Subdivision — Lands of Walker & VanValen
Coddington Road
Tax Parcel No. 47-2-6.52
Planning Board, July 16, 2002
MOTION made by Eva Hoffmann, seconded by George Conneman.
WHEREAS:
1. This action is consideration of Preliminary and Final Subdivision Approval for the proposed
subdivision on Coddington Road at the Town of Danby line, Town of Ithaca Tax Parcel No. 47-
2-6.52, Residence District R-30 and Conservation District. The proposal is to subdivide two
parcels totaling 0.49 +/- acres from the 62.73 +/- acre parcel, which will be consolidated with
two parcels resulting from subdivision of the existing 0.37 +/- acre triangular parcel in the Town
of Ithaca. Parcels in the Town of Ithaca will be attached by deed to parcels in' the Town of
Danby, creating two lots that meet minimum lot size requirements in the Town of Danby.
Neither parcel in the Town of Ithaca will have road frontage and will be deed restricted so as
not to be conveyed separately from the lots in Danby to ensure required road frontage.

2. This is an Unlisted Action for which the Town of Ithaca Planning Board, acting as lead agency
in environmental review with respect to Subdivision Approval, has on July 16, 2002, made a
negative determination of environmental significance, after having reviewed and accepted as
adequate a Short Environmental Assessment Form Part I, submitted by the applicant, and Part
II prepared by the Town Planning staff, and
3. The Planning Board, at a Public Hearing held on July 16, 2002, has reviewed and accepted as
adequate survey maps entitled "Survey Map Lands of George VanValen, Towns of Ithaca and
Danby, Tompkins County, New York," prepared by Michael J. Reagan, Licensed Land
Surveyor, dated 12/04/2000 and amended 6/20/2002, and "Survey Map Lands of Richard L.
and Ruth S. Walker and Part of Lands of George VanValen To Be Conveyed to Walker, Town
of Ithaca, Tompkins County, New York, ...", prepared by Michael J. Reagan, Licensed Land
Surveyor, dated 05/20/02, and other application materials, and
4. The Town of Danby has approved a Minor Land Division for Parcels "A" and "B" as shown on,
the "Survey Map Lands of Richard L. and Ruth S. Walker and Part of Lands of George
VanValen to be Conveyed to Walker ...", dated 05/20/02, prepared by Michael J. Reagan,
conditional upon receiving the necessary approvals from the Town of Ithaca, and
5. The sole purpose of subdividing off additional lands from Town of Ithaca Tax Parcel No. 47-2-
6.52 is to attach sufficient lands to Parcel A (0.63 +/- acres combined area in the Town of
Ithaca to form a total area in both Towns of 2.17 +/- acres) and Parcel B (0.23 +/- acres
combined area in the Town of Ithaca to form a total area in both Towns of 2.27 +/- acres) in
order to meet the minimum required lot area in the Town of Danby Zoning Ordinance,

NOW, THEREFORE, BE IT RESOLVED:
1. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary
and Final Subdivision Approval, as shown on the Preliminary and Final Subdivision Checklists,
having determined from the materials presented that such waiver will result in neither a
significant alteration of the purpose of subdivision control nor the policies enunciated or implied
by the Town Board, and
2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the
proposed subdivision on Coddington Road, Town of Ithaca Tax Parcel No. 47-2-6.52, as
shown on the survey maps entitled "Survey Map Lands of George VanValen, Towns of Ithaca
and Danby, Tompkins County, New York," prepared by Michael J. Reagan, Licensed Land
Surveyor, dated 12/04/2000 and amended 6/20/2002, and "Survey Map Lands of Richard L.
and Ruth S. Walker and Part of Lands of George VanValen To Be Conveyed to Walker, Town
of Ithaca, Tompkins County, New York, ...", prepared by Michael J. Reagan, Licensed Land
Surveyor, dated 05/20/02, subject to the following conditions:
a. Within six months of this approval, consolidation of the westerly portion of the
"Proposed Parcel to be Conveyed by VanValen to Walker" with the westerly portion of
the "Proposed Parcel to be Conveyed by Walker to Chandler", and consolidation of the
easterly portion of the "Proposed Parcel to be Conveyed by VanValen to Walker" with
the easterly portion of the "Proposed Parcel to be Conveyed by Walker to Chandler", as
shown on the survey maps, and submission to the Town of Ithaca Planning Department
of a copy of the request to the Tompkins County Assessment Department for said
consolidations, and
b. Prior to signing of the survey maps by the Planning Board Chair, submission of a deed
restriction or amended deed, for review and approval by the Attorney for the Town,
limiting the future conveyance or subdivision of the lands in the "Proposed Parcel to be
Conveyed by VanValen to Walker" (combined area 0.49 +/- acres) and the lands in the
"Proposed Parcel to be Conveyed by Walker to Chandler" within the Town of Ithaca
independent of Parcels "A" and "B" fronting on Coddington Road within the Town of
Danby, thereby retaining proper road frontage for said lands, and
C. Submission of a mylar and three dark -line prints of each of the above -referenced survey
maps, all signed and sealed by the licensed surveyor who prepared the survey, along
with the required surveyor's certificate, for signing by the Planning Board Chair, and
AND BE IT FURTHER RESOLVED:
The Planning Board finds that there is no need for any park land reservation created by this proposed
subdivision, and hereby waives the requirement for any park land reservation.
The vote on the motion resulted as follows:
