MEETING OF THE ITHACA TOWN BOARD

1. Call to order and Pledge of Allegiance
Mr. Howe opened the meeting at 5:33 p.m.
2. Report of Fire Chief — Tom Parsons (Attachment 1)
Chief Parsons summarized his submitted report, saying that the City of Ithaca passed their budget
Wednesday with the IFD budget at $11,366,096 which is an .8% increase over 2020.
In this budget, new equipment lines are $45 - $50k for the replacement of a 13 -year-old staff
vehicle (Hybrid with lights); fire hose replacements; portable radio replacements (multi-year plan)
and an upgrade/replacement of our Administrative Management system from server -based to
cloud -based.
Staffing — Funded positions are: Fire Chief, 6 Assistant Fire Chiefs, 8 Fire Lieutenants, and 49
Fire Fighter positions as well as an Administrative Coordinator. This represents the same staffing
level as 3 years ago and is a reduction of 1 Chief and 2 Firefighter positions.
Positions that became vacant due to retirements were not filled because we did not know what
would happen in the budget negotiations and now that it is adopted, we missed the Fall training
session and six firefighters will be hired and sent in the Spring to be activated in late July.
Capital Project — Replacement of a pumper truck with expected delivery in 2022. We are trying
to move to a greener fleet and the engine expected in January has idle reduction technology which
will shut the truck off when not pumping water so basically when we are standing by for an
accident or similar calls, it will shut down and reduce our carbon footprint.
Mr. DePaolo asked what happens to the funding related to unfilled positions for this current year?
Do those funds roll over to the 2021 budget or is this budget in addition to funds that were not used
for those positions?

Chief Parsons replied that the funds are not rolled over and were used to reduce the overall budget
and increased expenses in overtime, sick and family leave associated with the COVID-19
Pandemic.
Mr. DePaolo asked for clarification that the money was used to reduce the budget shortfall in the
Fire Department and not returned to the City of Ithaca's General fund.
Mr. Parsons replied that the City bills the Town quarterly and that is based on actual expenses of
the Fire Department; funds are not banked into the next quarter. He added that if IFD saves money
or reduces costs, that reduction is seen by the Town in the percentage billed.
Mr. DePaolo asked if the percentage that the Town pays is based on a percentage that's determined
every calendar year or is it the length of the contract?
Chief Parsons replied that it's a percentage of the contract of that year and every year that
percentage is recalculated. The Town does not see the actual costs until we send the bill each
quarter. He added that at the end of the year Steve Thayer and Mike Solvig reconcile the total
amount of money due.
Chief Parsons stated that they do not go over budget very often and have not in the past few years.
Overall, we are going to going to be under budget this year even with all the increased personnel
costs due to COVID-19 and leaving the open positions vacant is going to help.
We have incurred overtime costs because when you are short 5 positions due to retirements and
people separating from service, overtime is incurred to keep all shifts filled. He added that we have
a couple shifts that are short staffed so when people are on vacation, we have to pay overtime.
Chief Parsons stated that next Spring we will be in the same situation, incurring overtime costs,
but hopefully that will stop when we are fully staffed the second half of the year.
Mr. DePaolo asked if he anticipated that costs are going to revert to historical levels, meaning
when IC students coming back? He asked if he sees that as a driver of the number of calls the
department responds to.
Chief Parsons replied that with Cornell and IC not here, call volume has decreased and he assumed
it was mostly due to the student population, but, in talking with his peers across the state, overall
fire and medical emergency call volume is down 10-15% across the state. He attributed that to
people being less mobile and working from home and not traveling as well as businesses being
closed or restricted.
Chief Parsons added that in the last few weeks we have seen the call volume move back to normal
numbers at around 110/week where in the spring, we were at 70-80/week.
Mr. Goodman stated that it seems there was a flurry of gorge rescues this past summer and he
asked if the volume of those types of rescue calls were abnormally high and whether the City has

