Call to Order
Chairperson Sigel called the meeting to order at 7 : 04 p . m . He welcomed everyone to
the November meeting of the Town of Ithaca Zoning Board of Appeals and announced
there were two appeals before the Board .
APPEAL of Antonio and Diane Bozzelli , Owners/Appellants , requesting area
variances from the requirements of Chapter 270 , Article XI , Section 270=71 ,
Subsection C , to allow insufficient side yard setback of an enclosed porch on a
property located at 204 Tareyton Drive , Town of Ithaca Tax Parcel # 70 .= 11 - 10 , a
Medium Density Residential ( MDR) Zone .
Chairman Sigel asked the Applicants if there was anything they wanted to add . The
Applicants thought it was straight forward and would answer any questions . The Board
had no questions .
Chairman Sigel opened the public hearing at 7 : 07 p . m . There was no one wishing to
address the Board . The public hearing was closed at 7 : 07p . m .

Motion made by Kirk Sigel , seconded by Ron Krantz.
RESOLVED that this Board grant the appeal of Antonio and Diane Bozzelli requesting
area variances from the requirements of Chapter 270 , Article IX , Section 270- 71 ,
Subsection C , to allow insufficient side yard setback of an enclosed porch on a property
located at 204 Tareyton Drive , Town of Ithaca Tax Parcel # 70 . - 11 - 10 , a Medium
Density Residential Zone with the following :
Conditions :
1 . That the setback be no less than 12 ' from the side yard , and
2 . That no further construction take place within the required 15 ' setback without a
variance from this Board .
With the following
Findings :
That the benefit to the applicant does outweigh any detriment to the health safety and
welfare of the community , specifically :
1 . That the benefit the applicant wishes to achieve , which is that of maintaining an
enclosed porch which has existed for approximately 20 years , can not be
achieved by any other means , and
2 . That an undesirable change in the neighborhood character or to nearby
properties will not take place given that the structure has existed for some time ,
and
3 . That the request is not substantial , and
4 . That the request will not have adverse physical or environmental effects , and
5 . That the alleged difficulty is not self-created given that the applicant purchased
the home recently not realizing that there was a deficient side yard setback .

APPEAL of Joseph A. and Judith K . Burns , Owners/Appellants requesting area
variances from the requirements of Chapter 270 , Article VII , Section 270=45
Sections (A) ( 1 )( b )(6 ) and ( 8) , to exceed the allowable square footage and width of
a dock , located at 1089 Taughannock Blvd , Town of Ithaca Tax Parcel # 21 . =2-3 , a
Lakefront Residential ( LR) Zone .
Chairman Sigel asked the Applicants if they had anything to add to the submitted
materials .
Mr. Burns summarized the appeal and reiterated that options such as extending the
dock by 8 feet on only a portion of the existing 12 foot dock would be unsafe for children
as well as not aesthetically pleasing . The extension is needed to realize a deep enough
depth due to the creek making a delta of sediment into the lake . He also stated that he
had received approval from the DEC last week . He also stated that they had lived on
the property for over 40 years and plan to continue to live there .
Chairman Sigel noted that an email was before the Board when they arrived and gave
the Board a chance to review it . Ms . Brock made the comment that the email primarily
dealt with the length of the dock but that is not before the Zoning Board , The Planning
Board has jurisdiction over that and they have dealt with it . The ZBA is ruling on the
request for a variance on the width and total area . The Applicant noted that it was not
much more than what the Town Board was passing and Ms . Brock stated that the
Zoning Board can not assume what may or may not be passed by the Board and
therefore must rule based on the law as it is currently written .
Chairman Sigel asked why the extension needed to go further out than the hoist and the
Applicant gave the reasons that the dock protects you from the north waves and
provides a barrier and the view from the end of the dock would be blocked by the hoist if
it did not extend out a little further.
There was some discussion about the aerial photographs which seemed to depict trees
blocking the view of the dock by the neighbors . Mr. Burns said it is mostly brush and
there was a neighbor present who state he would speak to that .

Dave Mountin asked why the added length and Mr. Burns again stated that the depth is
needed . Ms . Mann asked why the extra width , and Mr. Burns stated the aesthetic and
safety concerns .
Jim Neifer spoke for the appeal in stating that the frontage is quite large and the request
for a bigger dock is reasonable in relation to the frontage . He also noted that there are
larger docks in the neighborhood .
Ms . Mann asked if the Town Board was taking into consideration the amount of
lakefront when setting the restrictions and Ms . Brock said no .
The public hearing was opened at 7 : 22 p . m . Four long -time neighbors of the Burns'
addressed the Board regarding the request and all stated they were in full support of it
and had no issues whatsoever. One neighbor assured the Board that it would not affect
boating along the shore in things such as kayaks which he does quite often .
The public hearing was closed at 7 : 27 p . m .

to nearby properties given that it is a modest extension to an existing dock , and
3 . That while the requests are substantial given the current law, being
approximately 30 % greater square footage and 50 % greater width , that
nevertheless , the benefit to the Applicant does outweigh any detriment to the
health , safety and welfare , and
4 . That there will not be any adverse physical or environmental effects as
evidenced by the Part 11 Environmental report prepared by Town Staff, and

5 . That while the alleged difficulty is self- created , nevertheless , the benefit to the
Applicant , again , does outweigh any detriment to the health , safety and welfare
of the community.
A vote on the motion resulted as follows :

Chairman Sigel thanked the applicants .
Other Business
Chairman Sigel asked Bruce Bates for an update on the Knewstub Complaint . The
complaint is still being investigated . Mr. Bates is meeting with the complainant
tomorrow and will be reviewing the CD evidence . The last inspection was on
September 25th . Discussion followed and Chairman Sigel asked that a determination be
made so that the Board had something to agree or disagree with and make a ruling . He
felt until that was done , the Board had no action it could take . Mr. Bates appreciated
the direction and will have a written finding as soon as he is able .
