YOUNG and SUSAN M. BARNETT, husband and wife, both of 410 Triphammer Road, Ithaca, New York 14850, parties of the first part, and TOWN OF ITHACA, a municipal corporation organized and existing under the laws of the State of New York, with main offices at 215 North Tioga Street, Ithaca, New York 14850, party of the second part, WITNESSETH, that the parties of the first part, inconsideration of One and 00/100 Dollars ($1.00), lawful money of the United States, and other good and valuable consideration, paid by the party of the second part, does hereby grant and release unto the parties of the second part, their heirs, distributees and assigns forever, ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Ithaca, County of Tompkins and State of New York, bounded and described as follows: COMMENCING at a point in the east line of Coy Glen Road at the southeasterly corner of premises reputedly owned by Constance Cook (380/491) which point of beginning is also approximately 419.5 feet northerly along the east line of Coy Glen Road from its intersection with the centerline of Glenside Road and North 00' 34' 53" West a distance of 33.61 feet from the centerline of Coy Glen Road; thence along the east line of Coy Glen Road on a slight curve to the right an arc distance of 289.93 feet with a chord of North 41 ° 35' O2" West and a chord length of 289.79 feet to a point; thence North 44 ° 37' 48" West a distance of 267.90 feet to a point in premises reputedly owned by Constance Cook; thence Soufh 00 ° 34' 53" East along the westerly line of said Cook premises a distance of 407.43 feet to the point of beginning. The property is part of Town of Ithaca tax parcel number 30.-1-1. The lot is unimproved. TOGETHER WITH all right, title and interest of the grantor extending to the centerline of the highways abutting the above described premises, SUBJECT TO the rights of the public therein. SUBJECT TO the following insofar as the same may affect the above described premises: An easement granted to New York State Electric & Gas Corp. and New York Telephone Company dated February 1, 1929 and recorded July 17, 1929 in the Tompkins County Clerk's Office in Liber 218 of Deeds at page 401. 2. An easement granted to New York State Electric & Gas Corp. (1) dated March 7, 1955 and recorded May 26, 1955 in said Clerk's Office in Liber 377 of Deeds at page 553 and (2) dated November 18, 1953 and recorded in said Clerk's Office March 11, 1954 in Liber 366 of Deeds at page 47. A water line easement granted to the Town of Ithaca, dated January 25, 1977 and recorded in said Clerk's Office May 13, 1977 in Liber 557 of Deeds at page 341. The above described premises are shown on a map entitled: "Subdivision Map Showing Lot to be Conveyed to The Town of Ithaca Located on Coy Glen Road, Town of Ithaca, Tompkins County, New York", dated October 30, 2003, prepared by T.G. Miller P.C., a copy of which map is intended to be filed concurrently herewith, is incorporated herein by reference and made a part hereof. BEING a portion of the same premises conveyed to the grantors by deed of The Corners Community Center, Inc. dated October 7, 2003 and recorded on October 7, 2003 in said Clerk's Office as Instrument No. 441446-003. TOGETHER WITH the appurtenances and all the estate and rights of the parties of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, it successors and assigns forever. AND said parties of the first part covenants as follows: FIRST: That the party of the second part shall quietly enjoy the said premises. SECOND: That the parties of the first part will forever warrant the title to said premises. THIRD: That, in Compliance with Section 13 of the Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first to the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
