Board Members Present: Rod Howe, Supervisor; Members Eric Levine (5:48), Rich DePaolo,

Mr. Howe called the meeting to order at 5:30 p.m.
2. Persons to be heard and Board Comments
There was no one from the public wishing to address the Board.
Board Comments:
Mr. DePaolo said that he was concerned with the amount of people at the East Shore Dr. park
saying that there are many, many people there on the lawn and on the riprap rocks every time it
is hot and it is dangerous because of parking, no -social distancing and no masks. He said he
understands we have signs that say no swimming, and social distancing guidelines, but there is a
risk there that we are not managing as well as maybe we should be. It is an "attractive nuisance"
and it is crazy down there.
Mr. Howe said our Parks Department is aware of the issues there and added that representatives
from the Cornell Sailing Center are upset with the crowds and access to their site and a
conference call is scheduled this week.
Mr. DePaolo asked if the paddleboard rental is associated with the Sailing Center or someone
who just set up shop and Mr. Howe said he assumed it was the Sailing Center but he will ask.
Ms. Leary asked about her suggestion to looking into HEPA filters in our buildings.
Mr. Howe said that we have discussed it and Joe Hulbert is looking at the system and will report
soon.
Ms. Hunter asked about the Tompkins County Water Resources Council's Wetlands Map and if
it has been adopted by the Town?

Ms. Ritter responded that staff use that map now when talking to residents and the Planning
Board but she didn't know if it was ever formally "adopted."
Ms. Hunter asked if it should be and Ms. Ritter said she will look into it and report back.
3. Public Hearing regarding a proposed local law to override the tax levy limit established
in General Municipal Law §3-c, for the fiscal year beginning January 1, 2021 and
ending December 31, 2021
Mr. Howe opened the public hearing at 5:41 p.m. There was no one present wishing to address
the Board. Ms. Rosa stated for the record that there was no one present on the alternate ZOOM
ID address that had been published.
Mr. Howe closed the public hearing at 5:42 p.m.
TB Resolution 2020 - 095: Adopting Local Law 3 of 2020 to Override the Tax Levy Limit
Established in General Municipal Law 0-c
Whereas, municipalities of the State of New York are limited in the amount of real property taxes
that may be levied each year under the tax levy limit established in General Municipal Law §3-c,
and
Whereas, subdivision 5 of General Municipal Law §3-c expressly authorizes a municipality to
override the tax levy limit by the adoption of a local law approved by vote of at least sixty percent
(60%) of the governing body, and
Whereas, at its meeting on June 8, 2020, the Town Board of the Town of Ithaca reviewed and
discussed a proposed local law to override the tax levy limit and adopted a resolution for a public
hearing to be held by said Town on July 13, 2020 at 5:30 p.m. to hear all interested parties on the
proposed local law entitled "A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT
ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C"; and
Whereas, notice of said public hearing was duly advertised in the Ithaca Journal; and
Whereas, said public hearing was duly held on said date and time at the Town Hall of the Town
of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed local law, or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of the proposed local law is a Type II action because it constitutes "routine or continuing
agency administration and management, not including new programs or major reordering of
priorities that may affect the environment," and thus this action is not subject to review under
SEQRA; now, therefore, be it

Resolved, that the Town Board of the Town of Ithaca hereby adopts Local Law 3 of 2020 entitled
"A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL
MUNICIPAL LAW §3-C", and be it further
Resolved, that the Town Clerk is hereby authorized and directed to file said local law with the
Secretary of State as required by law.

