Mr. Howe called the meeting to order at 5:35 p.m.

TB Resolution 2020 - 117: Adoption of the 2020 Assessment Rolls for Special Benefit
Districts and Special Benefit Areas for Tax Year 2021
Whereas, the Town Board of the Town of Ithaca held a properly advertised public hearing at the
Town Hall, 215 North Tioga Street, Ithaca, New York, on the 14th day of September 2020, to
consider the 2020 Assessment Rolls for Special Benefit Districts and Special Benefit Areas for the
Town of Ithaca for Tax Year 2021; now, therefore, be it
Resolved, the governing Town Board of the Town of Ithaca hereby approves and adopts the 2020
Assessment Rolls for the Special Benefit Districts and Special Benefit Areas of the Town of Ithaca
for Tax Year 2021 as follows:
Fire Protection District: Assessed Value - $1,291,611,686.00
Forest Home Light District: Assessed Value - $41,729,600.00
Glenside Light District: Assessed Value - $5,115,100.00
Renwick Heights Light District: Assessed Value - $14,474,600.00

Mr. Howe opened the public hearing at 5:38 p.m.; there was no one wishing to address the board
and the hearing was closed.
TB Resolution 2020 - 118: Approval of the Southern Cayu2a Lake Intermunicipal Water
Commission 2021 Budget (Bolton Point)
Whereas the Southern Cayuga Lake Intermunicipal Water Commission 2021 Preliminary Budget
has been approved by the Commission and a public hearing dutifully held by the Town of Ithaca
on September 14, 2020, now therefore be it
Resolved that the Town Board approves the Southern Cayuga Lake Intermunicipal Water
Commission 2021 Budget as submitted.

Mr. Howe opened the public hearing at 5:39 p.m.; there was no one wishing to address the board
and the hearing was closed.
The draft resolution was moved and seconded for discussion. The Board discussed Ms. Brock's
question regarding whether the Board would like to transition to using gender -neutral pronouns
since this is a complete revision of a chapter.
Mr. DePaolo asked for her suggested change.
Ms. Brock suggested "their" for both singular and plural, saying this is the most common practice
now.

Mr. DePaolo asked if the intent would be to revise all our laws and Ms. Brock responded that the
question came to mind because this was a complete revision and the transition could happen over
time.
Discussion followed and the board was in favor of making the change to "their." There was some
concern about confusion regarding singular and plural interpretations, but the board was in favor
of moving to a gender-nuetral pronoun of "their."
The change was accepted by the mover and the seconder.
TB Resolution 2020 - 119: Adopt Local Law 4 of 2020: A Local Law Comprehensively
Revising Town of Ithaca Code Chapter 125, `Building Construction and Fire Prevention,"
Adding Dangerous or Unsafe Buildings, Structures and Equipment Provisions to Chapter
125, and Deleting Chapter 129, `Buildings, Unsafe"
Whereas the Town's Codes and Ordinances Committee has reviewed, revised and recommended
changes to incorporate current Town of Ithaca Code Chapter 129 relative regulations into current
Chapter 125 regulations and revised and updated Chapter 125 to reflect current Town and State
requirements, and
Whereas the Town Board scheduled and held a duly publicized public hearing on September 14,
2020, at which time all persons/parties had an opportunity to speak or submit comments on behalf
of or in opposition to the proposed local law, and
Whereas pursuant to the New York State Environmental Quality Review Act (SEQRA) and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of this local law is a Type 2 action because it constitutes "routine or continuing agency
administration and management" and "adoption of regulations, policies, procedures and local
legislative decisions in connection with any action on the Type 2 list" and thus is not subject to
review; now therefore be it
Resolved that the Town Board hereby adopts Local Law 4 of 2020: A Local Law
Comprehensively Revising Town of Ithaca Code Chapter 125, `Building Construction and Fire
Prevention," Adding Dangerous or Unsafe Buildings, Structures and Equipment Provisions to
Chapter 125, and Deleting Chapter 129, `Buildings, Unsafe", and
The Town Clerk is hereby authorized to file said local law with the Secretary of State as required
by law.

d. Consideration of a waiver/reduction in the fee for a Temporary Certificate of
Occupancy for 104 Grove PI