discussed ways of collecting money for those calls specifically because he assumed they are
expensive.
Chief Parsons replied that with the call volume low, they have been managing gorge rescues within
existing resources and only had a few times that they had to bring in additional labor.
He added that what is happening in Ithaca is not unique to Ithaca, it is happening across the state
where there are recreational trails. Rangers have been very, very busy doing rescues for people
hiking in areas they are unfamiliar with or not prepared for. We have been to Treman and upper
Buttermilk where people have hiked up the trail and found that their physical fitness was not such
that they could complete the hike so they've called for help to assist them back out. This is a new
phenomenon we aren't familiar with.
Chief Parsons said that it is very obvious on all the trails that they've been highly used this year
with a lot of foot traffic; paths are widened as people a trying to maintain social distancing and
sometimes getting off the trail and into places they shouldn't.
3. Persons to be heard and board comments — No comments
4. Public hearing regarding Revised Official Town Map
Mr. Howe opened the public hearing at 5:55 p.m. There was no one wishing to speak on the subject
and Mr. Moseley stated for the record that there were no comments received or calls during the
meeting, and the hearing was closed.
Ms. Ritter noted that the comment regarding the farm road off of Blue Grass Ln by Bruce and
Doug Brittain was resolved. They were concerned that the reference to that "road" in the 2007
Transportation Plan as a multi -use trail would be forgotten. Staff does not believe that will happen
and that area is a natural place to look for future trails. The Official Map is not the place for that
type of designation.
Mr. Thaete and Mr. Coates agreed, adding that it does not meet the criteria for emergency access
and structural stability and they discussed this with Cornell, and they concurred that this path or
farm road is not a passable route and should not be on a map.
TB Resolution 2020 - 146: Adoption of Amendments and Revisions to the Official Map of
the Town of Ithaca
Whereas, Section 270 of New York Town Law authorizes the Town Board to establish an official
map of that part of the town outside the limits of any incorporated city or village showing the
streets, highways and parks theretofore laid out, and may also show drainage systems; and
Whereas, Section 273 of New York Town Law authorizes the Town Board to change or add to the
official map of the town so as to lay out new streets, highways, drainage systems or parks, after
first referring any such proposed changes or additions to the Planning Board for a report thereon;
and

Whereas, the current Official Map of the Town of Ithaca (Map) was last revised in 2019 and has
not been changed or amended since then; and
Whereas, the Town Planning Board reviewed the proposed changes to the Map at its meeting on
September 15, 2020, and recommended certain changes, and
Whereas, Town Staff have made said changes recommended by the Planning Board and presented
the Map to the Town Board on September 28, 2020, and
Whereas, a public hearing was duly called and held by the Town Board on November 9, 2020
regarding the proposed Map, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of the proposed Official Town Map is a Type II action because it constitutes "mapping
of existing roads, streets, highways, natural resources, land uses and ownership patterns," and thus
this action is not subject to review under SEQRA; now therefore be it
Resolved, that the Town Board of the Town of Ithaca hereby accepts and adopts the amendments
and revisions as shown on the Official Map of the Town of Ithaca, Dated November 3, 2020,
which version shall hereafter constitute the Official Map of the Town of Ithaca effective
immediately.

5. Public Hearing regarding the adoption of the New Neighborhood Code and related Town
Code Amendments
Mr. Howe opened the public hearing at 5:59 p.m. There was no one wishing to speak on the topic
and the Director of Code Enforcement noted for the record that there was no receipt of any
comments prior to or during the public hearing period via phone or email. The hearing was closed
at 6:00 p.m.
The Board discussed the process for SEQR evaluations during development of portions of the town
that may fall under this legislation. When would the environmental impact be discussed and
reviewed? How does the town avoid segmentation when a full build -out scenario, that will have
impacts, but doesn't happen at once, and may never happen.
Mr. Tasman explained that SEQR review would happen at the regulating plan or master plan stage
but there might be site-specific reviews as they come along. There is no real good answer to the
segmenting question.

