AGENDA ITEM NO. 14 - CONSIDER RENEWAL OF AGREEMENT WITH TOMPKINS COUNTY TO ASSIST IN PARTIAL COVERING OF THE COST OF TRANSIT AND HEALTH AND HUMAN SERVICES PROGRAMS: The Town Board had a brief discussion on the contract agreement with Tompkins County. The Town Board had concerns about the money being expended for these programs and the amount to be reimbursed back to the Town. The Town has discussed this several times with the County and the City. RESOLUTION NO. 8: Motion made by Councilman Conley, seconded by Councilwoman Russell that the Town Board of the Town of Ithaca hereby authorizes and directs the Town Supervisor to execute the 1998 Agreement with Tompkins County Transit and Health and Human Services Programs. A vote on the resolution resulted as follows: Supervisor Valentino, aye; Councilwoman Grigorov, aye; Councilman Klein, aye; Councilwoman Harrison, aye; Councilman Conley, aye; Councilwoman Russell, aye. AGENDA ITEM NO. 15 - CONSIDER DESIGNATION OF DELEGATES TO THE ASSOCIATION OF TOWNS OF THE STATE OF NEW YORK 1998 TRAINING SCHOOL & ANNUAL MEETING: RESOLUTION NO. 9: Motion made by Councilman Klein, seconded by Councilman Conley that the governing Town Board of the Town of Ithaca hereby appoints Catherine Valentino, Town Supervisor as the Official Delegate; and Carolyn Grigorov, Councilwoman as Altemate Delegate on behalf of the Town of Ithaca at the NYS Association of Towns Annual Meeting. A vote on the resolution resulted as follows: Supervisor Valentino, aye; Councilwoman Grigorov, aye; Councilman Klein, aye; Councilwoman Harrison, aye; Councilman Conley, aye, Councilwoman Russell, aye. AGENDA ITEM NO. 16 - CONSIDER RESOLUTIONS TO BE CONSIDERED AT THE ASSOCIATION OF TOWNS OF THE STATE OF NEW YORK 1998 TRAINING SCHOOL & ANNUAL MEETING: This agenda item will be deferred until the February Town Board Meeting. AGENDA ITEM NO. 17 - CONSIDER ABANDONMENT OF WILLIAMS GLEN ROAD AS A TOWN ROAD: Councilman Klein - Did the Town ever own this land? Attorney Barney - As far as I can tell this land was never conveyed to the Town. There were old deeds that made reference to it as a street back in the 1920's. Just to eliminate any possible question that there might be some right to the Town of Ithaca the thought was to abandon the road. Superintendent Noteboom - I agree that the Town should abandon Williams Glen Road. TOWN BOARD MEETING JANUARY 12,1998 APPROVED - FEBRUARY 9,1998 Councilwoman Russell - In other discussions about abandoned roads, such as a portion of Judd 'ra' lls Road, it was clear that the adjoining landowners had to consent to the abandonment of the 'road. Doesn't that apply here? Attorney Barney - That is when there is a user, and Williams Glen Road does not have a user. The Town can abandon any claim to this road and then it will be up to the landowners to work out. Superintendent Noteboom and the Town Board Members signed an official agreement to file in the Town Clerk's office for the abandonment of Williams Glen Road. AGENDA ITEM NO. 18 - CONSIDER AMENDMENT TO RETIREE HEALTH INSURANCE PORTION OF THE PERSONNEL MANUAL: Supervisor Valentino - Attorney Barney provided the Town Board with information on the Personnel Manual. The Personnel Manual, at the present time, is adequate under the law regarding the retiree health insurance benefits. AGENDA ITEM NO. 19 - SET PUBLIC HEARING DATE TO CONSIDER AMENDING LOCAL LAW NO. 1 - 1996, A "LOCAL LAW INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 66 YEAR OF AGE OR OVER": Attorney Barney - The State raised the permissible limits last year. The Town Board adopted a local law last year to increase the rate to be consistent with what the State permitted. The State adopted new legislation this year, but it does not increase the rates. The question is whether the Town Board wants to exclude the determination of eligible incomes of veteran disability benefits. A year ago, the State also adopted legislation which authorized subtracting out and calculating incomes based on unreimbursed health insurance costs through passage of a local law by a local government. Ed Hughes of the Tompkins County Assessment Office recognized it would be difficult to administer those health care cost and rely on people asking for reimbursements. Mr. Hughes was very careful to say that it is a policy issue for the Town Board. If the Town Board wishes to allow those medical deductions, County Assessment would do their best to accommodate the Board's wishes. If the Town Board wishes to change the law as it applies to residents of the Town of Ithaca and allow those deductions, then the Town needs to draft a local law. If the Town Board does not want to, then there would be no action needed. Councilwoman Russell - I am not sure how much extra work it would be for the County to track these medical deductions. Attorney Barney - People could incur a lot of medical bills during the year. It comes down to an honor system. The Assessment Office would be making sure these bills have not been reimbursed. Supervisor Valentino - People used to claim the medical expenses on their income tax returns, but it is not possible to do now. Councilman Klein - Do all sources of income qualify, such as Social Security, Disability, etc.? Attorney Barney - It is basically all income, but there are some that are excluded. Town Board Meeting 1/12/98 Agenda Item No. 17 RECOMMENDATION OF TOWN SUPERINTENDENT THAT HIGHWAY BE ABANDONED The undersigned, Fred Noteboom, Town Superintendent of Highways of the Town of Ithaca, County of Tompkins, New York, hereby certifies: That a portion Williams Glen Road in said Town of Ithaca, described below, has not been traveled or used as a highway for six and more years prior to the date of this certificate and said highway is hereby declared abandoned pursuant to Section 205 of the Highway Law as a highway and a public right-of-way. The portion of said highway being abandoned is that portion of Williams Glen Road adjacent to Town of Ithaca Tax Parcel Nos. 26-4-7 and 26-5-1 running from the easterly line of New York State Route 96 easterly a distance of approximately 152.5 feet (measured along the centerline of the unused portion of Williams Glen Road) to the westerly end of the portion of Williams Glen Road conveyed to the Town of Ithaca by deed of Richard E. Berggren et. al. dated September 9, 1975, and recorded in the Tompkins County Clerk's office in Book 548 of Deeds at Page 1078. In Witness Whereof the undersigned Town Superintendent cif highways, Fred Noteboom has executed this certificate and the undersigned members of the Town Board of said Town, constituting a majority of said Board, have consented to this certificate and the filing and recording thereof in the Town Clerk's office.
