An Easement to New York State Electric & Gas Corporation for gas pipeline by instrument dated April 30, 1987, recorded June 2, 1987 in said Clerk's Office in Liber 626 of Deeds at page 907, incorrectly shown in deed to grantor as 997. 4. An Easement to New York State Electric & Gas Corporation and New York Telephone Company by instrument dated September 30, 1994 and recorded in the Tompkins County Clerk's Office on November 14, 1994 in Liber 739 of Deeds at page 122. 5. Declaration of Covenants and Restrictions by Eddy Hill, Inc. dated November 24, 1994 and recorded in Liber 50 of Miscellaneous Records at page 82. The grantor herein covenants that said restrictions have not been violated. 6. An Easement to the Town of Ithaca for a Water Line by instrument dated July 14, 1999 and recorded in the Tompkins County Clerk's Office in Liber 853 of Deeds at Page 73. 7. An Easement to the Town of Ithaca for a sanitary sewer line by instrument dated July 14, 1999 and recorded in the Tompkins County Clerk's Office in Liber 853 of Deeds at Page 69. BEING a portion of the premises conveyed to Kevin P. Jacobs by deed of Eddy Hill, Inc. dated dated September 20, 2002, and recorded in the Tompkins County Clerk's Office on September 20, 2002 in Liber CD2511 of Deeds at page 924, as corrected by Warranty Deed of Correction dated June 4, 2003, and recorded in said Clerk's Office on June 5, 2003 at Instrument No. 433767-001. TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HAVE AND TO HOLD the premises herein granted unto the parry of the second part, his respective heirs, distributies, and assigns forever. AND the parry of the first part covenants as follows: FIRST, That the party of the second part shall quietly enjoy the said premises; SECOND, That said party of the first part will forever WARRANT the title to said premises. THIRD, That, in Compliance with Sec. 13 of the Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