For example, an area the Comprehensive Plan identifies as medium density TND; a regulating plan
for one property owner with an area of 200 acres is not a total build out scenario of that area. We
would only be looking at that 200 acres of development because we don't know when the rest of
that area will get built out.
Mr. Goodman added that there have been discussions of the three main areas; East Hill, South Hill
and West Hill. On East Hill, we assume Cornell will drive the planning process and be responsible
for the charrettes and the work there. On South Hill and West Hill, the Town can come up with a
regulating plan for an area; we don't have to wait for a landowner to decide to do something.
This is just the first phase of a long process. We have focused on South Hill because there has
been some interest in that area. We have talked about working on a charrette for South Hill and
drafting a regulating plan ourselves.
On West Hill, there are approximately 4 to 6 major landowners. We can get together with them
and ask them if now is a good time to start working on a charrette and a regulating plan for West
Hill.
The key is, we do not need to wait for a landowner to come to us. We are hoping to come up with
some charrettes and a regulating plan for the whole area on each hill to avoid segmentation.
Ms. Ritter added that for East Hill, it is likely that the whole area will be under one regulating plan
because there is really one property owner, so one regulating plan. On West Hill, we have several
property owners where one or more owners do not have any interest, at this point, in doing any
development on their land.
If we have one owner, that is easier, but if there are multiple owners, we may have to do the
regulating plan.
The Town could essentially be the applicant to propose a regulating plan for the greater area. The
other way the NNC allows for the regulating plan to happen is by application from a property
owner. The environmental review would only be on the area the application is for.
She went on to say that if we wanted to try to get everybody in the area together to do the entire
area that is possible, but there are procedures to allow for smaller areas to have established
regulating plans.
Mr. DePaolo asked if we have more flexibility in those areas because there's not a lot of build out
yet, but isn't it to our advantage to explore a more comprehensive regulating plan them rather than
waiting for things to come in to us in a more piecemeal fashion?
Ms. Ritter replied that she thinks it is more advantageous to think comprehensively and we can try
and pull property owners together to see if they want to participate.

This question was discussed at length at the committee level and the question of thresholds in
density that we didn't want to go above or transportation issues that would or should trigger
review(s).
Mr. Tasman expanded on scenarios and allocation of zones in the NNC and transects that would
control density goals. There is a preplanning process and if one area has a development request
that would max out a particular area, that would be discouraged, and the Board would have a
decision to make in the approval process. A charette is required at a certain size to encourage a
collaborative process and would involve all stakeholders, including the town. The SEQR issue is
a case-by-case basis and the Comprehensive Plan and the NNC will allow for some review.
Mr. Howe stated that there is a process in place with this, so it is not that we don't have it figured
out and he asked Ms. Brock to respond.
Ms. Brock said that this is just like any other request for rezoning, whether it is a TND or
conventional. Once an application comes in, that is when the review starts to determine what level
of environmental review is needed. Do we need a GEIS, or a site-specific process appropriate; it
depends on what comes in and is requested. Rezoning is always at the discretion of the Town
Board so the Town Board can always increase or decrease a level of review.
Mr. DePaolo said the question is are we going to take in to account previous requests as they
accumulate and it will be a accumulative analysis or are we going to look at them one by one as
we do now. We have a general idea of what we want and what is possible, but if we look at ten
20 -acre projects separately, is that as efficient as looking at a 200 -acre total build out scenario.
Ms. Brock responded that we always look at the existing background conditions so anything built
in a TND would become the new existing background and the impacts and implications will affect
the application and the review.
Mr. DePaolo responded that that then does benefit those who get there first because there will be
a lower baseline.
Ms. Brock responded that that is no different than what we do now; such as with services, say, that
is a capacity of a larger area than what may just be the instant application.
Mr. Goodman added that ultimately the Town Board is still in the driver's seat and will have the
ability to not allow a single developer to take up a large chunk of the baseline and say no, you have
to think larger or the Town itself can do a charette and control it even more.
The SEQR resolution was acted on.

environmental review with respect to the enactment of these local laws; and
Whereas, the Town Board, at its regular meeting held on November 9, 2020 has reviewed and
accepted as adequate the Full Environmental Assessment Form (EAF), Parts 1, 2 and 3, for this
action, prepared by the Town Planning staff; now, therefore, be it
Resolved, that the Town of Ithaca Town Board hereby makes a negative determination of
environmental significance in accordance with Article 8 of the Environmental Conservation Law,
6 NYCRR Part 617 New York State Environmental Quality Review, and Chapter 148
Environmental Quality Review of the Town of Ithaca Code for the above -referenced action as
proposed, based on the information in the EAF Part 1 and for the reasons set forth in the EAF Parts
2 and 3, and, therefore, a Draft Environmental Impact Statement will not be required.

