Re: Encroachment on sewer Easement

f, Dear Mr. and Mrs. Chipalowsky:
1 have reviewed your request for an evaluation of the impact of the encroachmm
of your house on tl)e Town unitary Sewer Easement executed on May 14. 1 %5. The
permanent Town Sanitary Sewer easement along the South boundary of your property is
twenty (20) feet wide and the 8" sanitary sewer is approximately 10 feet from the
property line at the front of the parcel and approximately 20 feet from the boundary at the
rear property line. The apparent encroachment results in the house foundation line being
approximately 7 feet from the actual sewer line. This distance between the house and the
actual sewer line does allow adequate room for maintenance in the event that an
excavation of the existing sewer is required.
Based on my review of the site conditions, the current encroachment is not
causing any interference with the maintenance or operation of the Town Sewer System,
and the Town of Ithaca will not require removal of the current encroachment.