4. Acknowledge receipt of Ithaca College Wetland Preservation easement inspection
(Attachment 1)
Mr. Howe noted that this is a yearly inspection report that the Board takes no official action on
and is for informational purposes.
Mr. DePaolo asked about the reference to the breach and asked how that can happen.
Mr. Thaete responded that it could have been the trees on the berm which are a major factor in
the deterioration of berms, or any number of things.
5. Discuss and consider award of contract for 2020 Sanitary Sewer Rehab Project
Mr. Thaete explained that the Town budgets $300K for this type of project every year, and the
project from 2019 ran into 2020 due to the contractor being behind schedule and then some
issues were found that the contractor had to redo which delayed payment into 2020. Monies
from 2019 do not roll over so those funds came from the budgeted $300K line and now that line
needs to be replenished. The bid also came in slightly over budget, and therefore the request is
for a budget transfer and approval to award.
Mr. DePaolo asked if any of this work is done in-house
Mr. Thaete responded that it is not; this is highly specialized equipment taking photos and videos
of the infrastructure. This year's project is focused on the Inlet Valley and the pumps in that
area.
TB Resolution 2020 - 096: Budget Amendment and Authorization to Award Contract for
the 2020 Sanitary Sewer Rehabilitation Proiect
Whereas, the 2020 Ithaca Town Budget included $300,000 for the rehabilitation of Sanitary
Sewers and Manholes; and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that

approval, construction and implementation of the Sanitary Sewer Rehabilitation Project 2020 (the
"Improvement" or "Project") are a Type II Action because the Action constitutes "replacement,
rehabilitation or reconstruction of a structure or facility, in kind, on the same site," and thus
approval, construction and implementation of the Improvement are not subject to review under
SEQRA; and
Whereas, on June 25, 2020, the Director of Engineering (Director) received bids for the Project;
and
Whereas, the Director reviewed the bids and qualifications received and has determined the lowest
responsive bid in the amount of $310,572.50 was made by the lowest responsible bidder,
Diversified Infrastructure Services Inc. 1604 Thomaston Ave. Unit J Waterbury CT 06704; and
Whereas, the lowest responsive bid was over the estimate by $10,572.50 and an additional 2%
contingency is customary and recommended in the amount of $6,000 for a total overage of
$16,572.50; and
Whereas, the Town has expended a total of $87,715.29 of the 2020 budgeted amount to complete
unfinished portions of the 2019 Sanitary Sewer Rehabilitation Project.
Whereas, the Director recommends transferring funds from the unreserved Sewer Fund to cover
this expenditure; now therefore be it
Resolved, that the Town Board hereby authorizes the award of the contract for the Town of Ithaca
2020 Sanitary Sewer Rehabilitation Project to Diversified Infrastructure Services Inc.; and be it
further
Resolved, that the Town Supervisor is authorized to execute such contract subject to approval of
the final contract documents by the Town Engineer and Attorney for the Town; and be it further
Resolved, that the Director is authorized to approve change orders to such contract upon receipt of
appropriate justification provided the maximum amount of such change orders shall not in the
aggregate exceed $6,000.00 without prior authorization of this Board, and provided further that
the total project cost, including contract, engineering, legal, inspection, and other expenses, does
not exceed the maximum authorized cost of $316,572.50 for the project, and be it further
Resolved, that the Town Board hereby amends the 2020 Ithaca Town Budget and authorizes and
directs the Town Finance Officer to appropriate an additional $104,287.79 from the unreserved
fund balance of the Sewer Fund to meet these expenditures, as follows:

$404,287.79.

6. Discuss Fisher Associates structural analysis memo (Attachment 2)
Mr. Howe gave an overview saying as we moved forward with the project and heard comments
from people in that area and looked at revising plans and ideas we realized we should get a
structural analysis of the culvert structure done. This is that analysis and it shows the structure is
not safe and we are going back to the approved plan from May and putting in the two pipes.
7. Discuss and consider approval and authorization for the Supervisor to sign an easement
associated with the Coddington Road Community Center park land swap — Pulled

Mr. Howe explained this is just to cover some effects of Covid-19 delays in contractors and
similar.
TB Resolution 2020 - 097: Extension of expiration dates for Building Permits, Zoning
Board of Appeals, and Planning Board approvals
Whereas the NYS Senate and Assembly have enacted S8236A (Bill) which allows for
municipalities to extend for a period of up to 120 days, building permits, Zoning Board of
Appeals active approvals and Planning Board active approvals received prior to March 7, 2020
to mitigate any hardships and delays associated with the declaration of the State Disaster
Emergency of COVID-19, and
Whereas the Director of Code Enforcement and the Director of Planning have discussed this
extension and recommend establishing the extension, and
Whereas Bill S8236A specifies the municipality should pass a resolution to use the provisions
contained, now therefore be it
Resolved, that the Town Board hereby authorizes a 120-day extension beyond the stated
expiration date for the following: (1) building permits issued before March 7, 2020, and (2)
Zoning Board of Appeals and Planning Board active approvals issued before March 7, 2020. No
additional moneys will be collected or charged by reason of such extensions.