Mr. Goodman thanked everyone who has been involved in this over the past 5 years, both staff
and consultants and highlighting Sue Ritter, Dan Tasman and Susan Brock. It is a little
anticlimactic, but this is just the first phase and it is exciting.
Mr. Moseley and Ms. Jordan noted that there were no comments, emails or attempts to contact the
Town during the public hearing to speak to this action.

272 to the Town of Ithaca Code, Titled "New Neighborhood Code"; Local Law 7 of 2020: A
Local Law Adding New Neighborhood Code References to Ithaca Town Code Chapter 270,
Zoning; and Local law 8 of 2020: A Local Law Adding New Neighborhood Code References
to Ithaca Town Code Chapter 234, Subdivision of Land
Whereas, the New Neighborhood Code (Chapter 272) is a form -based zoning and design code that
enables and guides the planning, zoning, platting, and building of new neighborhoods that take the
form of traditional neighborhood development (TND); and

Whereas, principles of TND include (1) a compact form, with a distinct center and edge; (2) a
mutually compatible mix of uses and building types; (3) residential, commercial and civic spaces
are within walking distance of each other; (4) a range of housing types, sizes, prices, and density
levels, that lends to a diversity of lifestyles, age groups, household types, and income levels among
residents; (5) parks, schools, and civic buildings at prominent and easily accessible locations, (6)
an interconnected network of streets, sidewalks, alleys, and paths, that disperses vehicle traffic,
makes walking and cycling safe and interesting, and allows different options for getting from one
place to another; (7) buildings facing the street or street -fronting open space; (8) high quality,
human -scaled architecture; (9) unobtrusive off-street parking; and (10) a strong sense of place and
identity; and
Whereas, the 2014 Town of Ithaca Comprehensive Plan recommends compact, mixed use
neighborhoods in the form of TND, in emerging growth areas close to major employers and
activity hubs; and
Whereas, the Comprehensive Plan calls for regulations that reflect current best practice in planning
and urban design to implement its recommendations and help achieve the Town's desired
development outcomes; and
Whereas, subdivision and zoning chapters of the Town Code (Chapters 234 and 270) were written
to implement planning policies of previous decades; so it is more practical for the Town Board to
adopt the New Neighborhood Code's form -based code in a new chapter and add New
Neighborhood Code references to Chapters 234 and 270 ; and
Whereas, at the June 12, 2017 Town Board meeting, a contract agreement was authorized with
consultants Randall West, in partnership with Better Cities and Towns and STREAM
Collaborative, for the purpose of assisting the Town in developing a form -based code; and
Whereas, a TND working group was convened, composed of two Town Board members, two
Planning Department staff and the consultants, for the purposes of developing the New
Neighborhood Code, a form -based code, to allow and regulate TND, based on Comprehensive
Plan goals, policies, and recommendations; and
Whereas, the TND working group met on a regular basis between 2017 and 2019, to review and
refine progressive draft sections of the New Neighborhood Code prepared by staff, with the goal
of developing a code tailored to the Town that follows best planning practice, and achieves the
desired development outcomes of the Comprehensive Plan; and
Whereas, throughout 2019 and the first half of 2020, meetings were held with stakeholders from
areas where the Town anticipates applying the code, and with members of the Code Enforcement
and Engineering Departments, to solicit comments about possible issues, and ways to improve
implementation, administration, and development outcomes; and
Whereas, in September 2019, a Town webpage devoted to the New Neighborhood Code went
online, with drafts of the code, information about TND and form -based zoning, answers to
frequently asked questions, and news of upcoming meetings and events; and

