WHEREAS, the Grantors are the owners of real property known as 249 Pennsylvania Avenue in said Town of Ithaca and designated as Ithaca Land Company Lots 76, 77 and 78, which properties are further designated as Town of Ithaca, Tax Parcel #54.-6-1 (the "Premises"). Said premises were conveyed to the Grantors as Parcel II in a deed from Leo V. Rosica dated May 12, 1995 and recorded in the Tompkins County Clerk's Office on May 12, 1995 in Liber 749 of Deeds at page 268, said Premises are described as Parcel 1 on the attached Schedule A. AND, WHEREAS, there is a single family home currently existing on said Parcel 1; AND, WHEREAS, the Grantors are the owners of an unimproved parcel of land designated as Ithaca Land Company Lot 75 and a part of Lot 74 and further designated as Town of Ithaca, Tax parcel #54.-6-3. Said property was conveyed to the Grantors by deed of L. Edward Ruggles and Beverly M. Ruggles recorded September 27, 2000 in the Tompkins County Clerk's Office in Liber 887 of Deeds at page 287. Said property is described as Parcel 2 on the attached Schedule A. AND, WHEREAS, both Premises hereinafter shall be called "the Premises" and are situated in a R-9 Zone under the current Town of Ithaca Zoning Ordinance; NOW, THEREFORE, in consideration of the grant of a Special Approval by the Town of Ithaca Board of Zoning Appeals on January 28, 2002 to occupy a one family dwelling at 249 Pennsylvania Avenue by six (6) unrelated persons, no other consideration herefor being given or intended, the Grantors do hereby impose upon the Premises described herein on Schedule A, RESTRICTIVE COVENANTS to run with the land until such time, if ever, that the Town of Ithaca or one of its duly authorized Boards or Agencies shall by written instrument or order release the same as follows: 1. No building or improvement shall be constructed upon the Premises described as Parcel Z in the attached Schedule A without the express written approval of the Town of Ithaca, with the intention being that if the building on Parcel 1 in the attached Schedule A should ever permanently cease to be occupied by more than three (3) unrelated persons, the Town of Ithaca would consider releasing these restrictive covenants. 2. The Grantors shall provide six (6) off street parking spaces on these premises to the occupants thereof. 3. The Grantors will immediately seek a consolidation of these two parcels to become one tax parcel.
