RESOLUTION DATED 1974.
A RESOLUTION MAKING CERTAIN DETERMINATIONS IN RELATION TO
INCREASE AND IMPROVEMENT OF THE FACILITIES
THE PROPOSED
OF WATER DISTRICT NO. 1 AND MCKINNEWATEERR•DISTRICT OF TM
TOWN OF LANSING, TOMPKINS COUNTY, YO
WHEREAS, the Town Board of the Town of Lansing, Tompkins County. 3
New York, by proceedings heretofore had and taken pursuant to Section
202-b of the Town Law, has determined it to be in the public interest f
•
to provide a certain increase and improvement of the facilities
of Water District NO. 1 and the McKinney Water District in a&"
Town consisting of a comprehensive water improvement including a
water treatment plant, transmission main and pump station for an
intermunicipal water supply facility for the Towns of Dryden,
Ithaca and Lansing and the Village of Cayuga Heights, all in
Tompkins County, New York, for the joint use and operation by the

said four municipalities of said facilities pursuant to an agreement
of municipal cooperation to be entered into by and between the said
Towns and the said Village pursuant to Article 5-0 of the General
Municipal Law, at an estimated cost of $4,150;000, which improvement
is more fully described in a map, plan and report prepared -In
connection therewith and is now on file in the office of the Town
Clerks and
WHEREAS, it has been determined that in order to contract
for the construction of said facilities it will be necessary to
•
increase the estimated cost thereof from $4,150,000 to $6,070,0001 amd
WHEREAS, said Town Board of the Town of Lansing duly adopted
an order on November 12 , 1974, calling a public hearing to eonsides
said proposed increase and improvement of facilities at the newly
estimated maximum cost, which public hearing was to be heldat the
Town Hall in said Town on the 26th day of November, 1974, at
8:00 o'clock P.M., Eastern Standard Tint and
WHEREAS, -notice of said public hearing was duly published and
posted in the manner provided by law and proof thereof has been
submitted to said Town Boards and
WHEREAS, said public hearing was duly held at the time and place
aforesaid, at which all persons interested were duly beard; and
WHEREAS, said Town Board has duly considered all of the
evidence given at such public hearing; NOW, THEREFORE, BE XT
RESOLVED, by the Town Board of the Town of Lansing, Tompkins
•
County, New York, as follows:
Section 1. Based upon the evidence given at the aforesaid public
hearing, it'has been found and determined to be in the public interest
to provide for the aforesaid increase and improvement of the facilities
of Water.Ristrict No. 1 and the McKinney Water District of the
Town of LdRsing, Tompkins County, New York, as described in the
preambles-:hrereof, at an estimated cost of $6,070,000, and the

appropriate modification of the aforesaid agreement of municipal
cooperation under which said improvement will be authorised is
hereby approved and the participation by said Town of Lansing, Tompkins
County, New York, in said agreement is hereby authorised. The amount
of said cost allocated to the Town of Lansing, pursuant to said
agreement ahall be borne'by the aforesaid water District 110. 1 by
the assessment, levy and collection from the several lots and parcels
therein in just proportion to the amount of benefit which the water
improvement shall confer upon said lots and parcels and by the
McKinney water District in said Town by "a assessment, levy and
collection from the several lots and parcels of land therein in the
same manner and at the saw time as other Tam charges.
Section 2. This resolution is adopted subject to the, ezecutiom
of the aforesaid agreement of municipal cooperation among the
aforesaid Towns and Village.
Section 3. This resolution shall take effect immediately.
The question of the adoption of the foregoing resolution was duly
put to a vote on roll call, which resulted as followsc