Mr. Howe opened the public hearing at 5:51 p.m.; there was no one wishing to address the board
and the hearing was closed.
The draft resolution was moved and seconded for discussion.
Mr. Howe noted that the reduction of $500 was discussed at the last meeting, bringing the fee from
$1,200 to $600.
The Board discussed the balancing criteria and drafted the findings for the requested reduction.
The majority of the board felt that the hardships listed in the letter were clear and valid, especially
given the COVID related Pause and delays in construction and materials, and referenced the letter
in the resolution as the basis of the findings.
There was some concern expressed regarding the subjectiveness of this regulation and that should
possibly be looked at.
TB Resolution 2020 - 120: Consideration of a Waiver/Reduction in fee for a Temporary
Certificate of Occupancy at 104 Grove PI
Whereas the Town Board received a request for a waiver from the fee for a Temporary Certificate
of Occupancy (TCO) from the owners of 104 Grove PI as outlined in Town of Ithaca Code, Chapter
125, Section 7.13(9)(a)(2), and
Whereas the Town Board discussed the request at their August 10, 2020 meeting and scheduled a
public hearing as required by the Town of Ithaca Code stated above, and
Whereas the Town Board held said public hearing on September 14, 2020 to hear comments
regarding the request, now therefore be it
Resolved that the Town Board does hereby reduce the fee for the Temporary Certificate of
Occupancy (TCO) from $1,100 to $600
With the following
Findings:
1. That the fee for the original building permit was not sufficient to cover the costs to the
Town and a reduction of $500.00 is granted to cover the costs to the Town, and
2. That the payment of the fee would be a significant hardship for the reasons stated in the
applicants' letter/request dated August 3, 2020, and

3. That the need for the TCO was not created by a lack of diligence by the applicant, but
rather the difficulty(s) imposed by the restrictions on construction activities by COVID-19
and NYS Executive Orders concerning the ability to work in many fields and industries
and the subsequent delays in obtaining materials, and
4. That the reduction in fee to $600.00 is the minimum necessary to alleviate the hardship and
cover the costs to the Town, and
5. That all other conditions for the issuance of a TCO asset forth in Town Code 125-713 have
been met

4. Consider setting a public hearing regarding adoption of the New Neighborhood Code
(NNC)
Ms. Ritter stated that the NNC has been on the website with its own webpage for over a year with
a lot of information, background material and educational material on form -based codes and
traditional neighborhood development. The Town also held community meetings, publicized its
realease to all media outlets and an article was in the Ithaca Voice. Through all of that, we have
had very little comment on the NNC other than a concern about an existing, non -conforming
building or development and we have added a new section to address that issue.
TB Resolution 2020 - 121: Setting a public hearing regarding the adoption of the New
Neighborhood Code and related Town Code amendments
Resolved, that the Town Board of the Town of Ithaca will hold a public hearing at 5:30 p.m. at the
Town Hall, 215 North Tioga Street, Ithaca, New York on the 19'h day of October 2020 and, if
necessary, via the ZOOM video and audio conferencing platform per Governor Cuomo's Executive
Order(s) and Extension(s) regarding health & safety efforts associated with COVID-19, for the
purpose of considering the adoption of the New Neighborhood Code and related Town Code
amendments, and be it further
Resolved, that at such time and place all persons interested in the proposed local law will be heard
concerning the same.

5. Consider authorization for Supervisor to sign a revised and extended lease agreement
with Tompkins County History Center

The draft resolution was moved and seconded for discussion.
Mr. Howe noted that the lease expired the end of August, and this is the same with the only changes
being a 5-year term and increasing the rent in increments if wanted.
The action is also subject to the Permissive Referendum process, and that was added to the draft
resolution.
Mr. DePaolo suggested removing the first whereas referencing COVID-19 and the correlation and
that whereas was removed.
Mr. DePaolo said his larger concern is whether or not we would need that space in 5 years.
Ms. Drake responded that the Consortium does intend to need more space, and they will be looking
at where the Engineers are now.
Mr. Howe responded that the space the Center is using is really only good for storage, not office
space.
Ms. Hunter asked about the portion of the building being rented and Mr. Howe responded that it
is the former archival room and three bays of the inactive storage room as well as areas of the
depths of the building, beyond the breakroom.
Ms. Hunter asked if the records sitting out in the hallway in the basement have been addressed and
she thought they should be in the archival room due to it's temperature and moisture control.
Mr. Howe said the Records Management Advisory Board is meeting soon, but he thought there
was still room in the archival room for the older records and asked Ms. Rosa to explain.
Ms. Rosa stated that the very old records are still in the archival room, the building permits are
still in the lobby. The new retention schedule from the State came out and will be discussed at the
RMAB. The 100%, word by word verification requirements that were a stumbling block the last
time disposing of scanned records was discussed has been clarified to each page, but there is a
different requirement for scanning "vendors" which Challenge and the County meet.
Ms. Hunter asked about funds from State grants that were received and the legality of not using
the archival rooms any longer.
Ms. Brock responded that the grant conditions should be reviewed and Ms. Drake added that the
grant was in 1999 and 200 and was for the shelving, not the rooms themselves.
Ms. Rosa stated that she would review the grants and report at the RMAB meeting and at the Town
Board meeting.

