ZONING BOARD OF APPEALS
OCTOBER 20, 1975 '
A Meeting of the Town of Ithaca Zoning Board of Appeals was
held in the Town of Ithaca Town Hall, 126 East Seneca Street, (second
floor)@ Ithaca, New York, on Monday, October 20, 1975, at 7:30 p.m.
PRESENT: Chairman Peter Francese, Jack Hewett, Laurene Ripley,
Edward Austen, Lawrence Fabbroni (Building Inspector).
ABSENT: Edward King.
ALSO PRESENT: Mr. and Mrs. Car% Root, Mr. and Mrs. Richard
Pendleton.
The Meeting was called to order by the Chairman'at 7:39 p.m.
PUBLIC HEARINGS APPEAL OF CARL AND ELSIE ROOT FROM THE DECISION OF
THE BUILDING INSPECTOR DENYING PERMISSION TO SUBDIVIDE A PARCEL
(16-66-3-4) WITH T140 HOMES THEREON INTO TWO SUBSTANDARD LOTS.EACH
WITH ONE EXISTING HOME, AT 336 FOREST HOME DRIVE, ITHACA, NEW YORK.
PERMISSION IS DENIED BY THE BUILDING INSPECTOR UNDER ARTICLE IV,
SECTIONS 14 AND 160 AND ARTICLE XIII, SECTION 67 OF THE ZONING
ORDINANCE.
Chairman Francese declared the Public Hearing in the above -
noted matter duly opened at 709 p.m.
Mr. Fabbroni presented the Appeal as published in the Ithaca
Journal on October 15, 1975, and presented for the record the Town
Clerk's Affidavit of Posting and Publication of *aid Appeal. 'Mr.
Fabbroni presented for the record the Secretary's Affidavit of
Service by Mail of the Notice of Public Hearing duly mailed to the
adjacent landowners. Mr: Fabbroni presented the Appeal Form signed
by Mr. and Mrs. Root and dated October 2, 1975.
The survey map presented by Mr. and Mrs.,Root titled 'Map of
Former William Mitchell Property at Forest Home on Lot 93 in Town of
Ithaca, N.Y.", drawn by Carl Crandall,-C.E. and dated May 6, 1953,
with addendum as follows: "In the late 19508s, as a flood control
measure, the creek was dredged and what had been an island in the
middle of the creek was pushed ashore. This operation added 25-30.1
to the property."
Mr. Austen asked Mr. Fabbroni what the zoning is for this area
and Mr. Fabbroni stated that it is in an R-15 zone.
Mr. Francese noted that there is about 508between the two
existinq houses.
Mr. Fabbroni stated that to Mr. Roots knowledqe the oldest
house was built around 1942 and that both houses predate zoning in
the Town of Ithaca.

Mr. Francese noted that except for the depth, both proposed
;i lots would have 1009 of frontage each.
Mr. Francese asked who was present for this Hearing -and Mr.
and Mrs. Root identified themselves and also Mr. and Mrs. Pendleton.
Mr. Pendleton stated that he owns the next four properties after the
Cornell property.
Mr. Francese asked Mr. Root to please explain why he wants to
divide this property. Mr. Root stated that he is thinking of
retiring and thinking of moving into the small house and selling
the big one or renting it. He stated that they have been there for
9-1/2 years. He stated that when they purchased the property, it
was.advertised that they could buy one house or both. He stated that
it never occurred to them when they bought them that it was one lot.
Mr. Francese asked Mr. Pendleton if he wished to express any,
objections to this proposal. %Mr. Pendleton stated that he did note
see any reason why this should not be done. He stated that he could
see no way in which making two properties rather than one would
depress any property values. He stated that he has not talked to the
Roots about this, he has just read about it. He stated that he is
perfectly'in agreement with the proposal. Mrs. Pendleton did not
make a statement.
Mr. Francese asked the members of the Board if they had any
problems with this matter. Each member present indicated that they
had no objections to the division of the existing lot. -
MOTION by Mr. Peter Francese, seconded by Mrs. Lauren Ripley:
RESOLVED, that the Zoning Board of Appeals of the Town of
Ithaca grant and hereby does grant an area variance to subdivide
Parcel No. 6-66-3-4 at 336 Forest Home Drive, Ithaca, N.Y. into two
lots. The dividing line between the lots to be formed shall be
approximately 129 west of and parallel to the westerly line of the
most easterly building in question. The Zoning Board -of Appeals of
the Town of Ithaca finds that this area variance is warranted since
both buildings.and lot condition precede the existing Zoning
Ordinance of the Town of Ithaca.
There being no further discussion, the Chair called for a vote.
Aye - Francese, Hewett, Ripley, Austen.
Nay - None.
The Chairman declared the Motion carried unanimously.
The Public Hearing in the Root Appeal was declared closed by
the Chair at 8:00 p.m.
ADJOURNMENT
The meeting was declared adjourned at 8:05 p.m. The Zoning
