RESOLVED that this Board grants the appeal of Larry Caskey, requesting variances from the requirements of Chapter 270, Article IX, Section 270-71c and 270-73d of the Town of Ithaca code to be.permitted to maintain a residence with insufficient lot depth and side yard setback at tax parcel number 72.-1-31, medium density residential zone With the findings that the requirements for an area variance have been satisfied: Specifically that the benefit that the applicant seeks, which is to be able to legally maintain and sell his home cannot feasibly be achieved by any other means, 2. That there will be no undesirable change in the neighborhood given that the property has been in existence in its present form for approximately 8 years, 3. That the requested variance is not substantial, there will be no physical or environmental affects, and 4. That while the alleged difficulty was self-created, nevertheless, that the benefit to the applicant does outweigh any detriment to the community. With the following conditions: That the rear yard depth be no less than 148 feet and that the side yard setback be no less than 11 feet, and 2.