TB Resolution 2020 — 098d: Provisional Appointment of Network Specialist
Whereas, there will be a vacant Network/ Records Specialist position due to a retirement, but the
Town created the Network Specialist position to replace the previous position, and
Whereas, the interviewing committee interviewed 6 candidates from the open recruitment for the
position, and
Whereas, the committee has determined that John Little possesses the necessary knowledge and
skills to satisfactorily perform the duties of the position and recommend appointment effective
July 27, 2020; now, therefore be it
Resolved, the Town Board of the Town of Ithaca does hereby approve the provisional
appointment of John Little as Network Specialist, effective July 27, 2020; and be it further
Resolved, this is a 40 hour a week salaried position, at the annual salary of $72,800, from
account number A1680.100, in Job Classification "F", with full time benefits; and be it further

Resolved, the said appointment is a provisional appointment pending the results from the next
civil service exam for this position.
10. Report of Town Officials
Ms. Rosa reported that the Town is doing marriage licenses and we are getting people from all
around and with the City of Ithaca being closed we are getting a lot of questions and if people get
in touch with Board Members, she wanted them to know.
Mr. DePaolo asked about the correspondence list, which in other times we would have a hard
copy in folders, and he asked if we could scan the correspondence to the Board.
Ms. Rosa responded that she sends out the correspondence as it comes in but this is wholistic list.
Mr. DePaolo asked about an item in the abstract about basketball hoops and nets and he asked if
we were installing them now?
Mr. Howe said he thought that the County cleared them, and we have installed them.
Mr. Slater agreed, and said he thought there was an email from the County, and we did install
them. Youth baseball is also starting next week.
Mr. DePaolo thought that was amazing since basketball is a very contact -heavy sport.
Discussion followed with Ms. Leary saying we should not be installing hoops, regardless of
signs for social distancing. Mr. DePaolo agreed, especially with the students returning.
Ms. Leary then asked if our mask policy changed because she thought staff were supposed to be
wearing masks unless they are at their desks and Ms. Rosa and Ms. Shaw are in the conference
room without masks. She said the virus can hang in the air for hours.
Mr. Howe responded that we have had meetings in the Aurora Room, and we are set 6-feet apart
and it is up to the individual. If people are walking around Town Hall they wear masks, but at
meetings, 6 feet apart, it is the choice of the person.
Ms. Leary said it is clearly against the State mandate and Mr. Howe and Mr. Goodman said it is
not.
Mr. Goodman said we have marked out the conference room so we are always 6 feet apart and
he is ok with hoops if the County said its okay.
Mr. Howe said he is fine with the hoops too, but wanted to hear from the other members.
Ms. Hunter said it is an odd approach to take; if your comfortable you don't have to wear one,
but the mask protects the other person, not the wearer and should then not be up to a person

being "comfortable" with not wearing a mask. She was also interested in hearing about people
who may be on a quarantine list and we are issuing marriage licenses to them. She said we have
a responsibility to manage this.
Mr. Howe said he will contact Mr. Kruppa about the hoops.
Ms. Bleiwas said she is inclined to say she would rather hold off on installing the hoops in an
abundance of caution. She said she is disappointed that staff are not wearing masks and making
poor choices.
Mr. DePaolo said he did not think it was a good idea to install the hoops given the type of play
and the closeness of the players.
Ms. Leary turned back to the masks, and said they do protect both, but leaving it up to people to
decide they are comfortable or the County says a policy is up to the municipality, we can be
stricter.
Mr. Howe said we will address the hoops and said he did not think we have been irresponsible in
Town Hall at all.
Ms. Drake said we have been responsible and there has been some relaxing of efforts.
Mr. Howe added that we may start having meetings in the Boardroom again soon and some
members may choose to continue to attend virtually and that is fine.
Ms. Leary said she has felt strongly about this and stay educated about this and forwarding
articles about the virus and when she thinks something is important enough and definitive
enough, she wants us to be aware of it.
The facts continue to come out and it is highly contagious and it should not be left up to the
individual. We have a responsibility to the staff and the public and if we know that 6 feet is an
arbitrary number, she doesn't care what people think, it is our responsibility to protect them.
Mr. Howe noted that there are Community Choice Aggregation webinars being offered and the
5G Forum and he hopes members attend and take advantage of them since we will be making
decisions on those topics.
Mr. Mosely reported that his department is starting to use digital forms and we have installed a
computer for the public to use to move this along.
Mr. Howe noted that John Little starts at the end of the month and interviews are happening for
the Water and Sewer Supervisor.