Whereas, at the October 1, 2019 Planning Board meeting, Planning staff gave a presentation on
the New Neighborhood Code, explained its features and development outcomes, answered
questions, and heard comments and suggestions and on November 19, 2019 the Planning Board
recommended that the Town of Ithaca adopt the proposed New Neighborhood Code; and
Whereas, on October 23, 2019, the town hosted a public meeting at Town Hall to introduce the
New Neighborhood Code to the general public, with a presentation and an opportunity for the
public to ask questions and offer comments and suggestions; and
Whereas, announcements and articles concerning the New Neighborhood Code appeared in the
Fall 2019 Town newsletter and local news media, with information about where to view and get
a copy of the most recent draft; and
Whereas, at Town Board meetings on June 8, 2020 and June 22, 2020 the board received an update
on the New Neighborhood Code with a presentation and an opportunity to discuss, ask questions
and offer suggestions on the proposal; and
Whereas, the Town Board of the Town of Ithaca scheduled a public hearing for November 9, 2020
at 5:30 p.m., to hear all interested parties on the proposed local laws entitled:
1) A Local Law Adding Chapter 272 to the Town of Ithaca Code, Titled "New
Neighborhood Code"; and
2) A Local Law Adding New Neighborhood Code References to Ithaca Town Code
Chapter 270, Zoning; and
3) A Local Law Adding New Neighborhood Code References to Ithaca Town Code
Chapter 234, Subdivision of Land, and
having postponed the originally scheduled date of October 19, 2020 in order to further refine the
New Neighborhood Code; and
Whereas, notice of the public hearing was duly advertised in the Ithaca Journal; and
Whereas, a public hearing was duly held on the date and time and all parties were permitted an
opportunity to speak on behalf of or in opposition to the proposed local laws, or any part of them;
and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, adoption of the local laws is a Type I Action for
which the Town Board of the Town of Ithaca, acting as lead agency in an environmental review
with respect to adoption of these local laws, has, on November 9, 2020, made a negative
determination of environmental significance, after having reviewed and accepted as adequate the
Full Environmental Assessment Form Parts 1, 2 and 3; and

Whereas, the Town Board finds that the amendments to the Town Code, and the type of
development it enables will further the health and welfare of the community and are in accordance
with the Comprehensive Plan; now therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby adopts the following:
Local Law 6 of 2020: A Local Law Adding Chapter 272 to the Town of Ithaca Code,
Titled "New Neighborhood Code"

6. Discuss and consider resolution of appreciation — Jon Meigs, Conservation Board
Mr. Howe noted that Mr. Meigs has been very active in the Town with the Scenic Resources, Coy
Glen Conservation Zone, Fischer award and even donated some land.
TB Resolution 2020 - 148: Resolution of Appreciation and Recognition of Service for
Jonathan Meigs
Whereas, Jonathan "Jon" Meigs was appointed to the Town of Ithaca Conservation Board in
February 1994; and
Whereas, Mr. Meigs resigned from said board on August 4, 2020; and
Whereas, Mr. Meigs has been a significant member of the board, who has devoted much personal
time and energy to Conservation Board projects, including serving on the Environmental Review
Committee, the Scenic Resources Committee (working on the Scenic Views Report, the top 10
views driving tour and brochure, and the scenic view signs), the Richard B. Fischer Environmental
Conservation Award Committee, and the Coy Glen Conservation Zone Committee (assisting in
researching and preparing a report for the Town Board for the new conservation zone); and
Whereas, Mr. Meigs also served on the City of Ithaca Natural Areas Commission for many years

8. Discuss and consider approval of UAW 2021-2023 Contract changes
Mr. DePaolo asked about Article 17 Wages, which read "will receive a minimum of..." and if
there should be a "maximum" also.
Ms. Drake responded that the language is carried over from the very first contract and back then
there was a minimum and a maximum.
Mr. DePaolo asked what dynamic could alter this; if the CPI goes through the roof, would this be
subject to renegotiation?
Ms. Drake replied that they would be locked in. There are things the employer can try to reopen,
such as recently with COVID-19, there were some areas of contracts that were reopened and that
is usually done by a memorandum of understanding (MOU.)
Mr. DePaolo asked about the Juneteenth holiday and Ms. Drake responded that that is coming up
tonight.
Mr. DePaolo asked about the increase in fringe time and Ms. Drake responded that that was to
bring it up to match the Town of Ithaca.
Ms. Hunter asked about vacation buyback increase and if that could be used for insurance and Ms.
Drake responded that it was increased because places such as Bolton Point where there is a small
staff and coverage would be an issue if vacation were to be used.
Ms. Brock suggested removing the word "minimum" for clarity.
Ms. Drake responded that this has been through all the levels and at this point she would hate to
do that now.

