In the Matter t of t The Establishment of the Second South t Hill dater District (1966).in the t FINAL ORDER Town of Ithaca, County of Tompkins, t CSTABLISHINC DISTRICT, State of Now York, pursuant to Articles �12-A of the Town Law. t -rrrrrr�-�rrrrrrrrrrrrrrrrrr—r�rr-��rr WILERCAS a trap, plan and report relating to the establish ment.of the proposed Second South Hill Water District 119609 pre- persd by competent engineers, duly licensed by the State of New York, was duly presented to and filed with the Town Board and an 1 Order was duly adopted by the Town Board on the 18th day of April, 1966 for the hearing of all persons interested in the matter on th i 9th day of May, 19669 at 6t00 o'clock P.K. on that day at the City Council Room of the City all in the City of Ithaca, Tompkins Coup yg'. Now York; and a hearing by the.s4id Board having boon duly hold at such time and place and it having been duly resolved and determine JqLi on the 9th day of May, 1966, following such hearing that the Notic j. of Hearing was published and posted as required by lei+ and was otherwise sufficient and that all the property and.property owners. within the proposed aiatrict wore benefited thereby, and that all i of the property and property owners benefited are included within i the limits of the district andthat the establishment of such district was in the public interest and it having been further resolved and determined that the establishment of a water district as set forth in the aforesaid map, plan•and report be approved, and that the improvement therein, mentioned be constructed, and r � 17 7" ,V the boundaries of the district having been then and there finally determined and set forth -and described in the said Resolution, and it having been further resolved that said Resolution was subject x to a permissive referendum as provided'in Section 209-e of the Town Law, and application havinf been thereafter duly made in -duplicate to the State Department of Audit and Controlat Albany, New York by application of the Supervisor of the.Town of Ithaca, i. dated June 229 1266, for permission to area -to such district as more fully provided for by.Artials 12•A of the Town Law, and the State Comptroller having duly made an order in duplicate dated the 7th day of �OVeO�r , 1966, granting permission for the creation of the district; and one copy of such order having been duly filed in the Office of the State Department of Audit and { Control at. Albany, New York, and the other in the Office of the loth November ` Town Clerk of this Town, on the day of , 1966 and the Town Clerk having duly presented such order to this Board at E, t its first meeting held after.the said order was filed with hie, amd 3 it further appearing that within ten days after the adoption by the Town Board of the aforesaid Resolution.the Town Clerk caused p � a Notice of said Resolution to be posted and published in the manner -provided for by Section .0 of the Town Law which Notice. contained the date of the adoption of the Resolution, and a copy of such Resolution, and which Notice specified that such Resoluti n ' was.adopted subject to a permissive referendum, and it further i appearing that more than thirty days have expired since the adopt on ! , of the aforesaid Resolution, and that no petition subscribed and' acknowledged by any person or persons qualified to vote upon the ¢' proposition has been filed with the Town Clark and the Town Clerk o-, having filed a certificate stating such fact in the Office of the Tompkins County Clerk and in the Office of the Department of Audi a JAMM V.
