Prevailing Time. PRESENT: Supervisor Catherine Valentino Councilwoman Carolyn Grigorov Councilwoman Mary Russell Councilman William Lesser Councilman Thomas Niederkorn Councilman Will Burbank ABSENT: Councilman David Klein In the Matter of the Proposed Sewer Improvement in the Town of Ithaca, PUBLIC INTEREST Tompkins County, New York, pursuant to Article 12-C of ORDER the Town Law to be known as the Town of Ithaca 2002 Trumansburg Road Sewer System Improvement WHEREAS, a plan, report and map has been duly prepared in such manner and in such detail as heretofore has been determined by the Town Board of the Town of Ithaca, Tompkins County, New York, relating to the creation and construction, pursuant to Article 12-C of the Town Law of sewer system improvements to be known and identified as the Town of Ithaca 2002 Trumansburg Road Sewer System Improvement, and hereinafter also referred to as "improvement", to provide such sewer improvement including extensions, to the present Town sewer improvement, such sewer system improvement to be constructed and owned by the Town of Ithaca, and WHEREAS, said plan, report and map have been prepared by Daniel Walker, P.E., the Town Engineer, a competent engineer duly licensed by the State of New York and have been filed in the office of the Town Clerk where they are available for public inspection, and WHEREAS, the area of said Town determined to be benefitted by said Town of Ithaca 2002 Trumansburg Road Sewer System Improvement consists of the entire area of said Town excepting therefrom the area contained within the Village of Cayuga Heights, and WHEREAS, the proposed Town of Ithaca 2001 Trumansburg Road Sewer System Improvement consists of the sewer improvements set forth below, and in the areas of the Town as set forth below, and as originally shown and described in said map, plan and report on file in the Office Liber:CD2509 Page:2223 TizuvansburgRoad SewerlmprovemeQt-friblic Interest Order, wp80; JCB Ithaca Resohitrons,• Hal, August 1, 20021231R)I of the Town Clerk: Construction and installation 8 inch PVC sewer pipe extending from the end of the existing sewer at the northeast corner of the Fire Station 6 property on Trumansburg Road northerly on the west side of Trumansburg Road a distance of approximately 3000 feet to the intersection of Trumansburg Road and Hayts Road, together with related manholes and appurtenances and installation of laterals to the highway right of way line to serve existing buildings on tax parcels adjacent to Trumansburg Road along the line as so extended; and WHEREAS, the Town Engineer has reduced the scope of the project, so that now the map, plan and report currently on file in the Office of the Town Clerk shows the improvement to be: Construction and installation 8 inch PVC sewer pipe extending from the end of the existing sewer at the northeast corner of the Fire Station 6 property on Trumansburg Road northerly on the west side of Trumansburg Road a distance of approximately 2400 feet to a point approximately 200 feet south of the intersection of Trumansburg Road and Hayts Road, together with related manholes and appurtenances and installation of laterals to the highway right of way line to serve existing buildings on tax parcels adjacent to Trumansburg Road along the line as so extended; and WHEREAS, the reduction in scope does not affect the number of properties to be served by, nor the number of properties to be benefitted by, the improvement, nor does it change the boundaries of the area to be benefitted, nor does it change the method of apportioning the costs of such improvement; and WHEREAS, the maximum initially proposed to be expended by the Town of Ithaca for the aforesaid improvement was $200,000.00 but the project having been reduced in scope the maximum now proposed to be expended is $153,500; and WHEREAS, the proposed method of financing said improvement to be employed by said Town of Ithaca consists of expenditure of current revenues and surplus funds from the operation of the Town -Wide Sewer Benefitted Area; and WHEREAS, said maximum estimated cost is not greater than 1/10th of 1% of the full valuation of taxable real property in the area of the Town of Ithaca outside of any villages; and WHEREAS, it is proposed that the cost of the aforesaid improvement shall be paid out of surplus funds and current revenues derived from the operation of the Town -Wide Sewer Benefitted Area; and WHEREAS, the aforesaid improvement has been determined to be an Unlisted Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act and the laws and regulations of the Town of Ithaca, the implementation of which as proposed, the Town Board has determined will not result in any significant environmental effects; and 2 Liber:CD2509 Page:2224 Tma iaashzub Road Server ImprocemeQt-Public Interest bider, rvp80;JCB Ithaca Resolutions,• Hal, August 1, 200212.