Ms. Brock responded that this is not a substantive change and could be made without having to
reopen or go back through all levels of the process. If this reflects the intent and the UAW agrees,
it can be done easily.
Mr. Goodman suggested to make sure we do it at the next negotiation because this has to go
through the other 5 municipalities, and it is onerous and not a change that will affect us.
Ms. Drake said she would reach out to the UAW and discuss it with them.
Mr. DePaolo asked about sick time where the maximum can be used to increase retirement levels
and if the difference between thresholds doesn't affect that.
Ms. Drake responded that it did not.
TB Resolution 2020 - 150: Approval of Collective Bargaining Agreement with the United
Auto Workers for Southern Cayuga Lake Intermunicipal Water Commission's Employees
for 2021-2023
Whereas, the Southern Cayuga Lake Intermunicipal Water Commission, in good faith, entered into
contract negotiations with the United Auto Workers union for a renewed collective bargaining
agreement for the contract that expired on December 31, 2020: and
Whereas, on October 28, 2020, the Commission's negotiating team reached tentative agreement
with the union's negotiating team; and
Whereas, on November 2, 2020, the employees in the union bargaining unit ratified the tentative
contract; and
Whereas, the Commission reviewed and approved the tentative contract at the November 5, 2020,
Commission meeting; and
Whereas, the Town of Ithaca Town Board has reviewed the tentative agreement and determined it
to be acceptable as required by the contract and the Public Employees Relation Board; now,
therefore, be it
Resolved, the Town of Ithaca Town Board does hereby approve the tentative collective bargaining
agreement between the Commission and UAW unit; and, be it further
Resolved, the Town of Ithaca Town Board authorizes the Commission's negotiating team to sign
said contract as presented.

9. Discuss and consider approval of the COVID Response policy
Ms. Drake summarized by saying that this is a compilation of the recent individual policies the
Board has approved as the need(s) arose and will change with any changes coming from the
Governor's Office.
Ms. Leary stated that the Governor is no longer issuing a list of high-risk states due to too many
hot spots. She had the following suggested changes:
• removing reference to high-risk state lists by the Governor
• changes for the wording in bullet one to "voluntary travel out of state" must self-report to
supervisor of such travel and are subject to quarantine restrictions as outlined on the NYS
Department of Health website
• the travel policy reference to being in contact with "sick" people should be changed to
"infected" people even if they are not symptomatic
• under safety policies, remove the word "cloth" and leave solely as "masks"
Mr. DePaolo had a couple of clarifying questions, saying, we are not then prohibiting cloth masks,
correct?
Ms. Leary responded yes, correct.
Mr. DePaolo then asked about the beginning of her statement, where she referenced travel to any
place other than an adjacent state.
Ms. Leary responded that she doesn't want to refer to a list that isn't there but instead send them
to the State website and that they have to report to their supervisor and abide by the website
guidelines.
Mr. DePaolo asked if he traveled to NYC then, he would not have to report?
Ms. Leary responded yes, that is correct because a trip to NYC would not be considered out-of-
state according to the Governor's current guidelines.
Mr. DePaolo wanted the resolution moved and seconded and then had a few typographical edits
and then more substantive; "In extreme circumstances, the town may return an employee with
confirmed COVID....." Who makes that determination?
Mr. Howe responded that he would think it would be him, Ms. Drake and Mr. Slater.
Ms. Drake suggested removing the word "extreme" because when and if this scenario happens, it
would be for critical staffing and we would be working closely with the County Health
Department. The Board agreed.
Mr. DePaolo continued to the travel policy, and the restrictions on returning to work and the
Supervisor having discretion to waive under certain circumstances.

Ms. Drake responded that this is under the current policy and we had a long discussion about it
then to allow for some discretion.
Mr. DePaolo turned to the ability to work from home or not and if quarantined and unable to work
from home, will not be paid. Are there any instances where travel would be deemed essential,
such as a funeral or family need (yes)... Then how does that square with compensation to people
who need to quarantine due to local exposure or exposure on the job?
Ms. Drake responded that there is a different procedure on that.... (inaudible)
Mr. DePaolo responded that this means that we have no idea if someone's high-risk behavior five
miles from town or from out of state travel and someone who has to travel, maybe for a very good
reason and with proper precautions, to another state has to quarantine for 2 weeks without pay, yet
someone can go to a friends house and get COVID or be contract traced to a positive COVID and
they will get paid for the same 2 week period? He thought that seemed a bit arbitrary to him.
People who may be careful won't get paid and those who engage in local high-risk will be paid.
Ms. Leary responded that this is in line with the Governor's travel guidelines. No other discussion.
TB Resolution 2020 - 151: Approval of COVID Response Policy
Whereas, the Town Board on March 30, 2020 approved of modified employment policies due to
the COVID-19 Pandemic from March 15, 2020 through June 8, 2020; and
Whereas, effective June 8, 2020, the Town Board established employment policies as facilities
began to open to the public and increasing the level of staff on site and to address travel
quarantines; and
Whereas, the Personnel & Organization committee reviewed the COVID Response Policy to
summarize previously adopted polices and established procedures in one document; and
Whereas, the Personnel and Organization Committee recommends the Town Board adopts the
COVID Response Policy; now, therefore, be it

