BARGAIN AND SALE DEED
THIS INDENTURE made this 9th of December, 2005,
BETWEEN: COUNTY OF TOMPKINS, a municipal corporation of the State of New York
having its principal office and place of business at the County Courthouse, 125 East
Court Street in the City of Ithaca, Tompkins County, New York,
party of the first part,
and TOWN OF ITHACA , a municipal corporation with offices at 215 North Tioga
Street, Ithaca, New York 14850,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of One and 00/100 Dollars
($1.00), lawful money of the United States, and other good and valuable consideration, paid by the
party of the second part, does hereby grant, release unto the party of the second part, its heirs,
distributees and assigns forever,
ALL THAT TRACT OR PARCEL OF LAND located substantially in Military Lot 48,
Town of Ithaca, more particularly bounded and described as follows:
BEGINNING at a southwest corner of premises reputedly owned by the West Hill Cemetery
Association which point of beginning is located the following courses and distances from the
intersection of the centerline of Hayts Road with the intersection of the centerline of Hopkins Road:
1. North 88 ° 16' 43" East 322.17 feet to a point; and
2. South 28 ° 3' 12" East 373.17 feet to the point or place of beginning.
RUNNING from said point or place of beginning:
South 66' 12' 34" West 99.30 feet to a pin;
2. Thence South 33 ° 8' 16" East 208.70 feet to an iron pin;
3. Thence North 66' 9' 5 5 " East 212.43 feet to a pipe;
4. Thence North 33 ° 24' 39" West 208.92 feet to a pipe in a south line of said West Hill
Cemetery Association parcel;
5. Thence South 66' 12' 34" West 112.15 feet to the point or place of beginning,
containing 1.00+ acres.
TOGETHER WITH any rights that have accrued to grantor by virtue of any improvements
on the property including the rights of encroachment of the fence line surrounding the water tank on
the property on to the property next south.
TOGETHER WITH an easement to construct, repair, inspect, maintain and replace a pipe
or pipes for conveying water under, over and across, and also an easement to construct, repair and
maintain a road or driveway for persons, facilities and supplies, in and to all that certain strip of land
running from said above described 1-acre parcel to Trumansburg Road - New York State Route 96
and more particularly bounded and described as follows:
BEGINNING in a point in the easterly line of said above described 1-acre parcel 102.09 feet
southeasterly along said line from the northeasterly corner of said lot, and running from said point
of beginning
North 66' 25' East approximately 1138.68 feet to a point in the centerline of
Trumansburg Road, which point is distant approximately 300 feet southerly along the
centerline of Trumansburg Road from its intersection with the centerline of Hayts
Road.
2. Thence along the centerline of Trumansburg Road - New York State Route 96 South
50' 30' 40" East 33.64 feet to a point;
3. Thence South 66 ° 25' West approximately 1148.82 feet to the easterly line of said
above described 1-acre parcel;
4. Thence along said easterly line North 33 ° 24' 39" West 30.42 feet to the point and
place of beginning.
AND FURTHER TOGETHER WITH an easement (a) to discharge water from stand
pipes, reservoirs, and for pipe lines into the brook flowing across lands owned in 1933 by the Estate
of George H. Hopkins, deceased, but more recently said to be owned by Dr. A. Cameron Gough, and
(b) to use the bed of said brook to convey such water over, along or across the lands adjacent thereto
without liability for any damage to lands, buildings or crops by reason of the exercise of such rights;
BEING Parcel 4 as described in a deed from the People of the State of New York to the
County of Tompkins dated October 17, 1956, a copy of which deed was recorded in the Tompkins
County Clerk's Office in Book 392 of Deeds at page 268. The transfer affected by this deed was
authorized by a resolution of the County Legislature of Tompkins County duly adopted at a meeting
duly called and held on the 19th day of July, 2005.
TOGETHER WITH the appurtenances and all the estate and rights of the parties of the first
part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
its heirs, distributees and assigns forever.

AND the party of the first part covenants that the party of the first part has no done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND said party of the first part covenants that, in compliance with Section 13 of the
Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first to the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
IN WITNESS WHEREOF, the party of the first part has hereunto set their hands and
seals the day and year first above written.