Mr. Levine stated that he would like to see a clause added to allow for canceling the lease upon 3
or 6 months notice because 5 years is a long time to tie up the use of the rooms in case the Town
did need the room or decided to sell the building.
Mr. Levine moved to add a 6-month cancellation clause to the lease, seconded by Mr. DePaolo.
Mr. Howe added that instead of a cancellation clause, an option would be to reduce the term to 3
years because he couldn't imagine doing the steps and planning that would be necessary to sell the
building or use the space. He suggested that change to the resolution and lease.
Mr. Levine and Mr. DePaolo responded that they would be in favor of reducing the term of the
lease instead of adding a cancellation clause.
Mr. Goodman began to address the space and his connection was lost. When he returned, Mr.
Howe explained that the members had discussed reducing the term of the lease rather than a
cancelation clause.
Mr. Goodman said he didn't think there is a space issue and agreed with the reduction in term.
Mr. Levine withdrew his motion to add a cancelation clause.
Mr. Goodman and Ms. Bleiwas agreed to the changes to remove the first whereas and change the
term to three years.
Mr. Howe noted that the permissive referendum period will run for 30 days and if no petitions
against are received, it will then be signed.
TB Resolution 2020 - 122: Authorization for Supervisor to sign a revised lease agreement
with the Tompkins County History Center; subject to permissive referendum
Whereas the Tompkins County History Center (Center) has a current lease with the Town of Ithaca
that is renewable yearly and expires each year on August 31 ", and
Whereas a revised lease, with the single significant change being the term of the lease from yearly
to 3-years, with a review and option for the Town to increase the rent by up to 6% occurring in
August of 2022, is proposed, now therefore be it
Resolved that the Town Board authorizes the Town Supervisor to execute the revised lease
agreement as described, subject to a permissive referendum in the manner provided in Town Law
Article 7.

6. Presentation of Highway Superintendent's Equipment and Machinery Report
Mr. Slater stated that this is an annual requirement from the Superintendent listing vehicles and
equipment. (Attachment 1)
7. Resolution Urging the Tompkins County Legislature to Call Upon New York State to
Allocate Funding to Local Municipalities to Support the Provision of Rural
Emergency Medical Services (EMS)
TB Resolution 2020 -123: Resolution Urging the Tompkins County Legislature to Call Upon
New York State to Allocate Funding to Local Municipalities to Support the Provision of
Rural Emergency Medical Services (EMS)
Whereas, volunteer Fire services and Emergency Medical Services (EMS) in rural New York State
have been under pressure for many years - ongoing declining volunteerism rates which leads to
the closure of departments, which leads to the expansion of coverage areas for nearby agencies,
which themselves struggle with staffing - in an environment of ever-increasing costs, and
Whereas, efforts to increase volunteerism, particularly in EMS, while noble, are neither sustainable
nor effective enough to make a meaningful impact, and
Whereas, as a result of these circumstances, many municipalities have been forced to implement
paid EMS Departments, contract for services with other paid departments, or do without timely
EMS coverage for their residents, and
Whereas, the ongoing Covid-19 pandemic has highlighted the critical nature of EMS, particularly
in rural areas where EMS response is the primary source of frontline emergency healthcare to
millions of New York residents, and
Whereas, as a subset of the healthcare field, annual EMS cost increases strain the budgets of rural
towns and villages who are nevertheless morally and ethically obligated to provide these services
to their constituents, and
Whereas, Article XVII §3 of the New York State Constitution states that, "The protection and
promotion of the health of the inhabitants of the state are matters ofpublic concern andprovision
therefore shall be made by the state and by such of its subdivisions and in such manner, and bV
such means as the le,-islature shall from time to time determine. " (emphasis added), and
Whereas the Tompkins County Council of Governments (TCCOG) requests the Tompkins County
Legislature call upon New York State to allocate funding to local municipalities to support the
provision of rural EMS, and
Whereas the TCCOG has requested that the Tompkins County Legislature advocate for a
Consolidated Local Street and Highway Improvement Program (CHIPS) or State Operating
Assistance (STOA) model of funding wherein funds will be allocated to municipalities using

formulae which takes into account call volume, coverage area, and funding needs, now, therefore
be it
Resolved, that the Ithaca Town Board supports the request from TCCOG to the Tompkins County
Legislature to call upon New York State to allocate funding to local municipalities to support the
provision of rural Emergency Medical Services (EMS), and be it further
Resolved, that the Town Clerk is directed to forward this resolution to New York State Legislators.

