Dear Mr. Winn:
After reviewing the plan dated September 16, 1980, prepared lay
George Schlecht, P.E., L,S., showing two lots to be sold from a larger
parcel (6-58-2-22.2) owned by John Marion, we have determined no
action is required by this office.
The Marion Subdivision, showing 23 lots along Pine Tree and
Slaterville Road, was approved by this nffice on October 11, 1960.
Each lot was appr.)ximately 1001 by 2001, and was to be served by
public water and individual sewage systems.
j In 1978, we received a letter from Adams, Theisen, and Ward,
11 Attorneys, stating that lots 12, 14, 16, 18, 20, and 22 had not been
sold and requesting that we write a letter to the County Clerk in-
dicating that these lots are no longer approved. We did not do this,
since our subdivision review and approval concerns the satisfactory
arrangements for water supply and sewage disposal for proposed lots.
The water supply and sewage disposal systems (now, public sewer is
available) were still satisfactory.
Therefore, since our approval did not "lapse"., and water supply,,
and sewage disposal arrangements are still satisfactory, and the
lots are substantially (althaugh one is larger) the same as approved
in 1960, no action on our part is required for these lots to be de-
veloped now.
