its principle offices located at 16 East Enfield Center Road, Ithaca, New York,
party of the first part, and
TOWN OF 1TIiACA, a municipal corporation in the County of Tompkins, State of New
York, with offices at 126 East Seneca Street, Ithaca, New York
party of the second part,
WITNESSET I, that the party of the first part, in consideration of One and 00/100 Dollars
($1.00) lawful money of the United States, together with other good and valuable consideration
paid by the party of the second part, do hereby grant and release unto the party of the second part,
its respective heirs, distributees, and assigns forever
ALL TI [AT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of
Tompkins, State of New York, and being more particularly bounded and described as follows:
BEGINNING at a point in the centerline of Seven Mile Drive which point is 1,418 feet,
more or less, northeasterly from the intersection of the said centerline line of Seven Mile Drive
with the intersection of the centerline of New York State Route 13; running thence South 69
degrees 27 minutes oo seconds East passing through an iron pin at 25.31 feet, a total of 657.15 feet
to a point in the centerline of a stream which point is also in the northwesterly boundary line of
premises now or formerly of International Assoc. of Machinist (613/979); running thence
northeasterly along the said centerline of said stream a distance of 517 feet more or less, on a
chord bearing of North 67 degrees 42 minutes 50 seconds East a distance of 512 feet to an iron pin;
thence North 11 degrees 32 minutes 10 seconds East a distance of 243.65 feet to an iron pin;
thence North 89 degrees 59 minutes 50 seconds West a distance of 765.48 feet to an iron pin;
thence North 41 degrees 17 minutes 45 seconds West a distance of 56.69 feet to an iron pin;
thence southwesterly and westerly on a curve to the right a distance of 153.29 feet on a chord
bearing and distance of South 75 degrees 38 minutes 00 seconds West 148.15 feet to an iron pin;
thence North 78 degrees 32 minutes 04 seconds West a distance of 145.78 feet to a point in the said
centerline of Seven Mile Drive; thence South 11 degrees 34 minutes 05 seconds West along said
centerline of Seven Mile Drive a distance of 241.97 feet to the point or place of beginning.
Reference is hereby made to a survey map entitled "MAP OF SURVEY PARKLANDS TO
BE CONVEYED TO TIIE TOWN OF ETI IACA, TOWN OF ITHACA, TOMPKINS COUNTY,
NEW YORK", dated August 30, 1994 as prepared by Robert S. Russler, Jr., L.S., a copy of which
survey is being filed with the Tompkins County Clerk's Office concurrently herewith and which
survey is incorporated herein by reference hereto.
Subject to the following insofar as they may affect the above described premises:
1. The right of the Grantor herein to construct a sewer line for subsequent conveyance to
the Town of Ithaca in a 30 foot wide permanent sewer easement and a 50 foot wide temporary
sewer easement as more fully set forth on the survey filed concurrently herewith.
2. The rights of the public in and to that portion of the above -described premises lying
within the bounds of a public highway.
3. An Easement to New York State Electric & Gas Corporation for a pole line dated July
15, 1936, recorded September 22, 1936 in the Tompkins County Clerk's Office in Liber 241 of
Deeds at page 44.

4. A gas pipeline easement to New York State Electric & Gas Corporation dated July 28,
1964, recorded in said Clerk's Office September 2, 1964 is Liber 452 of Deeds at page 881.
5. An Easement to New York Telephone Company for buried cable dated November 1,
1%9, recorded July 22, 1970 in said Clerk's Office in Liber 488 of Deeds at paqe 357.
6. An Easement to New York State Electric & Gas Corporation for gas pipeline by
instrument dated April 30, 1987, recorded June 2,1987 in said Clerk's Office in Liber 626 of Deeds
at page 907, incorrectly shown in deed to grantor as 927.
BEING a portion of the premises conveyed to the Grantor herein by deed of Finger Lakes
Management Corp., dated May 12, 1993 and recorded in the Tompkins County Clerk's Office in
Liber 698 of Deeds at page 286.
The premises herein described are to be used as parklands.
GRANTOR certifies that this conveyance does not represent a conveyance of all or
substantially all of the assets of Grantor and is made in the ordinary course of Grantor's business.
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
its respective heirs, distributees, and assigns forever.
AND said parry of the first part covenants as follows:
FIRST, that the party of the second part shall quietly enjoy the said premises;
SECOND, that said party of the first part will forever WARRANT the title to said premises.
THIRD, that in Compliance with Section 13 of the Lien 1_aw, the grantor will receive the
consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of the cost of the improvement before using any part of the total of the
same for any other purpose.
