BETWEEN: CODDINGTON ROAD COMMUNITY CENTER, INC. and the
TOWN OF ITHACA
WHEREAS, the Town of Ithaca• recognizes the need for a Town
park on South Hill to serve Town residents, and
WHEREAS, the Town is desirous of upgrading and maintaining a
playing field which is currently owned by the Center for use as a
Town park,
WHEREAS, the Coddington Road Community Center, Inc., has
rwp*sted assistance from the Town in the cleanup, repair, and
upgrading of outdoor play areas adjacent to said playing field,
NOW, THEREFORE, the Coddington Road Community Center, Inc.,
in consideration of the benefit of such improvements to its land
and adjacent properties, does grant a temporary easement to enter
upon and make improvements as are described on. the attached map
of the lands of Coddington Road Community Center, Inc. (refer to

include as little of the owner's property as may be necessary for
workers and vehicles while work is being performed. The

undersigned landowner understands and agrees that the sponsors do
not imply any continuing responsibility to maintain the outdoor
play areas in which improvements are to be made, except as
provided in a separate easement for the playing field.

The Owner, Coddington Road Community Center, Inc., reserves
all property rights and merely grants the access right to perform
the immediate work. The owner shall give prompt notice to the
Town of Ithaca Town Engineer of any damage to the property or
failure to restore the same properly.
