Ithaca, Tompkins County, New York, held at the Town Offices, in
the City of Ithaca, New York, in said Town, on the lft day of
December, 1973, at 5:00 p.m., Eastern Standard Time.
The'meeting'was called to order by Supervisor Schwan and (�

McElwee who moved its adoption, seconded by Councilman s

A RESOLUTION ESTABLISHING A BENEFITED AREA IN AND
'I FOR THE TOWN OF ITHACA, TOMPKINS CUUNTY,.NEW YORK,
+. !� TO BE KNOWN AS THE TOWN WIDE SEWER IMPROVEMENT
1 BENEFITED AREA, AND AUTHORIZING THE PROVIDING OF

A TOWN SEWER IMPROVEMENT FOR SAID AREA.
i{ WHEREAS, the Town Board of the Town of Ithaca, Tompkins "
;i
County, New York, has heretofore duly caused a plan, report and
li map to be prepared and filed in the office of the Town Clerk of i
!� said Town in relation to the providing of a sanitary sewer improve-
ment for the area of said Town outside of any villages, which area!
is the area benefited by said improvement as hereinafter describ9d�
pursuant to Article 12-C of the Town Law; and

WHEREAS, an order was duly adopted by said Town Board on

October 23, 1973, reciting the proposed improvement,.a description+
j I
i of the boundaries of the proposed benefited area, the maximum
amount proposed to be expended for said sewer -improvement, the 4r
proposed method of a e' p p apportioning the cost of said sewer improvement
'} the proposed method of financing to be employed, the fact that
1! said plan, report and map were filed in the Town Clerk's office

for public inspection specifying the Town offices on the third
floor at 108 East Green Street, Ithaca, New York, as the place,
where, and November 12, 1973 at 5:30 p.m., as the time when such
Board would meet and hold a public hearing on the authorization

of the said improvement and establishment of the said proposed

benefited•arer and on the plan, report and map filed in relation
thereto, at which all persons interested in the subject thereof
i
would be heard concerning the same; and •

WHEREAS, said Town Board duly caused a copy of said order.-

to be published and posted in the manner and within the time.pro-
vided b law, roof of said publication and

duly presented to said Town Board; and
WHEREAS, said.public hearing was duly held at the time
i and place aforesaid, at which all persons desiring to be heard i
were duly heard; and
WHEREAS, the Town Board duly consideted the aforesaid

plan and the proposal was adjourned and th#? Project Engineer was ;
authorized to prepare an amended plan, report and map to provide

for additional extensions and facilities to.said.sewer improvement

and such amended plan, report and map was .filed in the office of
the Town Clerk and an order was duly adorted by the. Town Board
on November 19, 1973, reciting the filing of the amended plan,
report and map showing such additional extA=iiuns to the sewer. :_; '
improvement calling for a public hearing on December 3, 1973, and
WHEREAS, the Town Board.duly caused a copy of said order
to be published and posted in the manner and within the time pro'
vided by law, and proof of said publication and posting has been
duly presented to the Town Board; and

WHEREAS, the public hearing was duly held at the time and j
place'aforesaid, at which all persons desiring to be_heard were i

WHEREAS, said Town Board has duly considered the afore-
said plan, report and map, as amended, and the evidence given at
r said public hearing; NOW, THEREFORE, BE IT.
RESOLVED, by the Town Board of the Town of Ithaca, Tomp-
kins County, New York, as follows:
Section 1. Upon the evidence given at the aforesaid ;
public hearings it is hereby found and determined:
a) That all the property in the said benefited area
as hereinafter described is benefited by said
( sewer improvement and that all property benefited
by said sewer improvement is included in said
benefited area; and i
;i b) That it is in the public interest to establish
such benefited area as hereinafter described and ;
to provide said sewer improvement as hereinafter
't authorized. f I

Section 2. The establishment of tht- iforesaid benefited
s. area to be designated and known as Town Wide ,'awer.Improvement
Benefited Area in said Town is.hereby authori?ed and approved, r
said area to consist of the entire area of 't%*- Town of Ithaca
outside of the Village of Cayuga Heights, the only village located
in said Town.
Section 3. Construction of the aforesaid sewer improve-
ment substantially in accordance with the aforesaid plan, report
and map, as amended, consisting of eight inch sanitary sewer lines,
i'
manholes, four inch house laterals, force mains, pump and lift
?stations and other appurtenant facilities for'con.nection to.the
existinq sanitary sewer system in said Town, is hereby authorized
tat.a maximum estimated cost of $970,000. Such cost shall be borne
by the aforesaid benefited area, constituting the entire area of
the Town of Ithaca, outside of the Village of Cayuga Heights, and '

to the extent not paid fr(a revenues derived from sewer rents or
other available funds, such cost shall be assessed, levied and
collected from the several lots and parcels of land in said bene
fited-area of the Town of Ithaca, in just proportion to the amount
of benefit which the sewer improvement shall confer upon said lots
and parcels, and such cost shall be financed by the issuance of
serial bonds of said Town to mature in'annual installments for
a period not exceeding forty years.
Section 4. This resolution is adopted subject to approva
of the State Comptroller in accordance with the provisions of subt
t division 13 of Section 209-q of the Town Law, and the Town Super-
.li
visor is hereby authorized to execute and file an application in
the Department of Audit and Control containing any required in-
formation for purposes of obtaining such approval.
Section 5. Pursuant to the provisions of subdivision 11(t)
,i of Section 209-q of the Town Law this resolution is adopted sub-
ject to permissive referendum.
The question of the adoption of the forefoing resolution
was duly put to a vote on roll call, which resulted as follows:_