RE: ANNUAL CONSERVATION EASEMENT INSPECTION
- ITHACA COLLEGE WETLAND MITIGATION SITES
RAPONI & RICH ROAD SITES
Attached are the copies of the completed Conservation Easement Monitoring & Inspection
Reports for the Ithaca College Wetland Mitigation Sites — Raponi & Rich Road Sites. The
conservation easement requires that an annual compliance inspection be completed by the Town
of Ithaca. This site inspection was completed for the Raponi and Rich Road sites on June 5t' and
found both sites to be in compliance with the terms of the easement.
During last years inspection of the Rich Road site, a large breach was identified on the northern
side of cell 5. There was a steady flow of water through the breach, which was directed toward
the residences on Northview Rd W. Ithaca College hired T.G. Miller P.C. to look at the issue and
provide guidance and recommendations for the repair. The repair involved Ithaca College
collapsing the tunnel and then they used a clay fill material to make the repair. The clay was
tamped in small lifts to ensure good compaction. It appears that the repair is working and you
can see the disturbed area in one of the attached photos.
It was noted that there were several new piles of yard waste that have been dumped along Rich
Road within the easement, some extending into wetland cell 6. Ithaca College has been
contacted and they will have these new piles removed. They also plan to install new signage in
that area. Attached are three photos of the yard waste that has been dumped at the Rich Road
site.

Description. The existing opening is a 13 ft. clear by 8.5 ft. high rectangular opening. Original construction
consisted of concrete gravity wall abutments with in -line wingwalls on both sides. No reinforcement in the
walls was observed. Barrel length is approximately 20 ft., with 10 ft. wingwall extensions on both sides
yielding a total length of approximately 40 ft. The superstructure is a deck slab constructed with
longitudinal railroad rail as reinforcing formed at the bottom and sides and filled with what appears to be
unreinforced concrete, as no reinforcement was observed in the large spall areas on the deck fascia. The
superstructure is covered with earth fill.
Culvert Condition. The superstructure is in very poor condition — see photos attached following this report.
The concrete deck is unreinforced except for the bottom rail reinforcement, which has significant corrosion
and section loss, especially near the fascia. Efflorescence was observed throughout the underside of the
deck slab, with stalactites up to 6 in. scattered across the underside. Concrete headwalls, if originally
constructed, have disintegrated completely, and the remaining exposed concrete deck cement matrix has
deteriorated to a point that aggregate can be easily removed with a small hammer claw or even by hand.
Above the deck, the fill is overgrown and has at least one 3 in. diameter scrub tree growing over the deck,
with brush, weeds and other dense overgrowth along the length of the rail bed approaches.
The abutments and wingwalls have significant cracks and efflorescence, and the tops of the walls have
spalled up to 6 in., with the cement matrix deteriorated like the deck concrete cement matrix. No reinforcing
was observed in spall areas, and no corrosion staining was present throughout the exposed wall faces.
Structural Assessment and Recommendation. Based on this condition inspection, it is our opinion that
the superstructure is not viable for the use as a pedestrian bridge due to the extent of corrosion and estimated
section loss in the reinforcing and the deteriorated condition of the concrete. The substructures are also in
poor condition and not suitable for re -use with a new superstructure, since they are unreinforced, cracked
and spalled, and would not be a reliable foundation for a new slab span.
