors and assigns forever, A PERMANENT EASEMENT to ::.May, construct, operate, reconstruct repair, enlarge, improve and maintain a sanitary sewer and appur- tenances in, on and over the following described land: ALL THAT TRACT OR PARCEL OF LAND, situate in the Village of Cayuga Heights, Tompkins County, New York, in constitu- ting a triangular piece of land at the extreme northerly bounds of the grantors' property, said triangle of land being formed by the east side of East Shore Drive and the southwest boundary of Renwick Place, and said triangular parcel of land being 10 feet in depth from the apex formed by the intersecting lines of the said roadways. This grant is free and clear from all encumbrances of any kind and nature except as follows: NONE. Before starting work on private property, the grantee, or its agents, shall notify the property owner in time so that he may remove from the line of work such plantings or structures as he wishes to preserve himself. The grantee agrees to have replaced the surface in as good condition as at present, including any blacktop, sidewalks, or other type of permanent surface, and if any part of the lawn is disturbed to regrade and reseed the same with a good grade of grass seed and to be responsible for any damage to poles, fences, mailboxes, arbors, masonry, and existing S drainage channels along and over said easement caused by the con- struction or repair of said sewer pipe line and to perform the work as promptly and with as little inconvenience as possible to the grantors. This agreement shall bind the heirs and representatives of the respective parties hereto.
