said point being 33 feet northerly at right angles from the center
line ,of the track'otherwise spelled as "tract" in a deed from the
party .of the second part to the party of the first part_ recorded.in
Tompkins County Clerk's Office in.Book 266 of Deeds at Page 37, and
being the southwest corner of lands.conveyed to the -party of. i'
the second part by deed of Ithaca :Enterprises.' Inc. dated June 30, -
IS38 and recorded in the Tompkins County Clerk's Office in Book
248 of Deeds at Page 254; thence easterly along the curving'
northerly line of.the right of way of said D. L. & W. Railroad 455
feet to an iron.pipe, said course passing through a concrete
monument 271.5 feet easterly from the place of beginning; thence``
north 77 degrees 30 minutes east 321.1 feet to an iron pipe', said i
course passing through an iron pipe near a 16 inch hickory tree 37.7
feet northeasterly from the beginning _of said course;-thence,south
77 degrees east 231-feet to an iron pipe..(In the deed from the party

at a regular meeting thereof, held on the 4th day.of September;
1952, subject to a permissive referendum according to the provisions
:i of the Town Law,of .the State of New York to become effective on the.
4th day of October..ly 2, if no petition protesting against such I
resolution was filed with the clerk, and requesting that it be
submitted to the qualified electors of the town for their approval
or disapproval. No such petition was filed with the Clerk, and the
resolution became effective on the 4th day of October. 1952. r
