You recently inquired as to the permitted side yard building setback at the Deer Run
Subdivision, Phase IIIS tin which 174 Whitetail Drive is located). The permitted setback
differs from the Town's Zoning Ordinance•for R-15 districts which requires side yard
building setbacks to property lines of 15 feet.
The approved subdivision Neap for this phase of the development contains a general
note which states that buildings must be located 30 feet apart at the side yards, As
such, a building on one lot could be located one foot from a property boundary line, as
long as, the building on the adjacent lot is located 29 feet away from that lot line.
Certainly any combination of numbers is acceptable, as long as, the 30 foot building
separation is maintained.
It is noteworthy that the only record I can find with respect to this 30 foot
building setback issue is from the general note on the approved subdivision map. If them
is any other pertinent information, I as not aware of it at this time.
