THIS INDENTURE made 7 r this dry of May, Nineteen Hundred and Ninety -Six
BI3TWEEN STEPHEN P. LUCENTE of 981 Taughannock Boulevard, Ithaca, New
York 14850, party of the first part, and
TOWN OF,ITHACA, a New York Municipal Corp., with office at
126 East Seneca Street, Ithaca, New York 14850,
patty of the second part,
WITNESSETH, That the party of the first part, in consideration of ONE AND NO! I W
Dollars ($1.00) lawful money of the United States, and other good and valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second
part, its successors and/or assigns forever,
ALL THAT TRACI' OR PARCEL OF LAND situate in the 'Town of Ithaca, County
of Tompkins and State of New York, being a part of Military Lot No. 89 in said 'Town and
hounded and described as follows:

BEGINNING at a point in the centerline of Sapsucker Woods Road, a distance of
approximately 125 feet northerly along said centerline from the southeast corner of Military Lot
89, which point of beginning is also the northeast corner of premises now or formerly of
Stoneman (see Liber 698 of Deeds at page 54); proceeding thence along the centerline of
Sapsucker Woods Road North 7" 42' 37" East a distance of 62.56 feet to a point marking the
southeast corner of premises conveyed to Patricia W. Lucente recorded in the Tompkins County
.Clerk's Office in Liber 715 of Deeds at page 104, proceeding thence North 81. 46' 21" West
along the southerly line of said Patricia Lucente premises, passing through an iron pin at 24.12
feet set in the westerly line of Sapsucker Woods Road and continuing for a total distance on this
course of 149.18 feet to an existing iron pin; proceeding thence North 7` 14' 30" East a distance
of 11.97 feet to a pin marking the southeasterly corner of subdivision Lot 12 on the subdivision
map hereinafter referenced; proceeding thence North 81> 54' 17" West along the southerly lines
of Lots 7 through 12 of said subdivision, a total distance of 609.20 feet to a monument set in
the west line of premises of Rocco Lucente (see Liber 370 of Deeds at page 106), said
monument marking a corner of a temporary cul-de-sac more particularly shown on the
subdivision map hereinafter referenced, which is more particularly described in the temporary
easement from Rocco P. Lucente to the Town of Ithaca, dated August 24, 1995 and recorded
in said Clerk's Office in Liber 756 of Deeds at page 344; proceeding thence South 8` 05' 43"
West a distance of 50 feet along the easterly boundary of said temporary cut -de -sac to an iron
pin marking the northwesterly corner of subdivision Lot 6; proceeding thence South 81 " 54' 14"
Lust along the northerly tines of subdivision Lot% I through 6 as shown on the subdivision map
hereinafter referenced a distance of 560 feet to a pin; proceeding thence South 55" 10' East
along the northeasterly boundary of said subdivision Lot l a distance of 55.52 feet to a pin

marking the westerly corner of the above referenced Stoneman premises (698D54); proceeding
thence South 81, 56' 59" east along the northerly line of said Stoneman premises, passing
through a pin at 125.07 feet for total distance on this course of 149.38 feet to the centerline of
Sapsucker Woods Road at the point or place of beginning.
REFERENCE is made to the subdivision plat entitled, "Final Subdivision Plat Sanctuary
Woods, Developer Steve Lucente, Town of Ithaca, County of Tompkins, State of New York",
dated January 21, 1994, last revised June 29.1994 by Lawrence P. Fabbroni, P.E.&L.S., a copy
of which map was filed in said Clerk's Office on August 31, 1995 in Map Drawer CC, Sheets
145 and 146,
It is intended to describe and convey by this deed the premises shown and denoted on said
subdivision map as "Sanctuary Drive".

SUBJECT TO the following insofar as they may affect the above described premises:
I. pole line easements granted to New York State Electric and Gas Corporation by 1
instruments dated October 10, 1935 and December 10, 1959 and recorded in said Clerk's Office
in Liber 241 of Deeds at page 306 and Liber 425 of Deeds at page 402, respectively;
2. gas main easements granted to New York State Electric and Gas Corporation by
instruments dated December 10, 1959 and two, both dated June 19, 1968 and recorded
respectively in said Clerk's Office in Liber 425 of Deeds at page 404 and Liber 477 of Deeds
at pages 149 and 151:
3. a water main easement granted to the Town of Ithaca by instrument dated May 19,
1959 and recorded in said Clerk's Office in Liber 417 of Deeds at page 162; and
4. a sewer easement granted to the Town of Ithaca by instrument dated June 15, 1965 and
recorded in said Clerk's Office in Liber 460 of Deeds at page 375.

TOGETHER WITH the appurtenances and all the estate and rights of the party of the F
first part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, its successors and/or assigns forever.

AND the party of the fast part covenants as follows:

FIRST, That the party of the second part shall quietly enjoy the said premises;
SECOND, That said party of the first part will forever WARRANT the title to said
premises.
THIRD, That, in Compliance with Sec. 13 of the Lien Law, the grantor will receive the
consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
IN WITNESS WHEREOF, the party of the first part has hereunto set his hand and seal
the day and year first above written.
