The meeting was called to order by De ut and L± rton e upon roll being called, there were PRESENTt Councilman John Joubert Councilman Lewis Gridley Councilman Clinton Cotterill Councilman Merton Webb ABSENTt Supervisor Charles McCord The following resolution was offered by Councilman Gridley who moved its adoption, seconded by Councilman-jnnhprr to --blitz RESOLUTION DATED December 3. . 1974. A RESOLUTION MAILING CERTAIN DETERMINATIONS IN RELATION TO THE PROPOSED INCREASE AND IMPROVEMENT OF THE FACILITIES OF WATER DISTRICT NO. 1 OF THE TOWN OF DRYDEN, TOMPKINS COUNTY, NEW YORK. € WHEREAS, the Town Board of the Town of Dryden, Tompkins County, New York, by proceedings" Foretofore had and taken pursuant to Section 202-b of the Town Law has determined it to be in the public interest to provide a certain increase and improvement of the facilities of Water District No. 1 in said Town consisting of a comprehensive water improvement including a water treatment plant, transmission, r main and pump station for an intermunicipal water supply facility for the Towns of Dryden, Ithaca and Lansing and the Village of Cayuga Heights, all in Tompkins County, New York, for the joint a use and operation by the said four municipalities of said facilities. pursuant to an agreement of municipal cooperation to be entered zr 21 to 308 -z_ into by and between the said Towns and the said village pursuant to_Article 5-G of the General municipal, -Law, at an estimated cost of-$4,150,000, which improvement is'nore fully described , in a map, plan and.report prepared in"connection therewith and is now on file in the office of the Town Clerks and WHEREAS, it has been determined that in order to contract " for the construction of said facilities it will be necessary to increase the estimated cost thereof from $4,150,000 to $6,070,000; and WHEREAS, said Town Board of the Town of Dryden duly adopted • an order on November _f A , 1974, calling a public hearing to consider said proposed increase and improvement of facilities at the newly estimated maximum cost, which public hearing was to be held at the .ua in said Town on the 3 14 day Of lFevember, 1974, at 7; o o'clock P.H., Eastern Standard Times and WHEREAS, notice of said public hearing was duly published and posted in the meaner provided by law and proof thereof has been submitted to said Town-Boardr and WHEREAS, said public hearing was duly held at the time and place aforesaid, at which all persons interested were duly beards and WHEREAS, said sown Board has duly considered all of the evidence given at such public hearings NOW, THEREFORE, BE IT RESOLVED, by the Town'Soard of the Town of Dryden, Tompkins t County, New York, as follows: • Section 1. Based upon the evidence given at the aforesaid public hearing, it has been found and determined to be in the public interest to provide for the aforesaid increase and improvement of the facilities of Water District No. of the Town of Drydaii, Tompkins County, New York, as described in the preambles hrereof, at an estimated cost of $6,070,000, and the appropriate modification of the aforesaid agreement of municipal cooperation -under which said improvement will be authorized is hereby approved and the participation by . -3- • lEy .21 tw said Town of Dryden, Tompkins County, Nov York, in said agreement is hereby authorised. The amount of said cost allocated to the Town of Dryden, pursuant to said agreement shall be borne by the aforesaid Nster District No. 1 by the assessment, levy and collection from the several lots and parcels therein in just proportion to the amount of benefit which the water Improvement shall confer upon said lots and parcels. Section 2. This resolution is adopted subject to the execution of the aforesaid agreement of municipal cooperation ymmg the • aforesaid Towns and village. Section 3. This resolution shall take effect immediately.
