Ted Kinder, et al. and Malloy Brothers Construction - Town of Ithaca - Tompkins County - State of New York" dated October 5, 1998, a copy of which is intended to be filed concurrently with this Deed. BEING a portion of the premises conveyed to Bill J. Manos by deed from Griffley Corporation dated April R, 1983 and recorded April 12. 1983 in the Tompkins County Clerk's Office in Book 593 of Deeds at page 999. BEING of a portion of the premises described as serial number 95 and as Town of Ithaca Tax Parcel 44-1-4.312 in the Tax Foreclosure Deed from Scott Heyman, as Tompkins County F 1� p tim Mina 278 Administrator, to County of Tompkins dated April 10, 1997 and recorded April 10. 1997 in Liber 792 of Deeds at page 236 and being a portion of the premises described in the deed to Edwin Hallberg from the County of Tompkins dated April 11, 1997, recorded in the Tompkins County Clerk's Office in Book 795 of Deeds at page 38 and being the same premises conveyed by Edwin Hallberg to the Town of Ithaca by deed dated December 30, 1998 recorded February 25, 1199 in Book 841 of Deeds at Page 101. The purpose of the within deed is to surrender any claim or interest the said Bill J. Manos may have in and to the parcel that was foreclosed by Tax Foreclosure Sale. TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, their heirs, distrihutees and assigns forever. AND said party of the first part covenant that, in compliance with Section 13 of the Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be, applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same lix any other purpose.
