WESTMONT and LOIS S. WESTMONT, residing at 206 Forest Home Drive, Ithaca, New York, 14850, parties of the first part, and TOWN OF ITHACA, a New York municipal corporation, having offices at 126 East Seneca Street, Ithaca, New York, 14850, as tenants by the entirety, party of the second part, WITNESSETH, that the party of the first pan, in consideration of One and 00/100 Dollar ($1.00), lawful money of the United States, and other good and valuable consideration, paid by the parties of the second part, does hereby grant and release unto the parties of the second part, their heirs, distributees and assigns forever, ALL THAT CERTAIN TRACT, PIECE OR PARCEL OF LAND lying, situate and being in the Town of Ithaca, County of Tompkins and State of New York, bounded and described in more particularly detail on Schedule A annexed hereto and made a pan hereof: BEING A PORTION of the premises conveyed to parties of the first pan by Deed dated August 1, 1997 and recorded August 1, 1997 in the Tompkins County Clerk's office in advance of the recording of this Deed. TO HAVE AND TO HOLD the premises herein granted unto the party of the second pan, their heirs, distributees and assigns forever. AND said parties of the first part covenants as follows: FIRST: That the party of the second part shall quietly enjoy the said premises. I SECOND: That said parties of the first pan will forever warrant the title to said premiss. THIRD: That, in compliance with Section 13 of the Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a j trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. IN WITNESS WHEREOF, the parties of the first pan has hereunto set his hand and seal • • 0 • tim 804 Pot 39 Schedule A ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Ithaca, County of Tompkins and State of New York, being more particularly bounded and described as follows: i COMMENCING at a point in the centerline of Forest Home Drive, which point lies 655.7 feet, more or less, northwesterly along said centerline from it% intersection with the centerline of Warren Road; THENCE North 54' 35' Fact, at 25 feet passing through a point marked by an iron pin, a total distance of 180.3 feet to a point, which point is the POINT OR PLACE OF BEGINNING; THENCE North 54" 35' East, along other premises of Town of Ithaca (Libor 597 of Deeds at Page 498). a distance of 8 feet to a point marked by an iron pin; THENCE South 32" 57' East, continuing along said premises of Town of Ithaca, a distance of 26 feet to a point; THENCE North 50' 15' West a distance of 26.9 feet to the point or place of beginning. Said premises are depicted as the "Area to he Conveyed to Town of Ithaca (73.6 SF)" on that certain survey map entitled "Survey Map of 206 Forest Home Drive - Lot 92 - Town of Ithaca - Tompkins County - New York", dated July 30, 1997, prepared by Kenneth A. Baker, L.S. #149415, a copy of which was recorded in the Tompkins County Clerk's Office together with the deed of said premises to grantors on August 1, 1997 in Libor 801 of Deeds '► i at Page 141, the subdivision of which premises was approved by the Town of Ithaca Planning Board as evidenced by the Certificate of Approval affixed September 5, 1997 to a copy of • said map, which copy is to be filed concurrently with the recording of this instrument. 0 . 75 804 ►ast 40 f IN WITNESS WHEREOF, the parties of the first part has hereunto set his hand and seal the day and year first above written.
