IRVING CANDEE, residing at 7890 Hicks Road, Baldwinsville, New York, ROBERT ME.DINA, residing at 5247 Fox Hill Lane, Camillus, New York and E:DWIN A. HALLBERG residing at 11431 Highway 70 West, Suite 308, Clayton, North Carolina, 27520 parties of the first part and TOWN OF ITHACA with offices at 126 Fast Seneca Street, Ithaca, New York 14850 party of the second part. WITNFSSETH. that the parties of the first part, in consideration of One and 00/100 Dollar (51.00), lawful money of the United States, and other good and valuable consideration, paid by the parties of the second part. do hereby grant and release unto the parties of the second part, their heirs, executors, successors, distributces and assigns forever, ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, "Tompkins County, State of New York, and being more particularly hounded and described as follows: COMMENCING at a point in the northerly boundary of East King Road which point is approximately 659 feet westerly along said north line from its intersection with the west line of Troy Road and which point of beginning is in the southwest corner of premises known as Whitetail Drive and conveyed to the Town of Ithaca by Deed recorded in Book 642 of Deeds at page 103. running thence north 82 degrees 3 minutes 24 seconds west along the highway boundary of East King Road, a distance of 40.09 feet to an iron pin at the southeast corner of premises reputedly owned by Mendelis (Book 635 of Deeds at page 742): thence north 7 degrees 36 minutes 19 seconds cast along the easterly line of Mcndclis, a distance of 199.95 feet to an c iron pin at the northeast of the Mendelis property; thence north 82 degrees 3 minutes 51 seconds west along the northerly line of Mendelis and premises reputedly owned by Montgomery (Book 633 of Deeds at page 911) passing through an iron pin at the northwest corner of Mendelis, a total distance of 200.03 feet to an iron pin; thence north 81 degrees 4 minutes 34 seconds west along premises reputedly owned by Verhelle (753 Deeds at page 89), a distance of 71.58 feet to a three-quarter inch rebar located at an easterly line of premises conveyed to the Town of Ithaca by Deed of Edwin Hallberg dated December 30, 1998 recorded in Book 841 of Deeds at page 101; cunning thence north 36 degrees 36 minutes 4 seconds west along said Town of Ithaca 116LR 862 FACE 332 parcel, a distance of 186.68 feet to a three-quarter inch rebar; running thence north 34 degrees 43 minutes 5 seconds west along said Town of Ithaca parcel, a distance of 34.77 feet to an iron rebar; thence north 85 degrees 46 minutes 40 seconds cast, a distance of 23.39 feet to an iron rebar located in the approximate southwest corner of premises reputedly owned by Belyea (662 Deeds at page 1033). thence southeasterly along the southwest lines of premises reputedly owned by Belyea, Lord (662 Deeds at page 261) and Maddock (745 Deeds at page 278). a distance of approximately 203 feet to an iron pin in the southwesterly line of Maddock; thence south 82 degrees 3 minutes 51 seconds east passing through an iron pin at 261.60 feet, a total distance of 292.68 feet to an iron pin in a westerly line of Whitetail Drive; thence southerly on a curve to the right with a radius of 453.97 feet an arc distance of 93.85 feet along the westerly line of Whitetail Drive to an iron pin; thence south 7 degrees 52 minutes 48 seconds west along the westerly line of Whitetail Drive, a distance of 126.83 feet to a point in the north line of King Road Gast and the point of beginning. It is the intention to convey the premises shown as "Parcel 'C'" on a map entitled "Survey Showing Parcels "A", "B" and "C" for Hallberg Associates" dated April 28, 1992, filed in the Tompkins County Clerk's Office June 10, 1992 in Drawer U, Sheet 54, excluding the portion of Parcel C that is being conveyed substantially concurrently by the grantors to David and Illa Burbank. Reference is also made to a map entitled "Subdivision Map Lands of Edwin Hallberg, Ted Kinder, ct al. and Malloy Bros. Construction" dated October 5, 1998, filed in the Tompkins County Clerk's Office February 25, 1999 in Drawer KK, Sheet 168. The westerly portion of the premises being conveyed by this Deed are more particularly shown on said 1998 Hallberg, et al. Subdivision Map. BEING a portion of the premises conveyed to the grantors herein by deed of Deer Run Investors. L.P. dated March 5, 1990 recorded May 3, 1990 in the Tompkins County Clerk's Office in Book 654 of Deeds at page 156 and Eking a portion of parcel "C" as show on a map entitled "Survey Showing Parcels "A", "B" and "C" for Hallberg Associates" dated April 28, 1992 filed in the Tompkins County Clerk's Office June 10. 1992 in Drawer U, Sheet 54. This property is conveyed to the Town of Ithaca for general municipal purposes. TOGETHER with the appurtenances and all the estate and rights of the parties of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, their heirs, executors, successors, distributees and assigns forever. AND said parties of the first part covenant as follows: FIRST: That the party of the second part shall quietly enjoy the said promises. SECOND: That said parties of the first pact will forever warrant the title to said premises.