I&I Study
Mr. Thaete gave a summary, stating that the original flow data was flawed so the contractor is
providing additional flow data at no cost. Also, the timing was bad as there was a huge water main

break on IC campus that skewed the data, so we are going to re -meter the campus which des incur
an additional cost and hence this contract.
TB Resolution 2020 - 152: Authorization to Sign an Amendment to the Infiltration and
Inflow Danby System Study
Whereas: Whereas, on October 21, 2019 the Town Board approved the 2020 Town Budget
(Resolution No 2019-152) that included $110,000 to fund a Danby Road Sewer Study and Code
Revisions, and
Whereas: On March 9, 2020 the Town Board Authorized to Award Contract (Resolution No 2020-
038) in the amount of $38,000 (Parts A) for the study made by the firm of Larson Design Group,
and
Whereas: On October 25, 2020 the Town requested additional sewer meters to be placed adjacent
to Ithaca College. Flow data collected during the original investigation corresponded with a
significant water main break on the Ithaca College campus; therefore, re -metering of this location
is required to collect accurate data, and
Whereas: On November 4, 2020 Larson Design Group provided a Design Change Order for this
additional service in the amount of $9000 ($4500 per meter location), now therefore be it
Resolved: that the Town Board of the Town of Ithaca authorizes the additional expenditure for the
re -metering required at the Ithaca College location as part of the Infiltration and Inflow Danby
System Study, and be it further

Architecture to continue providing professional services associated with the Inlet
Valley/Elmira Road corridor
Whereas, the Town Board authorized the Town Supervisor to execute a contract with Behan
Associates Landscape Architecture for the purpose of providing professional services to assist the
town in developing amended zoning regulations and design guidelines/standards for the Inlet
Valley/Elmira Road corridor, with a contract term from November 1, 2019 to August 31, 2020,
and at a cost not to exceed $25,000; and
Whereas, due in part to the Covid-19 pandemic, the project was paused for several months, but
there is still more work to be completed with the Economic Development Committee, including
stakeholder outreach meetings and continued work and refinement of a regulatory strategy;
therefore be it
Resolved, that the Town Board approves, authorizes and directs the Town Supervisor to execute a
supplemental agreement with Behan Associates Landscape Architecture to extend the contract
until August 31, 2021, utilizing the remaining funds allocated under the original agreement (from
account B8020.403) for continued professional services in support of developing zoning
regulations and design guidelines/standards for the Inlet Valley/Elmira Road corridor.

Mr. Howe noted that this took a while to resolve and get to this point and is detailed in the
resolution and has been discussed at many previous meetings.
TB Resolution 2020 - 154: Authorization for Supervisor to Sign an MOU with Cornell
University and the City of Ithaca Regarding Necessary Sewer Upgrades Associated with the
North Campus Residential Expansion Proiect.
Whereas, the Cornell North Campus Residential Expansion (NCRE) will be a large project in both
the Town and the City of Ithaca, and will impact the capacity of the existing jointly owned
Northside Sanitary Sewer Interceptor" ("NSSI"), and
Whereas, on June 18, 2019 the Town's Planning Board granted final site plan approval to NCRE,
such Resolution included a condition of Final Site Plan Approval that required completion and
operation of the required upgrades to the Jointly Owned (City and Town of Ithaca) NSSI prior to
issuance of any certificates of occupancy, and

