Witnesseth, that the party of the first part, in consideration of One and 00/100 Dollar ($1.00) lawful money of the United States, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, its heirs, successors and assigns forever: ALL THAT TRACT OR PARCEL OF LAND bounded and described as follows: Beginning at a point marked by an iron pipe in the northerly line of Woolf Lane, which point is also the northwesterly corner of Lot 13 upon a subdivision plat and survey map entitled "WESTWOOD HILLS RESIDENTIAL SUBDIVISION, TIM CIASCHI - DEVELOPER, FINAL PLAT - PHASE ONE, TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK" dated September 11, 1987, revised September 24, 1987, further revised September 28, 1987, and further revised November 5, 1987 by T.G. Jordan, Jr. (422/243); THENCE South 00 degrees 05 minutes East 25.53 feet to an existing pipe, said pipe being in the northerly line of property now or formerly of Woloszyn (698/49); THENCE North 78 degrees 28 minutes West 497.78 feet to an existing pipe, said pipe being also in the northerly property of land now or formerly of Van Der Hye (52974/9002); THENCE North 36 degrees 40 minutes West 37.52 feet to a point, being the point and place of beginning, containing in all approximately 0.292 acres as shown upon the Merritt Map, and as also shown upon a certain map filed in the Tompkins County Clerk's Office at Drawer CC, .Map Number 113 (pertaining to the transfer of the lands of the Merritt Subdivision from Grantor Timothy Ciaschi herein to Sydney Merritt and Joyce W. Merritt, husband and wife, by instrument dated August 4,1995 and filed August 8,1995 in the Tompkins County Clerk's Office at Liber 755, Page 163). BEING THE PURPOSES OF THIS DEED to dedicate the described premises in perpetuity to the Town of Ithaca as a Greenway and access way to Town parklands, and as a walkway to and from said parklands. BEING a further purposes of this transfer to dedicate such land for the fulfillment of obligations pertaining to the creation of the Westwood Hills Residential Subdivision, therein 'u`Lp-p icted or described as open space (See Ciaschi Map, also filed at Map Drawer LL, Sheet 48 (as filed 8/16/99) and Map Drawer LL, Sheet 148 (as filed 12/28/00)). Being also known and identified as Town of Ithaca Tax Parcel Number 23.-1-11.136. All together with the appurtenances thereof and therein, together with all of the tittle, interests, estate, and rights of the party of the first part in and to said premises. And the party of the first part does warrant, promise, represent, covenant and agree that no liens or mortgages exist upon the said described parcel. To Have and to Hold the premises herein granted unto the party of the second part, its heirs, successors and assigns forever. And the party of the first part does covenants as follows: FIRST, that the party of the second part shall quietly enjoy the said premises; SECOND, that said party of the first part will forever WARRANT the title to said premises. THIRD, that, in compliance with Sec.13 of the Lien Law, the grantor will receive consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