•34P11I WHEREAS, the Town Board of the Town of Ithaca duly adopted an order on July 8, 2002, calling a public hearing upon said plan, report and map including an estimate of cost and the question of providing sewer improvements to be known as the Town of Ithaca 2002 Trumansburg Road Sewer System Improvement, such public hearing to be held on the 29th day of July, 2002, at 5:45 o'clock p.m., Prevailing Time, at the Town Hall, 215 North Tioga Street, in the City of Ithaca, Tompkins County, New York, at which time and place all persons interested in the subject thereof could be heard concerning the same; and WHEREAS, notice of said public hearing was duly posted and published as required by law; and WHEREAS, said public hearing was duly held at the place and at the time aforesaid and all persons interested in the subject thereof were heard concerning the same; and WHEREAS, it is now desired to authorize the improvement to be known as the Town of Ithaca 2002 Trumansburg Road Sewer System Improvement; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Ithaca, Tompkins County, New York, as follows: Section 1. It is hereby determined that it is in the public interest to make the sewer improvement hereinafter described and such sewer improvement is hereby authorized. The proposed area hereby determined to be benefitted by said Town of Ithaca 2001 West Hill Sewer System Improvement is all of the Town of Ithaca outside of the Village of Cayuga Heights. Section 2. The proposed improvement shall consist of construction and installation of an 8 inch PVC sewer pipe extending from the end of the existing sewer at the northeast corner of the Fire Station 6 property on Trumansburg Road northerly on the west side of Trumansburg Road a distance of approximately 2400 feet to a point approximately 200 feet south of the intersection of Trumansburg Road and Hayts Road, together with related manholes and appurtenances and installation of laterals to the highway right of way line to serve existing buildings on tax parcels adjacent to Trumansburg Road along the line as so extended at an currently determined maximum estimated cost to said benefitted area of $153,500.00. The method of financing of said cost shall be by expenditure of current revenues and surplus funds derived from the operation of the Town -Wide Sewer System. Section 3. It is hereby determined that the estimated expense of the aforesaid improvement does not exceed I/I Oth of I % of the full valuation of the taxable real property in the area of said Town outside of Villages and, therefore, in accordance with the provisions of subdivision 13 of Section 209-q of the Town Law, the permission of the State Comptroller is not required for such improvement. 3 Liber:CD2509 Page:2225 TiumansGurg-Road Serverlmprorement-Public Interest Order, cvp80;JCB Ithaca Resolutions, Hal, August 1, 90021231P,11 Section 4. Pursuant to subdivision 6(d) of Section 209-q of the Town Law, the Town Clerk is hereby directed and ordered to cause a certified copy of this resolution to be duly recorded within 10 days of the date of adoption in the Office of the Clerk of the County of Tompkins, which when so recorded, shall be presumptive evidence of the regularity of the proceedings and action taken by the Town Board in relation to the aforesaid improvement. Section 5. It is hereby further determined that all of the cost of the aforesaid improvement shall be borne wholly by property within the Town of Ithaca outside of the Village of Cayuga Heights. Section 6. This order is adopted subject to permissive referendum. The question of adoption of the foregoing resolution was, upon motion made by Councilperson Niederkorn, and seconded by Councilperson Grigorov, duly put to a vote on a roll call, which resulted as follows: Supervisor Valentino Councilperson Russell Councilperson Grigorov Councilperson Lesser Councilperson Neiderkorn Councilperson Burbank The order was thereupon declared duly adopted.
