A
1. That he resides at 1075 Tau7haock Boulevard, Ithaca,
;dew York.
2. That deponent is one of the Grantees in a deed to
Harold A. Fish and W. l:u,ene Dennis from The Delaware, Lackawanna
rind Wcst.ero ",allroad Company dated ,January 31, 1958 and recorded
In the Tompkins County Clerk's office in Liber 404 of Deeds at
page 454.
3. That said deed was made subject to any outstanding right,
title and interest, if any, by reason of a deed to Hoffman
Steenburg and others,•Trustees, School District number twenty-six,
Town of Ithaca, Tomnkins County from the Cayuga & Susquehannah
Rail Road company dated November 12, 1851 and recorded in said
Clerk's office in Liber 59 of Deeds at page 291.'
4. That said School District, number twenty-six became
School District number seven and was consolidated with City School
District, City of Ithaca, New York on July 1, 1956.
5. That the premises described in said deed to nof.fman
Steenbur. and others, as Trustees, dated November 12, 1851,
ceased to be used for school purposes prior to July 1, 1956 and
have not been used for school purposes since said date, that the
school house which was on said premises was taken down and said

premises reverted to The Delaware, Lackawanna and Western Railroad
Company in accordance with the terms of said Deed of November 12,
1851 since said Railroad Company succeeded to the ,ayua &
Susquehannah R.1il. toad Company by certificate of mer-:,er filed in
the office of the Secretary of State of the State of `low York on
December 20, 1946, a certified copy of which was recorded in said
Clerk's office on June 3, 1958 in i.iber 14 of miscellaneous
Records at pa.,e 134.
6. That by virtue of the foregoing facts, title to the
premises described in said deed of November 12, 1851 passed to
Harold A. Fish and W. Eu;;ene Dennis by virtue.of said deed of
.January 31, 1958 since said School District was no longer in
existence on January 31, 1958 and title to said premises passed
to W.'Eu,ene Dennis in accordance with the terms of a deed dated
March 7, 1958 to W. Eugene Cennis from Harold A. Fish and W.
Eugene Dennis recorded in said Clerk's office in Liber 404 of
Deeds ,it page 461.