8. Discuss and consider naming of the various preserves on Culver Road the Culver
Road Preserve with sub -areas retaining their names
Ms. Ritter said this thought was prompted by a grant application for the preserve and simplifying
the naming.
TB Resolution 2020 — 124: Rename Dress Woods Preserve, Gerda Knegtman's Glen
Preserve, Marcia's Woods Preserve, and the recently acquired Babcock lands as the "Culver
Road Preserve"
Whereas, in February 2006, the Town of Ithaca purchased "Dress Woods Preserve"
(approximately 12 acres) on Culver Road, and
Whereas, in October 2012, the Town of Ithaca purchased "Gerda Knegtman's Glen Preserve"
(approximately 11 acres) on Culver Road, and
Whereas, in May 2016, the Town of Ithaca purchased "Marcia's Woods Preserve" (approximately
59 acres) on Culver and Bostwick Roads, and
Whereas, in June 2018 and December 2019, the Town of Ithaca purchased two parcels on Culver
Road from the Finger Lakes Land Trust for an additional preserve (totaling approximately 74
acres), which has not been officially named, and
Whereas, all of these properties are adjacent to each other and the Town of Ithaca now wishes to
manage these 156 acres as one contiguous preserve; now therefore be it
Resolved, that the Town Board hereby designates that the overall name of these 156 acres (Tax
Parcel No.'s 32.-1-7, 32.-1-9, 31.-6-1.22, 31.-6-1.23, 31.-1-14.2, and 31.-1-14.4) shall be the
"Culver Road Preserve", and be it further
Resolved, that the Town Board hereby designates the names of the subareas of the "Culver Road
Preserve", which will maintain the original intent of their naming, as "Dress Woods", "Gerda
Knegtman's Glen", "Marcia's Woods" and "Babcock Ridge".

9. Consider a Resolution of Appreciation — Lisa Carrier-Titti
Mr. Howe reported to the Board that this was read at the training and appreciation event on Friday
and present to Ms. Carrier-Titti. He read portions of the resolution for the board.
TB Resolution 2020-125: Recognition of Lisa Carrier-Titti's Dedicated Years of Service
Whereas, Lisa Carrier-Titti started her career at the Town of Ithaca on September 14, 1998, as the
pioneer Network/Records Specialist; she brought her education, years of experience in the
administration of medical records and her great desire to learn, implement and work more with
computer networks, and
Whereas, Records Management was an integral part of the first decade of Lisa's career with the
town; she worked collaboratively with the Town Clerks' Department in applying and procuring
several records management grants, the largest of which included the placement of archival -
quality, temperature and moisture controlled vault for historical records and a secondary records
storage room located at the current Town Hall, and
Whereas, Lisa started with a town that had a small number of computers, limited internet access
and a makeshift network system. With the move to the current Town Hall in 2000 and renovations
to the Public Works Facility in 2003, Lisa has been able to upgrade the network to include over
130 devices with unlimited internet access, a VOIP caller system, and has migrated all users to
Office 365; Lisa was persistent in expanding her knowledge and skills to make sure all the
departments and facilities had access to up-to-the-minute technology, and
Whereas, through Lisa's determination and leadership, fiber optic was laid to enable both Town
facilities to easily and efficiently share data and documents, and she integrated a fiber connection
to Tompkins County to allow for a digital archival system integration that brought significant
improvements and efficiencies to all Town staff and greatly benefited town residents, and
Whereas, during the COVID pandemic, Lisa worked tirelessly in assisting Town staff and was
instrumental in enabling the transition to allow for remote work with no advance notice, by making
quick and effective decisions and providing support even if it meant driving to an employee's
house to help configure routers so they could VPN into the Town's network system, and
Whereas, after twenty-two (22) years and one day of dedicated and devoted service to our
community, Lisa has chosen to retire from the Town of Ithaca, effective September 16, 2020, now,
therefore, be it
