ALL THAT TRACTOR PARCEL OF LAND situate in the Town of Ithaca, Tompkins
County, State of New York, and being more particularly bounded and described as follows:
COMMENCING at a point in the southeast corner of a strip of land conveyed to the
Town of Ithaca by deed of Ilospicare Foundation, Inc. dated August 31. 1993, recorded
i November 12, 1993 in the Tompkins County Clerk's Office in Book 713 of Deeds at page 127
and which point of teginning is the following courses and distances from the intersection of the
northerly line of King Road East with the west line of Whitetail Drive:
(a) Running westerly approximately 594 feet along the northerly line of King Road
Fsast to a point, which point is the southeasterly corner of the premises described
in the Deed from the County of Tompkins to Edwin Hallberg recorded in the
Tompkins County Clerk's Office in Book 795 of Deeds at page 38.
(b) Continuing along the northerly lire of King Road East an are distance of 236.02
feet on a curve to the right with a radius of 962.80 feel to an iron pin;

(c) Thence north 55 degrees 45 minutes 55 seconds west along the northeasterly lime
I of King Road Last 81.86 feet to an iron pin;
(d) Thence north 49 degrees 27 minutes 27 seconds east a distance of 372 feet to an

(e) Thence north 23 degrees 4 minutes 4 seconds west a distance of 114.03 feet to

an iron pin which pin is the point or place of beginning.
Running from said point of beginning the following courses:
1. North 5 degrees 22 minutes 51 seconds cast along the east line of said strip of land
conveyed to the Town of Ithaca (713 Deeds 127) a distance of 30 feet to iron pin;
2. Thence south 23 degrees 4 minutes 4 secoWs rant, a distaiwe of approximately 113 49
feet to a point which is a northwest corner of the premises conveyed by I-Awin I lallbetg
dated 1)axmber 31, 1998. recorded February 25, 1999 in the Tompkmc County Clerk's
Office in Book 841 of Ikeds at page 101.
3. Thence south 49 degrees 27 minutes 72 smonds west along a westerly line of said
Ilallterg parcel, a distance of 30.15 feet to iron pin;
4. Thence north 23 degrees 4 minutes 4 seconds west, 114.03 feet to the point or place of
beginning.
It is the intention to describe a strip of land approximately 30 feet in width running easterly front
the strip of land already owned by the Town of Ithaca (Book 713 of Deeds page 127) to the west
lira: of premises being conveyed by Edwin I Ialllxrg Io tile 'town of Ithaca by the deed above
referenced, all as shown on a map entitled "Subdivision Map off -ands of Iidwin I Ialllxng; Ted
Kinder, et al., and Malloy Bros. Construction - Town of Ithaca - Tompkins County - State of
New York" dated (htoher 5, 1998. a copy of which was filed February 26, 1999. The strip
being conveyed is the southerly portion of the 8139 square feet parcel out of the northeast corner
of Lot 12 of the Saunders Road subdivision.
SUBJECT to the following insofar as the same affect the above described premises:
1. An unrecorded easement to the Town of Ithaca for a sewer line.
2. A sewer line easement given by Manos to Auble by Deed recorded in Book 641
of Deeds at page 1062.
BEING a portion of the premises conveyed to Malloy Brothers Construction, Inc. by
Deed of Ilospicare Foundation, Inc. dated l3ccember 8, 1992, recorded January 25, 1993 in the
Tompkins County Clerk's Office in Book 692 of Deeds at page 325.
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises.

AND said party of the first part covenant as follows:
FIRST: That the party of the second part shall quietly enjoy the said premises.
SECOND: That said party of the first part will forever warrant the title to said premises.
THIRD: That, in Compliance with Section 13 of the Lien Law, the grantor will receive
the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of tl►c improvement and will
apply the same first to the payment of the cost of the improvement before using any part of tlx:
total of the same for any other purpose.
