and TOWN OF ITHACA a New York municipal corporation with
offices at 215 North Tioga Street, Ithaca, New York, 14850
parry of the second part,
WITNESSETH, that the party of the first part, in consideration of One and 00/100 Dollar
($1.00), lawful money of the United States, and other good and valuable consideration, paid by
the party of the second part, does hereby grant and release unto the party of the second part, their
heirs, executors, successors, distributees and assigns forever,
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of
Tompkins and State of New York being more particularly bounded and described as follows:
BEGINNING at a point in the westerly line of Troy Road, said point being 1657 feet, more
or less, northerly, as measured along said westerly line of Troy Road from its intersection with
the centerline of Whitetail Drive;
Thence, N84-03'-57" W, a distance of 200.00 feet to a point marked by an iron pin;
Thence, S06-03'-27" W, a total distance of 582.95 feet to a point marked by an iron pin;
Thence, N49-12'-50" W, a distance of 649.90 feet to a point marked by an iron pin;
Thence, SO4-43'-51" W, a distance of 123.69 feet to a point marked by an iron pin, said
point being in the northerly line of "Deer Run - Phase Two", prepared by George Schlecht, P.E.,
L.S., dated April 8, 1988; revised April 14, 1988; last amended June 6, 1989; filed in Drawer 34;
Thence, N49-12'-50" W, along the northerly line of "Deer Run - Phase Two", a distance
of 240.40 feet to a point marked by an iron pin;

Thence, N04-43'-51" E, along the easterly line of the aforementioned "Deer Run - Phase
Two" subdivision, a distance of 249.45 feet to a point marked by an iron pin;
Thence, 585-16'-09" E, a distance of 428.13 feet to a point marked by an iron pin;
Thence, 584-00'-11" E, a distance of 505.42 feet to a point in the westerly line of Troy
Road marked by an iron pin;
Thence, 504-55'-53" W, along the westerly line of Troy Road, a distance of 60.00 feet to
the POINT or PLACE OF BEGINNING; CONTAINING 7.32 acres, be the same more or less.
The above described Parcel "E" is shown on a map "Survey of Parcels A, B, C, D, E and
F for Hallberg Associates", prepared by George Schlecht, P.E., L.S., dated 2/08/90, filed in the
Tompkins County Clerk's Office on 2/20/90 in map drawer O page #59. Tax Parcel No. 44.-1-
122.2.
This conveyance is to the Town of Ithaca for general municipal purposes.
SUBJECT to an easement conveyed to the Town of Ithaca, by deed recorded in the
Tompkins County Clerk's Office in Book 655 at Page 16.
BEING part of the same premises conveyed by Ted Kinder, Irving Candee, and Robert
Medina to the Grantor herein by deed recorded in the Tompkins County Clerk's Office in Book
836 of Deeds at page 159.
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
their heirs, executors, successors, distributees and assigns forever.
AND said party of the first part covenant as follows:
FIRST: That the party of the second part shall quietly enjoy the said premises.
SECOND: That said party of the first part will forever warrant the title to said premises.
THIRD: That, in Compliance with Section 13 of the Lien Law, the grantor will receive
the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
