Dear Mr. Hilker: . The present condition of your development at the end of Northview Road is disgraceful, unlawful, and of.inadequate construction quality as follows: (1) Sewer - The Town will not accept th.e public sewer line constructed in the fall of 1978 until the proper tests are-conducted'to the satisfaction of the Town and the City Sewer Division. Because of the poor quality control during construction in maintaining bedding, line, and.grade, minimum in spection and test shall include a visual inspection ' by tamping to verify that.there are no sags, curves, bulges, etc; infiltration and exfiltration water tests and air tests. Minimum standards and..methods of the Town, City and ASTM shall be met and fol- lowed. (2) Water.- The Town will not accept the public water fine constructed in fall of 1978 until. the proper tests are conducted to the satisfaction of the Town and the Southern Cayuga Lake Intermunicipal Water Commission. Because of the poor quality control during construction and existing field condition of. the end blow -off minimum inspection and'texts shall include a 24 hour pressure test and further disin- fection if necessary and be satisfactory to the Town and SCLIWC and follow.AWWA recommendations. (3) Sewer - The end manhole cover is not secured to the manhole structure. This is both hazardous and un- lawful. Surface run-off is illegally entering the sewer at this point due solely to your negligence.. { R t t.I LN 24 fhcE 74 -2 August 16, 1979 (4) Hi �hhway - The back fill used in trenches- in the portion of Northview Road West already a Town Highway is unacceptable. All trenches shall be straight saw cut on each edge with twenty one inches of material removed and replaced with twelve inches of crushed bank run gravel compacted in six inch lifts, with six inches of crusher run lime- stone, and with three inches of asphalt concrete. (5) HHihway - The road material in place for the sec- .t of n of Northview Road West not yet accepted as a Town Highway is unacceptable. As a part of con- structing the water and sewer mains back fill mate- rial of.shale and clay has been intermixed with what'crushed back run was hauled in. The present lack of roadside drainage.has trapped water in the base and sub. -base allowing heavy construction ve- hicles to pump fines into the gravel around the entire perimeter of the circle and thus ruining the gradation of the crushed bank run gravel.. The road specifications requiring twelve inches of crushed bank run gravel, six inches of crusher run lime - .stone, and double oil and limestone treatment should be developed treating the existing.material as a sub -base or removing it. (6) Drainage Ditches -The drainage.ditch in the rear of areas shoulU be shaped to a trapedozoidal cross- section -with minimum 1.on.2 side slopes from lot level to ditch bottom. While I have observed the ditch to be deep enough and at a sufficient slope it is little'more than a trench in spots which with- out shaping and stabilization of ground cover will slough off and silt up creating pools and.blockages and unpleasant breeding areas for mosquitoes. . (7) Subdivision -.At the.time you had obtained.your building permit for 215 Northv.iew Road West and had sold a lot to Mr. Louis Munch, 214 Northview Road, a portion of which.bordered the existing Town High- way you had gone as far as you could in obtaining .permits or selling lots without completing the above items and having.the Town accept same or posting a bond of acceptable type.and amount for their comple- tion. At the time you sold 215 and subdivided that lot from your remaining land.you sold a lot with no .legal access to an accepted Town Highway.. This is a clear violation of Town Law. A certificate of compliance.cannot be issued for 215 Northview.Road West until you complete the -improvements as described • 1 • -3 August'16, 1979 above. The owners of 215 Northview Road West now own .a landlocked.parcel of land and by virtue of your illegal action are also in violation of Town Law. Air. Munch ,is more fortunate in that h.is property in part borders on the older•portion.of Northview Road Lest, a.Town Highway. Under no circumstances can any land .be sold of or a permit: to build be issued on the remaining three lots. Further, the above violation of.Town Law should be resolved within sixty days or the Town will pursue appropriate legal action. (8) Surve� In the'process of surveying the area given to.e Town as park land as part of this subdivision we were unable to locate any property markers even for the lot at 215 Northview West which you had. sold. Subsequent to our finding the owner at 215. Northview West requested a survey from'you. This practice of riot surveying lands sold will not. be tolerated. in the Town of Ithaca. The above points are all very serious acts of neglect.. All are clearly violations of permit requirements, $ubdivision Law, and Town Law. Having asked you over a month ago to visit the Town office to go over problems with Northview West this letter is the next step in a legal process that will hopefully avoid court action with your cooperation. While some items require immediate attention like'the manhole cover, the re- maining paving and construction season makes the sixty day dealine firm, realistic, and sufficient..
