The data that you have provided this office indicates that the house and garage were built in 1950, prior to any Town Zoning Ordinance. This would provide some "grand fathering" rights to the existing garage, based on the information provided. The shed at the rear of the property does not have any valid information regarding when it was built; therefore, it appears that the shed is in violation of the Town of Ithaca Zoning Ordinance, which requires a minimum of three feet to the property lines. The shed must be moved or an area variance must be received for the property. The determination of this office is based on information provided by your office. Should different information arise in the future, this office reserves the right to change its opinion of the property.
