AFFIDAVIT
WILLIAM J. DRESS, being duly sworn, deposes and says:
I reside at 202 Savage Farm Drive, Ithaca, New York 14850.
2. I am the owner in fee simple of the premises known generally at 283 Culver Road in the
Town of Ithaca, Tompkins County, New York and more particularly identified on the Town of Ithaca
tax maps as tax parcel no. 32-1-7. I am also the Grantee in the Deed of the above described premises to
me from Schuyler Reid Hafely dated November 25, 1960 recorded December 27, 1960 in the Tompkins
County Clerk's Office in Book 433 of Deeds at page 495. I am also the Grantor in the Deed of said
premises to the Town of Ithaca, dated concurrently and intended to be recorded concurrently with the
delivery of this Affidavit.
3. My attention has been drawn to an Oil & Gas Lease from Cora A. Culver, Arlington L.
Culver and Maude P. Culver dated August 5, 1930 to Republic Light, Heat & Power Co. Inc. recorded
October 25, 1930 in the Tompkins County Clerk's Office in Book 222 of Deeds at page 459, which
Lease was apparently assigned to Penn -York Natural Gas Corp. by instrument recorded May 22, 1931
in said Clerk's Office in Liber 224 of Deeds at page 323. Said Lease was for a period of "ten years
from the date hereof and as much longer as said premises are operated for the production of oil or gas."
4. Said Lease also contained a provision that stated "If no well is commenced within One
year from this date this lease shall become null and void unless the Lessee shall pay the Lessor a rental
quarterly in advance at the rate of $21.25/100 dollars per year until the commencement of said well."
5. During my entire period of ownership commencing in 1960, I received no payments
related to such Lease. Without limiting the foregoing, I never received any royalties nor any delay
rentals. As far as I am aware there was never any production of oil or gas on said premises nor
anywhere in the vicinity of said premises during my entire period of ownership. Accordingly, said Lease
has expired by its terms and no longer affects the above described property.
This Affidavit is made to induce the Town of Ithaca to accept a Deed of said premises and I
make this Affidavit knowing that the Town will rely on the statements made herein.