Whereas, on June 25, 2019 the City's Planning and Development Board granted preliminary site
plan approval to NCRE, such Resolution included a condition of Final Site Plan Approval that
required a Memorandum of Understanding between the City and Cornell "to, at Cornell's sole
expense, replace and upgrade the Jointly Owned (City and Town of Ithaca) NSSI," and
Whereas, Cornell, the City, and the Town have determined that it is in the interest of public health,
safety and welfare for the City and Town to allow this work to be performed by Cornell at Cornell's
sole cost and expense, subject to the City's inspection and the City and Town's acceptance of any
such work performed and installations or improvements made, as a pre -requisite to connecting the
NCRE project to NSSI, and Cornell is willing to perform this work and deliver the finished and
accepted work to the City and Town as set forth within the MOU; now, therefore, be it

to sign an Agreement with Cornell University and the City of Ithaca for the necessary sewer

them and will update the Board next month.

■ 5 firefighters and 2 Assistant Fire Chiefs have retired this year. Three of the
vacancies have been filled, but 4 firefighter positions have not been filled due
to a hiring freeze.

promoted to Lieutenant to fill the vacancy caused by the previous
promotion.
There were 3 firefighters hired to February to 6113 firefighter vacancies.
Those three firefighters were furloughed for 1 month in May and returned
to work on June 1, 2020
C) Firefighter Injury Leave
There is 1 Fire Lieutenant who has been out for 23 months on injury leave,
and it is unknown when he will return
There is 1 Firefighter who was on injury leave but returned to work on Light
Duty.
2) Budget Report
a) A 2020 Budget: Budget Summary for January through September 30 is attached
to this memo.
b) The financial impact of the COVID-19 pandemic on the local economy has been a
great concern for local officials. To address the deficits caused by reduced sales
tax revenues, the City has taken steps to contain costs and have made adjustments
to the City's 2020 Operating Budget. Hiring Freezes have been imposed, and
spending has been restricted.
Operational Changes in Response to COVID-10 Pandemic:
a) Under the Mayor's directive, like all City buildings, fire stations are currently closed
to the public to help limit the spread of COVID-19. Though not taking visitors, each
station continues to be fully staffed with firefighters 24 hours a day, 7 days a week.

b> Firefighters were working 24-hour shifts from April 6 through July 24 to limit the
amount of interaction between groups and to keep everyone healthy and able to
respond to true emergencies. They have returned to their previous work schedule.
c) Twice daily temperature checks on all firefighters on duty, as well as constant station
and equipment cleaning to compliment the hand washing and social distancing that all
have been practicing.
d) The Fire Prevention Bureau suspended inspections of existing occupancies and
extended operating permits for 6 months. While Code Enforcement activities have
been deemed by Governor Cuomo's Orders as essential work, the Fire Prevention
Bureau limited its activities to new construction and fire protection system
inspections. The Fire Prevention Bureau restarted inspection of existing occupancies
under modified procedures that permit inspections with social distancing and face
coverings being worn..
e) Emergency medical responses were limited to immediate life-threatening injuries or
conditions, serious calls that are ranked D, and E in the dispatch system. These
include chest pain, respiratory distress, and other life-threatening emergencies. The
fire department is not responding unless requested to assist the ambulance to any A,
B, or C, lower priority calls. The modified protocols have been reviewed the
department has returned to emergency responses to serious, but less life-threatening
call, that include calls classified as lower B and C call severity classifications.
All steps taken are to ensure compliance with new guidelines handed down by the
State Department of Health Bureau of EMS and are being enacted by counties across
New York. These steps will help limit firefighters' exposure and ration valuable
personal protective equipment (PPE).
4) Grants and Donations
a) In 2019, we received a FEMA AFG grant to replace the Diesel Exhaust Extraction
Systems in each of the four fire stations. The installations will begin the first
week in November.
b) This year, we have submitted three FEMA grant applications

funding of 8 firefighter positions. We were not awarded funding for this
grant.
b. FEMA Assistant for Firefighting grant to fund replacement rescue
equipment. In September, we were awarded $36,981 in federal funding

fund Personal Protection Equipment for Firefighters. In August, we were
awarded $5,927 in federal funding.

b) One Aerial Platform Truck was purchased in October of 2019 and will be
delivered on October 26, of 2020
C) One Pumper Truck was purchased in January and will be delivered in January of
2021.
