I am writing in response to your inquiry regarding the effort to correct the survey for 249 Coddington
Road (Tax Parcel No. 54-7-40) and 255 Coddington Road (Tax Parcel No. 53-1-1) and your question
as to whether the proposal would require any approvals from the Town of Ithaca.
I have reviewed the information that you have provided to me, including a description of the survey
deficiencies and the proposed manner that the error would be resolved --through an agreement
between the two property owners resulting in a relatively minor lot line shift to the north
(approximately 7 feet at the street line and narrowing to a sliver toward the back (east) portion of the
property). Based on this information provided, I would classify this proposal as a survey correction
which will not require any approvals from the Town of Ithaca.
Please be aware, however, that in 2005, when a building permit was issued for 255 Coddington
Road, the survey for the parcel indicated the lot was 0.38 acres in size. On December 12, 2007, two
years after the building permit was issued, the Tompkins County Assessment Department issued a
Notice of Tax Map Revision for this property which resulted in a decrease in the lot size to 0.29
acres. According to the Town of Ithaca Code, the minimum required lot size for this parcel, located
in the Medium Density Zone, is 0.34 acres (15,000 square feet). Because of the lot size deficiencies,
this property is now considered "non -conforming" and any future building permits for this property
will require a variance, given the non -conforming nature of the lot.
The proposed survey correction will worsen the non -conforming nature of the lot, but only slightly
so. The correction does not appear to impact any other lot area requirements of the Medium Density
Zone pertaining to the street line width, front yard width or depth.
