4 FOR THE YEAR 1984 DELETING THE OWNER OCCUPANCY REQUIREMENTS ST FORTH IN
SAID LOCAL LAW, SAPSUCKER WOODS". See Attachment #2.
Resolution No. 89 - LOCAL LAW AMENDING TOWN OF ITHACA LOCAL LAW NO. 4 FOR THE
YEAR 1984 DELETING THE OWNER OCCUPANCY REQUIREMENTS FOR CERTAIN HOUSES IN
SAPSUCKER WOODS SET FORTH IN SAID LOCAL LAW.
WHEREAS, a resolution was duly adopted by the Town Board of the Town of Ithaca for a
public hearing to be held by said Town Board on July 10, 2000, at 6:30 p.m. to hear all interested
parties on a proposed local law entitled "A LOCAL LAW AMENDING TOWN OF ITHACA LOCAL
LAW NO. 4 FOR THE YEAR 1984 DELETING THE OWNER OCCUPANCY REQUIREMENTS FOR
CERTAIN HOUSES IN SAPSUCKER WOODS SET FORTH IN SAID LOCAL LAW"; and
WHEREAS, notice of said public hearing was duly advertised in the Ithaca Journal; and
WHEREAS, said public hearing was duly held on said date and time at the Town Hall of the
Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed local law, or any part thereof, and
WHEREAS, pursuant to Part 617 of the Implementing Regulations pertaining to Article 8
(State Environmental Quality Review Act) it has been determined by the Town Board that adoption of
said proposed local law would not have a significant effect upon the environment and could be
processed without further regard to SEAR, and
WHEREAS, the Town Planning Board, after due consideration has recommended adoption of
such local law; and
WHEREAS, the matter was submitted for review to the Tompkins County Department of
Planning pursuant to New York State General Municipal Law Sections 239-I and/or 239-m, and such
Department issued its opinion that adoption of the proposed local law would not have a significant
deleterious impact on intercommunity, County, and State interests, and
WHEREAS, the Town Board finds it is in the best interests of the Town and its citizens to
adopt the local law, -
NOW, THEREFORE, be it
RESOLVED, that the Town Board of the Town of Ithaca hereby adopts said local law entitled
"A LOCAL LAW AMENDING TOWN OF ITHACA LOCAL LAW NO. 4 FOR THE. YEAR 1984
DELETING THE OWNER OCCUPANCY REQUIREMENTS FOR CERTAIN HOUSES IN
SAPSUCKER WOODS SET FORTH IN SAID LOCAL LAW", a copy of which is attached hereto and
made a part of this resolution; and it is further
RESOLVED, that the Town Clerk be and she hereby is directed to enter said local law in the
minutes of this meeting and in the Local Law book of the Town of Ithaca, and to give due notice of
the adoption of said local law by publication of such local law or an abstract or summary thereof in
the Ithaca Journal and by filing a copy of said local law with the Secretary of State of the State of
New York.
MOVED Councilman Klein, SECONDED Supervisor Valentino. A vote on the motion resulted as
follows: ROLL CALL VOTE: Supervisor Valentino, aye; Councilwoman Russell, aye; Councilwoman
Grigorov, aye; Councilman Klein, aye; Councilman Conley, aye; Councilman Niederkorn, aye, -
Councilman Lesser, aye. Carried unanimously.
