HomeMy WebLinkAboutBF149861-001I'M 22'ief:1082 Motion by Councilman-Deschi seconded by Councilman McElwee, In the matter of the sale of Town property on Elmira Road in the City of Ithaca: WHEREASs (1) The Town Board has caused a study to be made of the adequacy and suitability for use by the Town Highway Depart- ment of the property in the City of Ithaca on the Elmira Road which is now used and occupied by.the Town Highway Department,. and (2) The Town Engineer and Town Highway Superintendent have reported that said property is no longer adequate and suit- able for such purposes because of inadequate space, building con- ditions, and the like, and (3) it is further reported that the said property is not suitable for any other public purposes of the Town, and WHEREAS, the Board now makes the following determina- tions-. (A) That the said lands of the Town which are herein- after described are no longer adequate -or suitable for the present and the reasonably foreseeable needs of the Highway Department, and (B) That such lands and the buildings thereon are not required for any other present or reasonably foreseeable public purpose of the Town, and (C) That it would be in the best interests of the Town that such land be sold and that other lands more suitable for the purposes of the Highway Department be acquired, BE IT RESOLVED AS FOLLOWS: (1) The Town of Ithaca will sell real property, inc lud- ing lands and buildings thereon, owned by the Town in the City of Ithaca, fronting on the southeasterly side of Elmira Road (Route 13), and with rear line fronting on Spencer Road, being substantially shown as Tax Parcel 125-2-2 on the City of Ithaca Tax Map, and being all of the land used and occupied by the Town Highway Department. (2) The sale shall be by (i) auction to the highest bidder on such terms and provisions as are prepared by -the Town Supervisor and the Attorney for the Town including, amongst others, the right of the Town to reject any and all bids or (ii) in the event any such bids are rejected or the sale is not otherwise consummated in accordance with the terms of the auetio sale, then the property shall be resold in such manner as the .terms df sale may require or as the Town Board may otherwise determine. (3) Any auction sale shall be held upon compliance with all provisions of law and .as soon as all documents have been pre- pared and ,all necessary arrangements made. Without -limiting the; authority of the Supervisor, it is now contemplated that June 28„ 1976 is a tentative date for the auction sale, and that a tenta- tive date for delivery of title and possession is February 1, 1977. I 1 �1_ Pq f 22 rocdM r 2 - (4) The Town Supervisor is authorized to obtain and pay for the services of an auctioneer and to incur and pay for I' all other reasonable expenses required in connection with such ji sale and the preparation for such sale, including, amongst others, the cost of advertising any such sale in newspapers or other j media, preparation of brochures, appraisals and surveys, if any, 11 and title documents, and the Town Supervisor is authorized to I� execute and deliver all deeds and other instruments necessary to effect such sale and to do any and all other acts which may ,jj be necessary to accomplish the purposes of this resolution. �I (5) This resolution is subject to a permissive refer endum in accordance with the provisions of Town Law. f { * Ar At At STATE OF NEW YORK ) Il COUNTY OF TOMPKINS . ss: I, the undersigned Clerk of the Town of It haca, Tompkins County, New York, DO HEREBY. -CERTIFY: r That I have compared the foregoing copy of the minutes of an:adjourned meeting of the Town Board of said Town, held on the 17th day of May, 1976, with the original thereof on file in my office, and that the same is a true and correct copy of said original and of the whole.of said original.
