WARRANTY DEED
THIS INDENTURE, made December .4 7, 2004
BETWEEN JOHN F. YOUNG and SUSAN M. BARNETT, husband and wife, both of 410 Triphammer
Road, Ithaca, New York 14850,
parry of the first part, and
TOWN OF ITHACA, a municipal corporation organized and existing under the laws of the
State of New York, with main offices at 215 North Tioga Street, Ithaca, New York 14850,
party of the second part,
WITNESSETH that the party of the first part, in consideration of One Dollar ($1.00), lawful money of the
United States, and other good and valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of
Tompkins and State of New York, bounded and described as follows:
BEGINNING at a set iron pin located at the intersection of the northwesterly right of way line
of Floral Avenue (N.Y. S. Route 13A) with the line between the City of Ithaca on the north and the Town
of Ithaca on the south as shown on the hereinafter referenced subdivision map; thence running the
following courses and distances:
l . S 87' 15' 21" W along the line between the City of Ithaca on the north and the Town of
Ithaca on the south a distance of 201.17 feet to an existing iron pipe;
2. N 01 ° 06' 07" E along the line between the Town of Ithaca on the west and the City of
Ithaca on the east a distance of 424.65 feet to a point;
3. N 03' 04' 28" W along the line between the Town of Ithaca on the west and the City of
Ithaca on the east a distance of 220.37 feet to an existing iron pipe;
4. S 84' 38' 15" W a distance of 271.54 feet to a set iron pin;
5. S 60' 06' 57" W a distance of 391.84 feet to a set iron pin;
6. S 351 05' 03" W a distance of 145.32 feet to a set iron pin;
7. , S 53' 42' 55" E a distance of 32.43 feet to a set iron pin;
8. S 520 57' 54" E a distance of 348.89 feet to a set iron pin;
9. N 310 52' 40" E a distance of 188.20 feet to an existing iron pipe;
10. Southeasterly on a curve to the right an arc distance of 103.79 feet (subtended by a chord
having a bearing of S 19' 3 F 47" E and a distance of 103.55 feet) to an existing iron
pipe;
11. Southeasterly on a curve to the left an arc distance of 109.62 feet (subtended by a chord
having a bearing of S 17' 30' 02" E and a distance of 109.24 feet) to an existing iron
pipe;
12. S 53' 01' 53" E a distance of 93.23 feet to a set iron pin;
13. N 870 15' 21" E a distance of 340.07 feet to a set iron pin on the northwesterly right of
way line of Floral Avenue;
14. N 38' 44' 18" E along the northeasterly right of way line of Floral Avenue a distance of
20.02 feet to the point and place of beginning.
Containing 7.02 acres of land, more or less.
The above described premises are shown as Lot 3 on a subdivision map entitled "Glenside Park
Subdivision" dated Octboer 30, 2003 prepared by T.G. Miller, P.C., Engineers and Surveyors, filed in
the Tompkins County Clerk's Office on August 31, 2004 as Instrument Number 460166-003.
SUBJECT to the following insofar as they may affect these premises:
An easement granted to New York State Electric & Gas Corporation and New York
Telephone Company dated February 1,1929 and recorded July 17,1929 in the Tompkins
County Clerk's Office in Liber 218 of Deeds at page 401.
2. Easements granted to New York State Electric & Gas Corporation (1) dated March 7,
1955 and recorded May 26, 1955 in said Clerk's Office in Liber 377 of Deeds at pages
552, 553 and 554, and (2) dated November 18,1953 and recorded in said Clerk's Office
March 11, 1954 in Liber 366 of Deeds at page 47.
3. A water line easement granted to the Town of Ithaca, dated January 25, 1977 and
recorded in said Clerk's Office May 13, 1977 in Liber 557 of Deeds at page 341.
4. Restrictions that the owner should keep the premises and buildings thereon in a neat and
attractive condition; and no pigs, chickens, cattle or horses shall be kept on the premises.
5. Restriction running with the land that the portion of the lands conveyed herein lying
between the south line of the City of Ithaca and Lot 5 as shown on the hereinabove
mentioned subdivision map shall be used for pedestrian and maintenance vehicle access
only.
6. Restriction running with the land that the premises conveyed herein shall be used only
for a municipal recreational park.
TOGETHER with a permanent right of way for ingress and egress to Lot 3, to be used in
common with others, 32 feet in width over subdivision Lot 2 shown on a subdivision map entitled
"GLENSIDE PARK SUBDIVISION," dated October 30, 2003, prepared by T.G. Miller P.C., Engineers
and Surveyors. The said right of way is 32 feet in width and located adjacent to the southeasterly line
of said Lot 2. Said easement is approximately 300 feet in length running no4easterly from Glenside
Road to Lot 3 as shown on said subdivision map, which Lot 3 ise coriteyed to the Town
as a park.
BEING a portion of the same premises conveyed to the grantors by deed of The Corners
Community Center, Inc. dated October 7, 2003 and recorded on October 7, 2003 in said Clerk's Office
as Instrument No. 441446-003.

TOGETHER with the appurtenances and all the estate and rights of the parry of the first part in and to said
premises,
TO HAVE AND TO HOLD the premises herein granted unto the parry of the second part, the heirs or successors
and assigns of the party of the second part forever.
AND the party of the first part covenants as follows:
FIRST, That the party of the second part shall quietly enjoy the said premises:
SECOND, That the party of the first part will forever WARRANT the title to said premises.
THIRD, That this deed is subject to the trust fund provisions of Section 13 of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the parry of the first part has duly executed this deed the day and year first
above written.
