KENNETH POYER, of 206 Dubois Road, Ithaca, New York,14850 (herein, "the party of the first
part"), and
the TOWN OF ITHACA, a municipal corporation organized under the laws of the State of New
York, with offices at 215 North Tioga Street, Ithaca, New York 14850 (herein, "the party of the
second part").
Witnesseth, that the party of the first part, in consideration of One and 00/100 Dollar ($1.00)
lawful money of the United States, and other good and valuable consideration paid by the party
of the second part, does hereby forever grant and release unto the party of the second part, its
heirs, successors and assigns, ALL THAT TRACT OR PARCEL OF LAND, situate in the
Town of Ithaca, Tompkins County, New York, bounded and described as follows:
BEGINNING at a point demarking the intersection of the centerlines of Dubois Road
Orchard Hill Road; proceeding South 14' 59' 50" East along the centerline of said Dubois F
150.46' to a point; then proceeding southwesterly along a line South 75° 00' 10" West to a F
upon the northerly highway boundary of said Dubois Road, said point being the true point
place of beginning;
THENCE South 75' 00' 10" West a distance of 367.45' to a point of curvature;
THENCE turning northerly (right) as depicted upon the Poyer Subdivision Plat Map (as furt
described below) 90° along a circle with a radius of 110' to a point (an arc distance
approximately 172.79');
THENCE North 14° 59' 50" West a distance of 105' to a point in the southerly properly line
Lot 8 as depicted upon said Poyer Subdivision Plat Map;
THENCE South 75' 00' 10" West a distance of 238.63' to a point in the easterly property line
lands now or formerly of Burrell (R.O.);
THENCE South 19° 14' 17" East a distance of 20' along such eastern property line of Burrell;
THENCE North 75' 00' 10" East a distance of 110' to a point;

THENCE turning easterly (left) as depicted upon said Poyer Subdivision Plat Map 90° along
circle with a radius of 130' to a point (an arc distance of approximately 204.20');
THENCE North 75° 00' 10" East a distance of 367.45' to a point in the northerly highway line

THENCE North 14' 59' 50" West along said northerly highway line of Dubois Road to the

BEING the same walking trail as depicted upon the Poyer Subdivision Plat Map (entitl
"Poyer Subdivision, Town of Ithaca, Tompkins Co., N.Y. State, Tax Map Parcel 22-01-01.2, De
Ref. 449/344) as drawn by John S. MacNeill, Jr. PC, R. James Stockwin, L.S., as dated 9/13/
(Job No. 9202-011).
BEING the purpose of this deed to convey said premises for dedication to the party of ,
second part of a 20' wide walking trail running northerly from Dubois Road to lands now
formerly of Burrell (R.O.).
Together with the appurtenances, and all the estate and rights of the party of the first part in and
to said premises.
To Have and to Hold the premises herein granted unto the parties of the second part, its heirs,
successors and assigns forever.
And the party of the first part does covenant as follows:
FIRST, that the parties of the second part shall quietly enjoy the said premises;
SECOND, that said party of the first part will forever WARRANT the title to said premises.
THIRD, that, in compliance with Sec. 13 of the Lien Law, the grantor will receive
consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
